September 29, 16975
A`special meeting of the Plymouth City Council was called to order by Mayor
Hi`ide at 7-,s5 P.M, in the Council Chambers of the Public Works Building,
14900 Twenty-third Avenue North, on September 29, 1975.

Mayor Hilde opened the public hearing at 7:50 P,M. SEWER - PROJECT 406
Item 5-A
Dave Sealine, 12609 - 26th Avenue North, claimed the store
sewer system was inadequate since his yard was flooded when
a sewer backed up after a rainfall last summer.
Engin,--a" Goldberg explained the system was designed a6equately
for a 5 -year storm basis, but a sudden downpour might cause
Some flooding for a short period. In Mr. Sealine's case, hiss
rear yard is quite low and the drain was clogged with leaves
and debris when the flooding occurred last summer causing the rack -up.
Barb Nelson, 2700 Pineview, presented a petition from 32 familir;
in the area opposing the assessment for storm drainage improveiiW t,.
She claimed water from her lot was not draining into the system apd
asked the City to investigate,
En,lnee r Goldberg explained her assessment was for only about 20
percent of the total of her lot area since her lot was on the
border of the drainage district. He said Engineering would field
check her lot again.
Councilman Nunt requested that research be done to determine if
the lot had been assn%sdd previously for another drainage district.

Ron Haugan, 2710 Oikview Lane, Block 4, I.qt 17, lives on the

Engineer Goldberg answered Engineering would look into the matter.
Ed Heins, 2920 Berkshire Lane, Block 3, Lot 12, stated he built his
home three years ago and paid for asses-.ments then. he asked that
the present charge be investigated.
Engineer Goldberg stated that the previous sewer assessments wire
sanitary sewer and not storm sewer. This was the first assessment
for storm sewer.
Peter Hill, 2630 Pineview Lane, purchased his home recently and
asked if the former owner had been notified of the proposed
assessment before the sale of the home.
Councilman Hunt answered the project was ordered prior to the time
Mr. Hill purchased his home and a'public hearing had been held;
therefore ,the pending assessment would be a matter of record.
Mayor Hilde closed the public hearing at 8:05 P AO
Councilman Spaeth suggested putting rock rings around the drains
in the lower areas of the drainage district to prevent them from
being blocked up O th debris. Engineer Goldberg stated he would
investigate the suggestion of rock or blacktop rings.
Mayor Hilde expiained the difficulty of justifying storm sewer
assessments to everyone's satisfaction. He felt at the time this
project was ordered there was much public suaport for it.
However, many people have since that time bought homes in the area
without realizing an assessment had been ordered, The Mayor
respectfully received the petition presented by Ms. Nelson but
stated there was not much that could be done about it. The storm
sewer is dlready in and the P-oney must be collected.
Councilman Aunt directed staff to investigate all questionable
lots to determine if they had been included in any previous assessment.
Ed Heins, 2920 Berkshire Lane, questioned the difference between
the preliminary cost estimate and the final assessment.
Councilman Hunt explained the preliminary estimate was too low
because there was no way to determine the cost of the easements
at the time of the project {searing.

assessment project.
Mayor Hilde opened the public hearing at 8:23 P.M.

Mayor Hilde opened the public hearing at 8:25 P,M% PROJECT 404

Roy Johnson, 1032 Nathan Lane North, questioned the difference
between the preliminary cost estimate and the final assessment.
He also requested that his assessment be deferred for an
indefinite period as long as he occupied the house.
Engineer Goldberg replied that the bids for the project came in
higher than estimated because of some unexpected difficulties
encountered with the ground alono the railroad tracks. He
stated it was the City's policy to set a period of five years
for deferred assessments with the option of extending it again
at the end of that time.

to direct staff to initiate a procedure backing up policy relative
to 5 -year deferred assessments by making annual check of "homesteaded"
parcels and collecting the assessment when such property becomes
non -homesteaded

S. S. Clayman, 9707 - 10th Avenue North, questioned placement PROJECT 405
of driveway on his property and also asked when Lancaster Iter 5-D
Lane would be vacated Cy the City.
Mayor Hilde direct staff to look into the placemer.t of Mr.
Clayman's driveway and indicated that it would be some time
before the matter of Lancaster Lane was settled.
Alex Lissick, 9621 - 10th Avenu4 North, expressed dissatisfaction
with the inequities of the Fiscal Disparities Act and with the
assessment for a 9 -ton street he felt was not necessary for the
residents.
Mayor Hilde agreed the Fiscal Disparities Act was unfair to the
suburbs but felt it had no application to Thi.- specific case.

Dennis Gormley, 4355 Adair 60venue North, questioned how the Item 5-E
omission of these lots from the original asse;sment was
discovered, why he was told water was not available to his
lot and why :ie was being charged interest from 1970.
Engineer Goleberg replied the omissions were discovered in
a random search and the City was in error when he was told
water was not available to his lot.
0. V. Kane, 4010 Saratoga Circle North, objected to being
charged interest on an assessment, he had no knowledge of.
He claimed that the contractor paid an assessment for water
when the house was built.
Engineer Goldberg replied the contractor paid the ast..ssment
for the lateral water main and this assessme^t was for a
connection charge.
Mrs. Hofford, 3941 Revere Lane North, acquired her home in 1973
at which time a title search showed no liens or other encumbrances
on the property. She stated the assessment should not be her
obligation but that of the former om!r,
councilman Hunt answered that tour Seasons had paid for the street
and most of the water assessments for t`ac proper`,y.
Mayor Hilde stated that the City was obliged to buy the system
from Four Seasons and add to it and improve it so that it world
be in conformance with the City's development plan for that area.

representing Paul Kanduth, protested the assessment oh Mr.
Kanduth's property forewater, Presently there isPresently 't

will not be made till next fall. His objection is that the two

William Kanauth,', 5518 Regent, claimer. he paid a previous assessment for water and '

assessment included and if there would be an assessment for sewers in the future,
Engineer Goldberg, explained the pre4ious water assessment was an area charge for
only one portion of his property and the present assessment was'for the balance
of the pOoperty 'to',,,hich water is now available. He stated the assessment included
the NE water Main Trunk and the Elevated Tower at Zachary Line north of C.R. 96
He believed this area had already been assessed for sewer, but,he would investigate
and call Mr. Kanduth,with a reply,
Councilman Neils stated when the water trunk lure wa; extended down Zachary Lane
from 36 to E.R. 9 Mr. Xanduth would not be assessed again for waterlarea charges,
Ars. Jack Faber, 2865 Medicine Lake Drive, questioned the amount of the assessment,',

Councilman Neils replied if the property was south of O,N, 9 the entire area was
included in the area charge and north of C.R. 9 the area charge would not be for

Engineer GoldbetQ stated a hook-up must be made within 2 to 2-1/2 years and a minimum
wafer service charge would be made whether or not the water was being used,
Council was in receipt of letters from Mr, Willard Johnson, dated September 19, 19756
and Mr, 8 Mrs. Fred Menselkoch, dated April 19 and September 16, 1975, protesting
the assessment wWch are to be part of the record,

Mayor Hilde called for a special meeting on Wednesday,
October 8, at 8:00 P.M. 4n the Conference Room at
City Hall to adopt deferred assessment rolls.
MayorlHilde directed Manager Willis to put an item on the
a99nda in the near future providing for a discussion period
relative to the preporation and presentation of background
materials for agenda items so as to more effectively present
these items.
Councilman Hunt suggested attaching the minutes from the project
hearing to the assessments items for a pub "r. hearing.
Mayor Hilde adjourned the meeting at 10:35 P.M.
