MEETING OF VILLAGE COUNCIL OF
VILLAGE OF PLYMOUTH, MINNESOTA
December 21, 1970
Pursuant to due call ai:d notice thereof a regular meeting
of the Village Council of the Village of Plymouth was held on
December 21, 1970 at the council chambers, 14900 C 23rd Avenue
Forth, Minneapolis, Minnesota, commencing at 7:30 o'clock p.m.
IThe following members were present: Mayor Hilde, Councilmen
Hintz, Johnson, Kindserh and Spaeth. The following members were
absent: None.

III "RESOLUTION NO. 70-522
A RESOLUTION AUTHORIZING THE ACTING
VILLAGE MANAGER TO EXECUTE ON BEHALF
OF THE VILLAGE OF PLYMOUTH A CONTRACT
' WITH THE MINNEAPOLIS INDUSTRIAL
RAILWAY COMPANY RELATING TO THE OPENING
01? A PUBLIC ROADWAY ACROSS THE TRACKS
OF SAID RAILWAY COMPANY AT THEIR
INTERSECTION WITH NATHAN LANE
WHEREAS, 3_4-, has bee31 deemed to be desirable and necessary
,that Nathan Lane be extended and opened between 10th Avenue
North and 13th Avenue North and,
WHEREAS, said extension and opening will cause said
Nathan Lane to cross the right of way of the Minneapolis
Industrial Railway Company and,
WHEREAS, in connection therew9.th the Village has
petitioned the Minnesota Public Service Commission for an
order authorizing the opening and maintaining of such crossing
and,
WHEREAS, the said railway company has presented to the
Village of Plymouth a proposed contract relating to the opening
of such public roadway across its tracks and,
WHEREAS, the Village Council has considered such
contract and has received recommendations with respect thereto
from the Village Attorney and the Consulting Village Engineer,
NOW THEREFORE BE IT HEREBY RESOLVED BY THE VILLAGE
COUNCIL OF THE VILLAGE OF PLYMOUTH AS FOLLOWS:
1. The Acting Village Manager is hereby
authorized and directed to execute said contract
on behalf of the Village of Plymouth.
J4 2. Said contract shall then be presented
ff to Minneapolis Industrial Railway Company for
i� its execution accompanied with a certified copy
4� of this resolution."
The above motion was seconded by Councilman Spaeth
�i and upon vote being taken thereon the following voted in favor
thereof: Mayor Hilde, Councilmen Hintz, Johnson, Kindseth and

li Spaeth. The following voted against: None.
Whereupon said resolution was declared duly passed
and adopted.

I, the undersigned, being the duly qualified and acting i
village clerk of the Village of Plymouth, Minnesota, hereby
certify that I have carefully compared the attached and fore-
going extract of minutes of a regular meeting of the Village
Council of said village held December 21, 1970 with the original
thereof on file in my office and the same is a full, true and
complete transcript therefrom insofar as the same relates to
authorizing the acting village manager to execute on behalf of
the Village of Plymouth a contract with the Minneapolis Industria
Railway Company relating to the opening of a public roadway across
the tracks of said railway company at their intersection with
Nathan Lane.
WITNESS, My hand officially as such village clerk and
the corporate seal of the Village this 29th day of
December , 1970.
