MINUTES
SPECIAL COUNCIL MEETING
November 28, 1977
A special meeting of the Plymouth City Council was called to order by Mayor Hilde
at 7:35 p.m. in the Council Chambers of the Public Works Building, 14900 Twenty-
third Avenue North, on November 28, 1977,
PRESENT: Mayor Hilde, Councilmen Hunt, Neils, Seibold and Spaeth, Manager Willis,
Planner Dillirud, EngineRr Goldberg, Administrative Assistant Boyles and
Attorney Lefler.
ABSENT: None.
MINUTES
MOTION was made by Councilman Neils, seconded by Councilman
Seibold, to approve the minutes of the Aovember 21 regular Council
meeting with the following correction of page 260, paragraph 2:
strike the words "under County Road 6.....in Area 10" and
substitute the words "of parkland north of County Road 6 from
Niagara Lane to the west side of the present superintendent's
building site to preserve that wooded area."
Motion carried, four ayes. Mayor Hilde abstained.
MOTION was made by Councilman Hunt, seconded by Councilman
Seibold, to adopt RESOLUTION NO. 77-6960 A RESOLUTION DENYING
REQUEST OF WAYNE H. FLECK FOR LOT DIVISION OF PLATTED PROPERTY
A-777).
Motion carried on a Roll Call vote, five ayes.
MOTION was made by Councilman Spaeth, seconded by Councilman
Seibold, to adopt RESOLUTION NO. 77-697, A RESOLUTION APPROVING
LOT CONSOLIDATION/DIVISION FOR JIM ANDERSON OF PLATTED PROPERTY

Motion carried on a Roll Call vote, five ayes.
MOTION was made by Councilman hunt, seconded by Councilman
Spaeth, to adopt RESOLUTION NO. 77-698, A RESOLUTION SETTING
CONDI11UNS TO BE WET PRIOR TO FILING OF LOT CONSOLIDATION/
DIVISION "OR JIM ANDERSON (A-776).
Moo ion carried on a Roll Call vote, five ayes.
MOTION was rude by Councilman Hunt, seconded by Councilman
Seibold, to adopt RWLUTION NO. 77-699, A RESOLUTION APPROVING
CHANGE ORDEk G-1 IN THE AMOUNT OF $442.75 AND CHANGE ORDER G-3
IN Tf!E AMOUNT OF $383.65 FOR FIRE STATION NO. 2 PROJECT NO. 608,
WITH THE TOTAL REVISED CONTRACT TOTALLING $217,815.40.
Motion carried on a Roll Call vote, five ayes.

Council reviewed the recommendations of the Planning Commission PROPOSED ZONING
with regard to the suggested changes in the Lity's zoning map. ORDINANCE REVIEW
Council also reviewed in detail the correspondence submitted by ;tem 8
property owners as well as the City's legal posture regarding
the rezoning of lands. The City Attorney discussed recent court
decisions involving rezoning. Following general discussion c:°
the concept of rezoning and the consistency of the proposed zoning
with the 1973 Land Use Guide Plan, Council took the following actions:
MOTION was made by Councilman Hunt, seconded by Councilman
Neils, to change current zoning for Plat 44360, Parcels 9500,
9400 and 9200, in Area 1 from B-3 to B-2.
Motion carried, five ayes.
MOTION was made by Councilman Seibold, seconded by Councilman
Hunt, that zoning for Area 2 remain I-1.
Motion carried, four ayes. Councilman Neils voted nay.
MOTION was made by Councilman Hunt, seconded by Councilman
Spaeth, that zoning for Area 3 remain I-1.
Motion carried, four ayes. Councilman Neils voted nay.
MOTION was made by Councilman hunt, seconded by Councilman
Spaeth, that zoning for Area 4 remain I-1.
Motion carried, five ayes
MOTION was made by Councilma. Neils, seconded by Councilman
Hunt, to direct staff to contact the owner of Parcel 825,
Plat 437'14, and work with him to initiate the application
for a conditional use permit for the retail sales operation
and a site plan for the existing business and any potential
expansion in the future.
Motion carried, five ayes.
MOTION was made by Councilman Hunt, seconded by Councilman
Seibold, to approve Planning Commission's recommendation to
rezone Area 5 from R-4 to R-lA.
Motion carried, five ayes.
MOTION was made by Councilman Hunt, seconded by Councilman
Neils, that zoning for Plat 43736, Parcel 6810, in Area 6
remain as I-1.
Motion carried, five ayes.

Hunt, to approve Planning Commission's recommendation to rezone
the remainder of Area a from R-4 to R-3.
Motion carried, five ayes.
MOTION was made by Councilman Spaeth. saconded by Councilman
Hunt, to rezone Plat 43736, Parcels 5292 and 5260, in Area 7
from B-3 and B-4 to 3-2.
Motion carries, five ayes.
MOTION was made by Councilman Hunt, seconded by Counci'man
Seibold, to approve Planning Commission's recommendation to rezone
the remainder of Area 7 from B-4 to B-1.
Motion carried, five ayes.

Sakibold, to approve Planning Commission's recommendation to
rezone Area 9 from P. -w to R-3 and Area 10 from R-2 to R -1A.

Seibold, to rezone Plat 44597, Parcel 4000, in Area 11 from
B-3 to B-2 and to approve the Planning Co'mmission's recommendation
to rezone Plat 44597, Parcel 5000, from B-3 to B-1.
Motion carried, five ayes.
NOTION was made by Councilman Spaeth, seconded by Councilman
Neils, to approve Planning Commission's recommendation that
zoning for Area 12 remain B-1.
Motion carried, five ayes.
MOTION was made by Councilman Hunt, seconded by Councilman
Seibold, to approve Planning Commission's recommendation to
rezone Area 13 from -1 ',o B-1.
Motion carried. four, ayes. Councilman Spaeth voted nay.
MUTION was made by Councilman Hunt, seconded by Councilman
Seibold, to approve Planning Commission's recommendation to
rezone Area 14 from R4 to R-3.
Motion carried, five ayes.

MOTION was made by Councilman Spaeth, seconded by Councilman AREA 15
Hunt, to approve Planning Commission's recommendation to rezone
Area 15 from B-3 to B-2.

Seibold, to approve Planning Commission's recommeneLtion to
rezone Area 16 from B-3 to B-2.
Motion carried, five ayes.
MOTION was made by Councilman Hunt, seconded by Councilman Neils,
to direct staff to notify businesses that would require a conditional
use permit as a result of rezoning and to advise them that no fee
would be charged if they initiate an application for CUP within a
90 -day r.leriod from the effective date of the ordinance.
Motion carried, five ayes.
MOTICA was made by Councilman Hunt, seconded by Councilman Neils, AREA 17
to approve Planning Commission's recommendation to rezone Area 17
from B-3 to B-2.
Motion carried, Five aye!.
MOTION was made by Councilman Hunt, seconded by Councilman Spaeth, AREA 18
that zoning for Area 18 remain 1-1.
Motion carried, five ayes.
MOTION was made by Councilman Hunt, seconded by Councilman Neils,
to direct staff to look at size of Plat 43720, Parcel 6010, in
Area 18 that present business occupies and restrict 1-•1 zoning
to that parcel.
Motion carried, five ayes.
MOTION was made by Councilman Hunt, seconded by Councilman Neils. AREA 19
to rezone flat 43720, Parcel 2412, in Area 19 from I- to I-1.
Motion carried, five ayes.
MOTION ,qas male by Mayor Hi1de, seconded by Councilman Hunt,
to direct staff to review all zoning changes proposed by Council
that differ from Planning Commission's recommendations or existing
zoning and return to Council with the legal and planning implications
that would be incurred.
Motion carried, five ayes.

MOTI:I was made by Councilmen Neils, seconded by Councilman
to direct staff to prepare a resolution for adoption oT the
zoning map reflecting Council's modifications and alternate
to that resolution in cases where staff submits significant
contrary to Council's actions of tonight.

to dire.:t staff to prepare a resolution for final adoption of the
proposed Zoning Ordinance,
MOTION TO AMEND was made by Councilman Hunt, secondeo by Councilman
Seibold, by designating Item 15 on page 32, "greenhouses and nurseries
with retail sales," as a use by Conditional Use Permit in a 8-2 zone.
Motion to amend carried, five ayes.
MOTION TO AMEND wat made by Councilman Neils, seconded by Councilman
Spaeth, by designating Section 1, Suudivision 3, Item 10 on page 26
be amended tn read, "Parks and recreatic-nal areas owned or operated by
public bodies, other than the City of Plymouth" and further that such
use be by Conditional Use Permit rather than Permitted Use.
Motion to amend carried, five ayes.
MOTION TO AMEND was made by Councilman Spaeth, seconded by Councilman
Hunt, by substituting "City Council" for the word "Board" in Item D
un page 20.
Motion to amend carried, five ayes.
MOTION TO AMEND was made by Councilman Hunt, seconded by Councilman
Neils, by changing Item 6e on page 28 to coincide with Item 6a in
regard to minimum side yard requirements.

MOTION was made by Councilman Neils, seconded by Councilman
Spaeth, to direct staff to research the Uniform Building Code
with respect to multiple dwellirtgt and advise Council whether
minimum floor areas per dwelling ;mit are advisable in our
Zoning Ordinance for multiple dwellings.
Notion carried, five ayes.
MOTION TO AMEND was made by Councilman Hunt, seconded by Councilman
Seibold, by adding the words "or greater" to Item 6 on page 62 after
the words "lesser" in the first and fifth lines.
Motion to amend carried, live ayes.
Main Motion carried, as amended, five ayes.
