1. NORTHWEST SUBURBS CABLE COMMUNICATIONS COMMISSION -- Friday morning
at the regular monthly meeting of the Northwest Suburbs Cable
Communications Commission, we received a report from John Eddy of
Suburban Cable that they were proposing to realign the channel
line-up effective January. They contend that under the new Federal
law, the cable company has the unilateral right to make such channel
changes (protected by the first amendment). A copy of John Eddy's
memo on this topic is attached along with the proposed channel
line-up revisions. The most significant change from our perspective
would be the assignment of our current channel 7 to the MTV, while
our local government access channel would become channel 50. The
Cable Commission indicated dissatisfaction with the proposed
revision to the channel line-up and has instructed it's Executive
Director and the Executive Committee to work with the Commission's
attorney to explore what options may be available. Mr. Eddy also
advised the Commission that effective January 1, the company will be
increasing the basic monthly subscription rate from $10.45 to
$13.45. The company has been under a rate cap under the current
franchise ordinance, which cap expires at the end of this year. In
addition, the company will be, in effect, eliminating both the
universal (free) and family rate tier. (I-1)

2. LEAGUE OF MINNESOTA CITIES MEETINGS -- Thursday afternoon and
evening, I attended the meeting hosted by the Board of Directors of
the League of Minnesota Cities. The purpose of this meetinq was to
bring together representatives of the several lobbying interest
groups to determine the degree to which we might have issues in
common that might be solved through working in the League
structure. Besides the League Board of Directors and the Municipal
Legislative Commission, also present were representatives of the
Coalition of Outstate Cities, the League of Small Cities, and
lobbying representatives of both Minneapolis and St. Paul. The
League engaged Mr. Lyle Sumek of Sumek Associates to help facilitate
the meeting. A bottom line of the meeting was a general
understanding that we all could benefit if we were able to work
together and one way to foster that would be to share data bases and
maintain open and complete lines of communication. We did not
discuss divisive issues such as local government aids or other
fiscal matters.
Thursday morning, Councilmember Zitur and I attended the LMC's
Policy Adoption meeting. The League's legislative policies were
reviewed by the membership present and voted upon. There was no
change of significance to any of the policies presented and the
atmosphere was very relaxed as compared to previous years when
fiscal matters were very divisive.
3. RECOMMENDATION TO REMOVE PILGRIM LANE NEIGHBORHOOD HOCKEY RINK --The
Park and Recreation Director has recommended that the hockey rink at
the Pilgrim Lane neighborhood park be removed. Attached is his memo
setting forth the reasons for that recommendation. I concur in
Eric's recommendation. This particular rink was constructed well
prior to the time we completed our total comprehensive park
planning. Subsequently, of course, we have developed major hockey
facilities at various sites throughout the City. In this particular
area, those were located at the Plymouth Junior High School. We
plan to begin the dismantling of the hockey rink this week,
although, the area will continue to be used as a open free skating
area for the neighborhood. (I-3)
4. CITIZENS LEAGUE REPORT - FISCAL DISPARITY -- Attached is a copy of
an article from the Citizens League publication, "Minnesota
Journal", which reports that more than 27 percent of the Twin Cities
metropolitan region's commercial -industrial tax base will be shared
in the tax year 1987 under the state's fiscal disparities law. The
article also provides an analysis of the impacts of tax -base sharing
since the law went into effect in 1975. Plymouth's 1986 total
commercial -industrial tax base per capita after tax -base sharing is
$2,871. Our total growth in tax base per capita with tax -base
sharing since 1971 is $2,004. Without tax -base sharing for this
same period, it would have been $2,775. (I-4)

5. M.I.P. WATER TOWER PAINTING - UPDATE -- The contractor for the
painting of the M.I.P. water tower was to disinfect the tower last
Saturday in order that it could be placed back into service for this
winter. Because of the weather, no futher work can be completed on
the painting of the tower until this spring. The contractor had not
properly drained his water truck and the pump froze and broke
apart. Therefore, the contractor could not work on the water tower
on Saturday.
Fred Moore worked with the contractor on Saturday and Sunday at the
Public Works building to thaw out his water truck and repair the
part. This work was accomplished at about noon on Sunday. The
contractor completed the disinfection of the water tower on _Sunday
afternoon.
The City Water Department filled the water tower on Monday and
Tuesday and took a water sample for testing to ensure that it met
safe drinking standards. The test results were received on
Wednesday and the water met all required standards. The water tower
was placed back into service on Wednesday afternoon, November 19.
No further work will take place on finishing the painting of the
water tower until spring. Fred will be working with dim Thomson,
City Attorney, in preparing a recommendation on terminating the
present contract. The contractor is on notice that we are
considering the termination of his contract for not meeting the
required completion schedule. We will also be addressing an
extension of time as requested by the contractor and liquidated
damages as provided for in the contract.
6. TOWN MEETING STAFF RESPONSES -- Attached are copies of staff

RE: Proposed Channel Lineup Chancre
Enclosed is a letter from John Eddy proposing a new channel
lineup. Also enclosed is the Commission's procedure for con-
sidering such proposed changes.
The requested change was received by this office on November 12,
1986. As the proposed change affects access channels, the Com-
munity Television Corporation is to consider the proposed change
and may make a recommendation regarding access channels to the
Commission.
The proposed change has been placed on the agenda for information
purposes and no action is required.
Staff will report to the Commission regarding this proposal at
the December meeting.

Reply To:
Suburban Cablevision Company is planning to implement several
programming changes expected to strengthen the value of our
product and improve the viewing convenience of our subscribers.
First of all, we plan a realignment of our channels as indicated
in the attached current and planned line-up.
Secondly, we are please by the opportunity to add several new
services to our channel line-up. The Quality, Value, Convenience
Channel will be added to provide subscribers with a home shopping
service. The Discovery Channel will provide viewers with
educational/informational programming. KTMA, our regions newest
UHF station, will be made available. A second Pay -Per -View
channel will be added in anticipation of this segment of our
business continuing to grow.
Recently, a Preview Channel was added to insure that subscribers
are fully informed of programming events occurring on the cable
system. We also added C -Span II and Festival. With the
completion of our programming changes effective January 1, seven
programming services will have been made available to our
subscribers within a period of only six months.
To make room for these additions, three programming services
presently carried must be dropped from the line-up, or occupy
unused channel space presently reserved for access. The Learning
Channel, PTL Network, and the Spanish International Network are
the three channels affected.

We acknowledge commission jurisdiction with respect to the
deletion of any programming that affects overall mix, level and
quality of programming. We do not believe that the Commission
has jurisdiction with respect to our utilization of unused access
channels.
We believe that The Learning Channel, PTL, and the Spanish
International Network should in fact be retained and we ask for
your cooperation in locating space for them on channel bandwidth
presently reserved but unused for access.
Greg, we believe these changes are important to the success of
Suburban Cablevision Company and our ability to provide the
viewing convenience and choice our customers demand. We would be
happy to discuss these improvements with you.

RE: Policy regarding Programming Service Changes
At the June, 1985 Commission meeting, Staff was directed to meet with
representatives of Cable TV Northwest regarding a process for considera-
tion and implementation of programming service changes in light of
changes in federal law and municipal authority since the current program-
ming change policy was adopted. We have met with representatives of Cable
TV Northwest and recommend adoption of the following policy:
PROGRAMMING SERVICE CHANGE POLICY AND PROCESS
No change shall be made to Grantee's programming service offering nor channel
lineup prior to the completion of and compliance with all requirements set
forth below:
1. Notice: Grantee shall provide written notice of any pro-
gramming service or channel lineup change at least thirty
(30) days prior to the regularly scheduled Commission meeting
prior to the proposed effective date of such change. If the
proposed change will impact any local programming or access
channels such notice shall also be provided to the Northwest
Suburbs Community Television Corporation no later than thirty
(30) days prior to the regularly scheduled NWSCTC meeting
immediately prior to the Commission meeting referred to above.
2. In Grantee's notice required by section one above, Grantee shall
state its opinion as to whether the Commission has approval
jurisdiction over the proposed change. Grantee shall submit its
rationale and documentary information with the notice.
3. If Grantee acknowledges Commission approval jurisdiction over
the programming change, Grantee's notice shall include a demon-
stration that the mix, quality and level of services required
by the Franchise Ordinance at the time it was granted will be
maintained after the change or that the mix, quality and level
of services will not be maintained. If the mix, quality and
level of services will not he maintained, Grantee shall set
forth its rationale for the proposed change and its argument
as to why the Commission should approve such change.

4. If grantee does not acknowledge Commission jurisdiction
over programming changes, grantee may demonstrate that
the mix, quality and level of service is maintained or
that it is not maintained and put forth its rationale
for the change.
S. Grantee's notice shall be accompanied by a copy of Grantee's
current channel lineup and the revised channel lineup which
would be effective if the proposed change was made.
6. Upon receipt of Grantee's notice in compliance with Sections
1 through S above, Commission Staff and Grantee shall meet
to discuss the proposed change, jurisdictional questions, and
Commission review process. Such meeting shall occur prior
to any consideration of the proposed change by the Commission.
7. Grantee's proposed change and request for approval shall be
scheduled as an agenda item for consideration at the Com-
mission's first regularly scheduled Commission meeting follow-
ing thirty (30) days after receipt of the notice set forth
in Section 1 above.
8. Notwithstanding anything set.,forth in Section 7 above, the
Commission shall, in any event, meet within sixty (60) days
of receipt of the written notice set forth in Section 1 above.
A decision shall be made regarding the jurisdictional question
raised by Grantee's request within sixty (60) days of receipt of the
written notice set forth in Section 1 above, and failure to
meet or take action regarding such jurisdictional question
within sixty (60) days of receipt of such notice will be deemed
to be acceptance of Grantee's opinion regarding jurisdiction.
A decision shall be made on the merits of Grantee's request
within 120 days after receipt of written notice set forth in
Section 1 above, unless such 120 day period is extended by
mutual agreement of Grantee and Commission. The proposed
change shall be effective if the Commission after the 120
day period or a mutually agreed upon extension thereof takes
no action to disapprove the proposed change.

SUBJECT: PILGRIM LANE HOCKEY RINK
Due to problems with the gas furnace, budget constraints and the new facili-
ties at Plymouth Jr. High, the decision was made in 1984 to not operate the
warming house at Pilgrim Lane school/neighborhood park. At that time, we
contacted the president and vice president of the homeowners associations,
the principal of the elementary school and the youth athletic association.
General concurrence was reached, because of the opening of two new hockey
rinks one block away from this site and a new warming house, that it was
no longer necessary to operate this facility at the level it had previously
been maintained.
The plan has been to allow the hockey rink to stay in use as long as the
hockey boards were in a reasonably safe condition. Mark Peterson, our
Park and Environmental Supervisor, has indicated to me that the condition
of the boards is such that they do present a hazard to potential park
users. He has therefore recommended, and I concur, that it is now
necessary to remove the hockey boards from this site in order to maintain
a safe play environment. It is our intention to continue to maintain a
large pleasure skating rink with lights at this location.
The Park and Recreation Advisory Commission, at their November 13 meeting,
reviewed our recommendation and gave it unanimous approval. Unless I
hear differently from you, the park crew will begin dismantling this
rink on Tuesday, November 25.

review and comment. Your form requests that we
bikers and walkers along West Medicine Lake Drive.
The Comprehensive Trail Plan for the City of Plymouth contemplates a trail
that will circle Medicine Lake at some time in the future. We currently
have built a Class I trail from County Road 9 southerly down to 26th
Avenue. From that point south to Highway 55, because of the road's close
proximity to the water's edge, it has been difficult to proceed with any
type of trail improvements. Currently, the City Council has authorized
us to have our traffic consultant analyze this stretch of road for a
recommendation on how improvements might be undertaken for safety in this
area. This recommendation should be forthcoming shortly to the Park and
Recreation Advisory Commission for their review and recommendation to
the City Council. I wish to assure you that we will do everything in our
power to improve the situation along this stretch of road in a timely fashion,
working within the current budget guidelines that we have.

with the Director of public Works, Fred Moore, concerning placing sorme type of
siq_n on the current stop sign in the west part of the Plymouth Shopping Center.
In short, I relayed your message for a "STOP HERE ON RED", or suggested a sign
that would say "DO NOT STOP IN INTERSECTION".
Mr. Moore was going to check on the feasibility of signing this location per your
request-. If you do rot see it signed as you requested, the reason would be that
in the traffic engineer's opinion, it would not be effective.
If you should have further questions cr concerns regarding the aforementioned
intersection, please do not hesitate to contact me or Mr. Moore directly. Again,

Recently our office was notified by Mr. Wallace Urbanski who is the owner of the
property referenced above, regarding a problem of ground water seepage in the
underground transit heating ducts of his home.
Based upon Mr. Urbanski's request, an inspection of his property was performed by
Building Inspector, Arnie Rasmusson, who verified this information. Mr. Rasmusson
also discovered the draintile installed was at an elevation above the underground
duct system.
It is my understanding that Mr. Urbanski has contacted you on several occasions
regarding this matter, and that as of this date no corrective repair work has been
done to resolve this matter.
Rule #1345.1580 sub Part II of the Minnesota Heating, Ventilating, Air Conditioning
and Refrigeration Code states the following:
"Draintile. No underground duct shall be installed where water conditions may occur
unless means are provided to collect and drain surface and underground water by the
installation of draintile around the perimeter of the space served by the underground
duct system. The top of the draintile shall be at an elevation lower than the bottom
of the underground duct."
Failure to comply with this provision is considered a violation of the State Building
Code as well as the Plymouth City Code. I am therefore requesting that you provide me
with a letter which will indicate the following:
I. The corrective steps you will take to resolve this matter.
2. A scheduled date and time when the corrective work will commence.
Your letter must be received by me no latter than Wednesday, November 26, 1986. I
would recommend you communicate your efforts with Mr. Urbanski on this matter. It is
my intent to have a representative from our office present at the time the work is to
commence and inspect the work to be done as well as to review the items of Mr.
Urbanski's letter to you dated October 27, 1986.
I am confident this matter can be resolved without the need to proceed with any
further action.

I refer you to our conversation of November 10th,at which time I
advised you that I,:ark Danielson,the contractor,who built my house
had failed to set up a meeting with me and A. Rasmusson,Plymouth
Building Inspector.In our conversation I told you that I had. sent
Mr. Danielson a registered letter with a list of complaints involving
the house he built for me and completed to a point five months a3o.
The letter was mailed October 27th,and I did receive a phone call
from !,',Ir. Danielson the following Sunday evening,November 2nd,at which
time I told him I would be available any time during the next two
weeks to discuss and resolve the problems noted in my letter to him
especially the seepage of ground Nater into my basement heating ducts.
n November 3rd I called v:r. Rasmusson and told him that the contractor
would call him to set up an appointment between the three of us at my
home to discuss with the heating man a.solution to the heating problem.

me to call you on 1over,ber 10th to make one last effort to resolve this
matter informally.
Since I have not heard from after our discussion I can only assume
that you did not succeed in getting hold of the contractor.

which you may wish to keep on file should a similar situation arise

I am the Project Coordinator of the City of Plymouth. I certify that
the attached copies of paid invoices are for expenses in excess of $7,447.50
incurred by the City of Plymouth during the year beginning January 1, 1986 and
ending December 31, 1986.
I certify that these expenses were incurred as a direct result of
program operations that qualify for reimbursement under 1985 Minnesota Statute
473.844, Subdivision 5.1. I further certify that Plymouth has received no
grants loans or appropriations to reimburse these expenses. Our records will
be open for review and copying by the Council or its authorized agents for a
period of three years from the date of certification of expenses. A brief
description of the program, its operation and intent follows:
The City of Plymouth has a contract with W.A.S.P., Inc. (Super Cycle)
whereby curbside collection of newsprint, corrugated cardboard, all
metal cans, glass, motor oil and automobile batteries is provided on a
once a month basis. A drop—off center is collected from twice a
month. The contract amount is $2,250 per month.

Last Monday night my car was broken into. I reported it
Tuesday moring around nine. Mary Nelson was the responding
officer. He was very courteous and efficient. He is an
officerPlymouth can be proud of.
This was my second dealing with the Police since moving
here five months ago. You may remember we talked about
another outstanding Plymouth officer. I am very impressed
with the Police here in Plymouth. You apparently have a
fine group of officers under you.
Well, I just wanted to share the pride which I have in
our Police force. Our church will also remember you and
the force in our prayers. We appreciate you and your of-
ficers.
