sulting enliineer assuclaled with this project. Mr. Roscoe pro-
vided a description of the project using overheads to describe
the variuvis road Improvements contemplated. A dtdmoncf inter-
chdnye has been planned since the 1960's end Is necessary to
allue develupment i« the land dress adjacent to the roadway.
Replacement of the existing bridge, Installation of a third lane

called for park dedication of 34.4 acres and development of 776
dwelling units, while this project provides for a park dedlcd-

The overall density of the project is 7.9 units per acre.
Cuuncllmember Schneider asked whether Mr. Ddhigren would have
any objection to requlrlrg that all multiple drelllnq units In
the proposed development be designed and constructed as condo-
miniums rather then as rerutdl properly. Mr. Ddhlgren Indio.dted
that he would have no problem with such d condition. Mdyor
Ddver port questioned whether Mr. Dahlgre, had the authority to
mdke such d commllment. Mr. Dahlgren fell that he did and that
If the developer desired ally f•hdnge &n the future that they
would have to petition the Counc:l.

Counei'loember Schneider Indicated that. a nuaber of the Cavanaugh
Adlltion Associction concerns relate to previous non-performance
of City regnlremments by landowners In this ares. He Indicated
that .towq the City Councll, stat:' and City Attorney are more
bid to ensure that the City's revulremonts are carried forth In
the dovelopwnt. process. Attor.sey Lefler explained that the
City CouncIP may provide that the regulding Is contingent upon

consistent with the concept plan.

LA -1 guiding, the developer could construct between 404 and W

AMENDKENT FOR CHARLES 4ELGARDE FOR FERNBROOK CONSTRUCTION
COMPANY, subject to the eight conditions and adding condition
number 9 to read, "The construction of )4th Avenue North between
the west property line and Fernbrook lane Is to be completed
with the First Phase of the development."; and condition number
10 to read, "A minimum of one underground parking space shall be
provided for each dwelling unit in both LA -3 and LA -4 oulded
areas, as partial satlsfact;.on of ordinance minlaKen parking
requirements."

Mayor Davenport asked what detriment there might be to the lake
with the 62 foot setback. Al Klelrbeck explained that the
Shoreland Management Act considers distance from the lake edge
ordinary high water line) but not unique topographical features
such as elevdtl(n. He celleves that given the elevation of this
lot there would be minlmal Impact, on the tale by granting the
variance.
Extensive discussion ensued regarding the purpose and Intent of
the urdinrnce and the circumstances of this petition.
MOTION made by Cuuncilmember Moen, seconded by Councllmember
Schneider to approved Resolution No. 83-135 APPROVING VARIANCE
FOR STEPHEN AND CAROLYN RUFF FOR PROPERTY LOCATED AT 125 BLACK
OAKS LANE, adding the finding that: all six ordinance criteria
for a vdrlanee had been met.

The Special Assessment Committee announced that It wwjid sleet
following the Council meeting to discuss the concerns of Mr.
James D. Olsen.
