PRESENT: Mayor Schnelder, Councllmembers Crain, Vasillou, Yitur, and Sisk, Manager Willis, Assistant Manaqer Boyles, Planning Director Tremere, Public Works Director Moore, City Attorney Thomson, and City Clerk Brandt ASSENT: Nome PRESENTATION Mayur Schneider presented Don Rinkenberger of Boy Scout Troop 584 with a cher* In the amount of $230.56 for the 57.64 tons of paper they recycled through March 31, 1967. He doesn't believe this rezoning would set a precedent but It does raise the issue of what's the measurable distance which constitutes the fringe of a walking neighbor- hood. This site area could qualtfy It as a PUD, nowever, this developer chose conventional platting to save time. He believes a measurable definition of fringe should be discussed if spect- flc mtniawms and maximums are to be set. Mr. Coyle stated the development as proposed has only 43 lots In Phase I. The developer is willing to work with the City to re- configure the balance of the lots. MOTION was made by Councilmember Vasiliou, seconded by Council - member Zitur, to adopt RESOLUTION N0. 87-274 APPROVING PRELIMIN- ARY PLAT AND VARIANCE FOR MARV ANDERSON CONSTRUCTION COMPANY FOR F ERNBROOK WOODS ( 87018) . Councilmember Vaslllou pointed out that this area is a sensitive one and she shares the concern about preserving the woods. Mary Anderson has been a responsive developer who will work with the City and the neighborhood but this doesn't mean that everyone will get what they want. She sympathizes with the stdff's interpretation of " fringd' and feels they have atAed fairly and proactively. While she is concerned, she believes this eeve:lup- ment Is going to happen and the City should work to insure It's done In good taste. Councilmember Crdln stated he is uncomfortable with this and be- lieves 19300 ft. is too deep to be a fringe. He doesn't see how more than S% of the plat could be termed fringe and part of R -16's purpose is transitional between lower and higher den- sity. 1,300 ft. far exceeds any justification from a transi- tional basis and he doesn't believe this entire parcel should be this dense. He agreed staff had been proactive, but the entire site was not within the Intent of this district, only the east 1/3 should be considered for R-18 zoning. Discussion followed on the possibility of moving the smaller lots, which are proposed tit the south and west, to the east along Fernbrook Une. Manager Willis CIdrlfLed that the development to the south, which Is zoned R-iB, and the PUD south of that have single fami- ly houses abutting Fernbrook Lane. Dir,-t%.tor Tremere stated that, because of sewer availability, only one phase can be developed and the rest will remain as out - lots, except for Schmidt Lake Road, pending sewer availability. rI Mayor Schneider noted that a 4/5 vote Is required and he doesn't believe the petitioner can get them with this plan. The Cquncll could defer the Item for another solution which is what he would prefer rdther than denying the request. Mr. Coyle stated it strikes him that the lack of a definition of fringe, which at this point could be resolved after their pro- cess, shouldn't be included In that decision. Councilmember Vdslllou stated she is concerned that the Planninq Cummissluit recommended this wianimously and believes It should be discussed further. Mr. Coyle stated that, if they put attached hones on the fringe, this would take out more trees; It the developer came back with a PUO, it would allow for more dense development and If they are required to redesign, more planning expenses would be Incurred, as well as loslnq one buildinq season. So, they would like the Council to decide tonight on the proposal as they feel they have fulfilled their requirements. Mayor Schneider stated that, If attached homes were proposed on Feriabrook Lane, no trees would be destroyed be:ause there ace none in that dreg. A concerti Is the lack of open space and amenities.
