Parents and Youth Reminded of Curfew Laws
With summer's longer periods of daylight, parents and youth in Plymouth are reminded that
youth under age 18 in Plymouth must abide by the Hennepin County curfew ordinance.
The county curfew ordinance prohibits juveniles from being in public places or establishments
during certain nighttime hours. A public place is any place to which the public or a substantial portion
of the public has access. This includes streets, highways, parks and schools. An establishment is a
privately -owned place of business such as a movie theater, restaurant, bowling alley or coffee shop.
The curfew requirements are:
Under age 12
• Sunday, Monday, Tuesday, Wednesday, Thursday -- Home by 9 p.m.
• Friday and Saturday -- Home by 10 p.m.
Age 12 -14
• Sunday, Monday, Tuesday, Wednesday, Thursday -- Home by 10 p.m.
• Friday and Saturday -- Home by 11 p.m.
Age 15 -17
• Sunday, Monday, Tuesday, Wednesday, Thursday -- Home by 11 p.m.
• Friday and Saturday -- Home by Midnight

The curfew is lifted 7 days a week at 5 a.m.
The curfew contains a number of exceptions. It does not apply if the juvenile is:
With a parent, guardian, or other responsible adult;
At work or in the process of going to or coming home from work;
Involved in an emergency;
• Going to, attending, or coming home from a supervised school, church, or recreational activity;
Running an errand at the direction of his/her parent or guardian;
• Traveling interstate;
In front of his/her own residence or the property next-door to the residence; or
Engaged in the valid exercise of First Amendment rights.
Violation of the curfew may lead to a fine and/or court appearance. Under the curfew ordinance, a
parent or guardian is guilty of a misdemeanor if the parent knowingly, or through negligent
supervision, permits a juvenile to break curfew.

estimates. I appreciate your reviewing and correcting the numbers of permits
Issued for single-family, detached units during December of 2001. As a result of
your research I have raised the number of households in Plymouth to 25,829 and
the April 1, 2002 population to 67,824 residents.
Your offer to break down the numbers of permits issued by month for calendar
years 2001 and 2002 will be very helpful to me in completing the estimates for
April 1, 2003. 1 will be sending revised estimates to the Department of Revenue
this week.

FIRE -RESCUE INCIDENT OF INTEREST
DATE: 07/14/03 TIME: 12:43 a.m. ADDRESS: 14420 28" Place N.
DETAILS: The Department was dispatched to a reported business fire at the Arby's
Restaurant. Initial callers reported flames showing from the business. Police officers
arriving a short time later confirmed a heavily involved structure fire.
Upon arrival, Tower 11 (Specken, Evenson, Weldon, Nordby, Perbix, and D. Carlson) and
Ladder 31 (W. Hebert, Sheldon, Ahrens, Berg, Peterson, and Hughes) placed elevated
master streams and handlines into service. They were assisted by Aerial 21 (Hendrickson,
P. Branyon, Baker, and O'Leary) and Engine 11 (Dore, B. Fasching, D. Fasching, and
Korsmo).
The fire was contained to the area already involved. An exterior operation was conducted
due to the potential for structural collapse. The building sustained significant damage,
including a major structural collapse, and is considered a total loss. The fire was placed
under control 54 minutes following fire department arrival.
Forty-three members of the Plymouth Fire Department responded to the fire. There were
no civilian or firefighter injuries.
RESPONSE TIME: 8 minutes.
FIRE ORIGIN/CAUSE: Under investigation by the State Fire Marshal's Office.
ESTIMATED FIRE LOSS: Not yet determined.

In view of the fact that City Manager Dwight Johnson was absent, as well as two of the
new appointees, there was discussion on amending the agenda to defer orientation and
discussion of the 2003-2004 meeting calendar to the July 14 meeting. Ifna made a
motion, seconded by Janet, to amend the agenda. The motion passed in a unanimous
voice vote.

Recap by Attendees at the League of Minnesota Cities Conference
Youth interviews
Members who attended the St. Cloud League of Minnesota Cities Conference reported on
activities they attended. Highlights they found especially interesting included the
keynotes speaker, Chris Gates, who spoke about citizen involvement in government.
They also enjoyed the closing speaker, Maryann Jennings, who addressed issues of ethics
in government.
Intergenerational Committee
The committee is planning the next Bridging the Gap event on Thursday, October 16`h, a
release date for both Wayzata and Robbinsdale area schools. The topic will be "TV News

—Are we getting what we want?" Regina is working on providing a panel of local
media personnel. Dennis Douda, of WCCO-TV, has already agreed to be one of the
panelists.
Youth Center Committee
Mike reported that a community committee will be meeting on Tuesday, June 24 to
discuss the latest work on development at the workhouse site.
Marketing Committee
Adam agreed to serve as the new committee chair. The group will make an effort to set
up the "YAC Shack" at the Music in Plymouth event July 2.
Future Agenda Topics
At the next meeting, in addition to an orientation for new members, and a discussion of
the meeting calendar for the coming year, members will discuss selection of chair or
co-chair positions. The group will also begin discussions about goals and objectives for
the coming year.

SUBJECT: DRAINAGE CONCERNS
Dear Ms. Stobbe:
I am responding to your June 23, 2003 letter to City Manager Dwight Johnson in which
you expressed concerns with drainage issues regarding the Stone Creek Village
development near the intersection of West Medicine Lake Drive and Highway 55. In your
letter you indicate that drainage issues have worsened since the Stone Creek development
project has started this past spring resulting in more water draining towards your property
located at 11215 —12`h Avenue.
In researching your concerns, which you have discussed with Engineering staff in the past,
we understand that there is a need for some channel and/or pipe cleaning to facilitate the
flow of water through the wetland area adjacent to your property and northerly under the
railroad tracks north of your property to Medicine Lake. In reviewing the site grading plan
for your property and the parking lot adjacent to the wetland, it does appear that the corner
of your parking lot will be under water in periods of significant storm water events. It is
certainly possible that the water levels on your driveway have become higher recently due
to blockages either in the downstream railroad culvert as well as the channel through the
wetlands which may need to be excavated to facilitate the flow. We will be checking this
condition out and if channel work does need to be done, it would likely be scheduled to be
done under frozen conditions this winter. The railroad culvert is the responsibility of the
railroad, but we will contact them requesting their cooperation if their culvert is blocking
drainage.
With respect to your expressed concerns about the Stone Creek Village development
creating a worsened problem for your property, no fill has been placed within the wetland
area and the ponds required to hold and treat storm water have not yet been constructed.
The work done thus far should not be causing an increase in flow toward your property as
no additional hard surface has been constructed. It is our understanding these ponds will
be constructed this fall or early next year depending on site conditions and these ponds are
designed to control the rate of runoff to predevelopment conditions. City staff will

all work is completed in a satisfactory manner.

taken place. Several loads of fill have been brought in to develop the Stone Creek project. It
does not seem, however, that there is sufficient ponding to compensate for the extra fill since we
are getting additional drainage unto our property.
It is the City of Plymouth's responsibility to ensure that the buildings at the property 11215 12th
Ave. N. are not damaged by water due to drainage issues caused by this project or others in the
area. The city engineers had the opportunity to thoroughly examine this issue, as we urged in
August 2001, before approving the project. We strongly recommend that the City reevaluate the
ponding areas of the project while it is still in progress.

RE: City of Plymouth Water System Report -2002
Mayor Johnson,
Thank you for returning my call the week of June 30 regarding my concerns over the
drinking water quality as reported in the City of Plymouth Water System Report 2002.
As a citizen of the community and the father of two young children, I felt compelled to
contact you again regarding my concerns. In brief, there are areas of Plymouth that are
shown to have levels of Copper that exceed the EPA Action Level. The highest allowed
amount by the EPA is 1.3 ppm but 23% of homes tested showed levels of approx 1.74
ppm. Per the report, short-term exposure could lead to gastrointestinal distress and long-
term effects include possible liver or kidney damage.
In speaking to the City of Plymouth water treatment staff, I have learned that the areas
most affected are those serviced by the Zachary Water Treatment Plant. I was told that
the type of filtration system this plan utilizes raises the level of dissolved oxygen, which
directly results in aggressive leaching of copper pipes. Through my research, I also
learned that the City of Plymouth adds Zinc Ortho Phosphate to the water as a corrosion
inhibitor. The problem with this type of treatment is that any home with a water softener
greatly reduces the effectiveness of the corrosion inhibitor. Finally, I understand that
correcting the issue at the Zachary plan will not occur until late 2005. That is two years
from now, two more years that children and adults will be drinking tainted water.
I have two major issues with the report:
First, The City of Plymouth Water System Report 2002 fails to inform residents in
those specific areas served by the Zachary Plant of the high levels of copper.
Second, there is nothing in the report that spells out what residents can do to
protect themselves and their children from the dangers of copper poisoning.

I would like to see the City of Plymouth take action to better inform those residents
affected by the Zachary plan. I would recommend the following steps:
1) An article be placed in the local newspaper showing a detailed map of those
affected areas and measures that residents can take to protect themselves
2) A follow up mailer to residents in the affected areas with the detailed map and
measures that residents can take to protect themselves.
I am sure you would agree that all Plymouth residents deserve safe drinking water and
those residents who do not currently have safe water should be informed quickly of the
issue and how to protect themselves.

Dear Mr. & Mrs. Suppes:
Mayor Judy Johnson forwarded your letter dated July 15 to David Hinners at Lundgren
Brothers, concerning landscaping in the Wyndermere Farms neighborhood. She asked
staff to determine whether there were any city requirements relating to your desire for a
berm and trees as a transition from the villas and the traditional homes along your street.
The city -approved grading plan for the development shows no berms in the vicinity of
46th Avenue and Merrimac Lane. It appears that there would not be sufficient space for
berms in the yard areas between the planned homes and the street, and that berms could
negatively affect the drainage plan for the area. Because Wyndermere is a single-family
neighborhood the city did not require a landscape plan. The City Code does not require
any buffer or screening between detached homes, regardless of their styles or price
ranges.

Dear Mark and Kim,
I want to update you on improvements that will be taking place near your
home. 46`h Avenue North has now been constructed and will intersect
with Merrimac Lane North.
Shone 612.473.1231 There was preliminary talk of a burm and trees going along Merrimac to

family. Due to drainage issues, a burro will not be constructed. However,
East Wayzata Boulevard Lundgren Bros will be planting Spruce trees along Merrimac, which will

For timing, we do need to wait for the remaining utilities to be installed on
46`x' Ave. The trees could be planted as soon as two weeks or as late as

Dear Mr. Hinners,
As far back as the summer of 2000 the issue of whether to build single family homes or villas along 46th Avenue
was undecided. The representation made to us at that time by Lundgren Bros. sales staff (Patty Tauscher and
Michelle Rademacher) were earth berms, similar to those on Jewel Lane, would be built to create a transition buffer
between the style of homes. This was a selling point in our decision to build/buy our home at 4545 Merrimac Lane
North. It's come to our attention Lundgren Bros. plans to construct villas along 46th Avenue right up to Merrimac
Lane. In other words, the corner lots are to be built upon rather than used as space for earth berms (i.e. transition
buffers). There are three points I would like to bring to your attention.
1) Misrepresentation - I am very disturbed by the misrepresentations made by Lundgren Bros. and it's agents.
Furthermore, they're are other families living along Merrimac, as well as residents living in the villas, that have been
told the same story.
2) Drainage - Michelle Rademacher, in her letter dated July 1, 2003 (see enclosed copy), referenced the issue of
drainage as to why villas were going to be built versus earth berms. I truly struggle to understand this logic.
Common sense tells me an earth berm, sod and trees will do a better job absorbing watershed than a roof.
3) Safety - Earth berms will limit what a driver can see as traffic moves westbound on 46th Avenue onto Merrimac
Lane. In other words, it forces a driver to slow down as he/she turns left/right onto Merrimac. I would suggest an
earth berm will work better than a "Stop" or "Yield" sign ................ With so many children living along Merrimac I
consider the matter of public safety to be of utmost importance.
To conclude, we were disappointed to hear this news and would like an explanation of what is going on,

Dear Resident/Land Owner:
The City has recently received an application from CSM Corporation, under File No. 2003076,
for 1) a comprehensive plan amendment to reguide property from IP (Planned Industrial) to C
(Commercial), and 2) a PUD (Planned Unit Development) Sketch Plan. The proposal would
allow redevelopment of the Dana Spicer site located at 15905 State Highway 55 with 263,000
square feet of retail commercial uses. A map indicating the location of the area is provided
below.
This letter is being mailed to all landowners within 750 feet of the site in order to provide notice
and information about the application — in advance of the official notice that will be sent out
prior to the Planning Commission's public hearing on the matter. The City will -send out another
letter notifying you of the Planning Commission public hearing date, not less than ten days prior
to the hearing date. The purpose of the public hearing is to allow neighboring property owners to
appear in front of the Planning Commission to ask questions and make comments relating to the
application. You may.also submit comments in writing. All written comments will become part
of the public record.
If you have any questions or comments concerning this application or the review procedures,
please call Shawn Drill, Senior Planner, at (763) 509-5456.
In addition, you may review information relating to this application at City Hall during regular
