PRESENT: Mayor Miide, reuncilmen Seibold and,Spaeth, Manager Willis,
Planner Dillerud, and. Attorney Lefler. Councilman Hunt
arrived at 7:40 P.M.

MOTION was made by Councilman
Spaeth, to approve the minutes

MOTION was made by Councilman Spaeth, seconded by Councilman
Seibold, to adopt RESOLUTION N0. 76-341, A RESOLUTION AUTHORIZING
THE SALE AND ISSUANCE OF INDUSTRIAL DEVELOPMENT REVENUE BONDS
IN THE AMOUNT OF 53,0000.000 FOR WHITTAKER CORP. UNDER THE
MINNESOTA MUNICIPAL INDUSTRIAL DEVELOPMENT ACT TO FINANCE A
PROJECT TNEREUNDER, AND DESIGNATING THE CITY REPRESENTATIVE
FOR THE PROJECT.

Seibold, to adopt RESOLUTION N0, 76 3459 A RESOLUTION SETTING
CONDITIONS PRIOR TO IECORDING OF FINAL PLAT FFR "MISSION HILLS"
FOR NISS10h WEST DEVELOPMENT CO. (A-338).
Notion carried on a Roll Call vote, three ayes: Council-
man Spaeth abstained.
MOTION was made by Councilman Spaeth, seconded by Counci'iman
Seibold, to adopt RESOLUTION NO. 76-346. A RESOLUTION DENYING
REQUEST OF BLUE JAY RENTAL ENTERPRISES FOR A CONDITIONAL USE
PERMIT 1*0 OPER4TE A RENTAL BUSIKSS IN A B-3 ZONING DISTRICT

William Jasper, Blue Zzy Rental Enterprises, Inc,, protested
denial of his request for tanditional Use Permit since he
felt the usage he proposed was consistent with the zonii:g i
tkhe.area and the s reenino he proposed to use for the out-
side storage area world eliminate the injurious effect of
vehicles and equipmerkt parked outside.
Planner Dillerud reviewed the Planning Commission's recom-
mendation relative to the Harris Bros.' proposal for a
distribution center at the northwest corner of High,=iy 1-494
and Highway 55 that it would not be consistent with limited
Businoss Guiding.
MOTION was maAn by Councilman Spaeth, seconded by Councilman
Seibold, to conk -sir with the Planning Conmi^sion's recom-
mendation for the following reasons: 1) the proposed.use
would not be compatible with the neighboring cesidential
area; 2? there is no conditional use permit similar to a
distrib4t-!on center allowed in a B-1 zone; 3) merchandising
services are not permitted in a B-1 zope; 4) the proposod
use does not promote trade or business convenience; 5) there
is concern that the proposed use would cause traffic con-
gestion; 6) the area ,s zoned for administrative business
and would be subject !o core restrictive controls,
Motion carriid. four ayes,
Mayor Hilde asked if Council felt some low and moderate income
housing would be feasible in this area, A discussion followed
and Planner Dillerud suggested the wooded area in the tract
might be suitable for residential development,

Councilman Eunt stated the Council has always been
favorable tvlany goal plan that does not adversely affect
a propei-t , adjacent to the site and t. -:;y would be
re ponsive to lo3king at any good plan for the site.

Hunt, to adopt RESOLUTION N0, 76-3419 A RESOLUTION ESTABLISHIr)

Manager Willis reported on the status of the Dutch Elm disease
program. Harry Foster, 10717A - 10th Avenue Northe questioned
the status of the dead elm tries on the property adjacent to
his. Manager Willis replied the tree inspector has checked
the trees and will contact the oimer and attempt to have the
trees removed.

Manager Willis rer,rted on the demands made by Local 49 for LABOR RELATIONS
modification of their present agreement when it expitses at REPORT LOCAL 49
the end of this year. There was a discussion of how the City Item 12
would respond to the Union's demands and how the wages in
our present contract compare with wages for similar workers
in other communities. There was also a dis;upion of fringe banefits
equested and the consensus was that the 'nit at demands were offensive and out of line.
MOTION was made by Councilman Hunt, seconded by Councilman
Seibold, to adopt RESOLUT*ON NO. 76-348, A RESOLUTION APPROVING
ON -SALE NONINTOXICATING MOLT LIQUOR LICENSES FOR A PERIOD TO
EXPIRE JUNE 30, 1977 FOR THE FOLLOWING: ELM CREEK GOLF COURSE.
HAMPTON HILLS GOLF COURSE, HOLLYDALE GOLF COURSE, IVY'S PLACE.
1'S PIZZA, LATUFF'S PIZZERIA. V.F.W. POST 05903 AND WEST
MEDICINE LAKE COMMUNITY CLUB.

LIBBY'S SUPERETTE. MINNESO(A SUPERMARKETS, INC., TOM THUMB

FOLLOWING: IVY'S PLACE, V.F.w. CLUB #5903. AND WEST MEDICINE
LADE COMMUNITY FLUB.

Manager Millis reviewed the long-range Council calendar
he had prepared. It bias suggested that the budget study
sessions proposed for August 18 and 19 be moved to August 9
