FOR "KINGSVIEW HEIGHTS 5TH ADDITION" FOR PROPERTY LOCATED NORTH OF 44TH AVENUE BETWEEN JUNEAU AND HARBOR LANES (2013096) WHEREAS, EICHI, Inc. has requested approval of a preliminary and final plat for roughly 3.1 acres of land presently legally described as Outlot J, Kingview Heights 2" a Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by EICHI, Inc. for a preliminary and final plat for Kingsview Heights 5th Addition, subject to the following conditions: 1. A preliminary and final plat is approved for the creation of one single-family lot for Kingsview Heights 5th Addition, in accordance with the plat and plans received by the city on October 3, 2013, except as may be amended by this resolution. 2. This approval waives the requirement for sidewalks to be installed on 44'1'/45 1h Avenues. 3. Prior to recording the final plat, the applicant shall: 1) pay the applicable fees for park dedication and area assessments; 2) receive city approval of final constriction plans; and 3) revise the easements along the north property line to be six feet from the property line. 4. Prior to issuance of a building permit, the applicant shall either: 1) remove the existing accessory building or move it to a conforming location on the owner's property or 2) submit a request to Hennepin County to adjust the lot line between the two properties such that the accessory building would be conforming to the requirements of the zoning ordinance. 5. Prior to approval of a building permit, the applicant shall: a. Submit proof of recording for the plat. b. Show the location of silt fence to be installed and maintained during constriction. c. Submit a final tree preservation plan in compliance with the subdivision regulations. d. Show an approved location for the driveway that minimizes conflict with the sewer main. 6. Standard Conditions: a. The lowest floor elevations shall be a minimum of two feet higher than the calculated 100 -year high water elevation of the adjacent wetland. b. Two trees shall be required to be planted or preserved in the front yard. Res. 2014-022 File 2013096 Page 2 c. Building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. d. Removal of all hazardous trees from the property at the owner's expense. e. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
