SPECIAL COUNCIL MEETING
September ??, 1975
A special meeting of the Piymotith City Council was called to Ardor by Mayor
Hilde at 7:35 P.M. ).n the Council Chambers of tt)e Putlic Works Building,
14900 Twenty-third Avenue North, on September 22, 1975.
PRESENT: Mayor Hilde, Councilmen Hunt, Seibold and Spaeth, Manager Willis,
Planner Oillerud, Engineer Goldberg, Attorney Lefler and
Administrat;ve Assistant Kreager.
ABSENT: Councilman Neils
MINUTES
MOTION was made by Counzilman Hunt, seconded by Councilman
Spaeth, to approve the minutes of the September 15 regular
Council meeting with the following corrections and additions:
1. Page 296, RELATE - Add: "....if at that time Council
decides to continue to support the project."
2. Page 296, Item 6-A - Change amount of the General Fund
budget to read $2,247,536.
3. Page 298, Item 6-C - Motion on deferring preliminary
engineering report on Fernbrook lane should be recorded
as carried, four ayes.
Motion to approve the minutes as amended carried, four ayes.
PUBLIC HEARINGS
Manager Willis introduced the public hearings explaining the
purpose of the hearings and the procedures involved and spe-
cifying how the meting had 'peen announced. He advised the
citizens of the procedures and deadlines involved with payment
of special assessments.
Engineer Goldberg reviewed the Vicksburg Lane assessment project.

Item 5
Manager Willis requested Council to adopt a resolution calling a -
public hearing for the assessment of three properties inadvertently
omitted in the preparation of the Vicksburg lane assessment, and
announcing such hearing as required.
Ceuncilmah Seibold requested that residents of Lots 1 and 20,
Block 2, Plymouth Manor 2nd Addition be given the option of
cutting off Their access to Vicksburg since they have access
on a secondary street.

Duane Soland, 15620 Fifth Avenue North, stated he is already PUBLIC HEARING
paying a storm sewer assessment and asked Engineer Goldberg to VICKSBURG LANE
review his case, Item 5-A
Engineer Goldberg stated Ar. Soland's property had been assessed for storm sewer
under the Parker's Lake project in 1959 and therefore recommended deleting his
property from the present assessment roll.
Russ Almquist, 15905 Fourth Avenue North, asked Engineer Goldberg to go into
mere detail on how the project was assessed,
Engineer Goldberg explained the street assessment was determined by existence of
driveway access to Vicksburg and whether property is residential or comnercial;
all in accordance with the present City policy; and the storm sewer assessment
was applied to all properties within the drainage district.1 Only those properties
abutting street were assessed for street improvements. Sidewalk assessment was
applied to all properties except single family residential,
Councilman Hunt commented that Vicksburg -was constructed to 9 -ton design, however,
residents were being assessed on the basis of 7 -ton design and the difference in
cost was being covered by MSA (Minnesota State Aid),
Councilman Spaeth stated a: ,•)ne abi ,:ting Vicksburg Lane would be assessed only
for curb and gutter if theS voved their access to Vicksburg.
Thomas Finn, 15900 Fourteenth Avenue North, lives on the corner of Fourteenth
Avenue and has 40' on Vicksburg. He asked if he was being assessed for the
sidewalk on his property and w;tat percent he was paying of the cost for curb and
gutter on Vicksburg.
Engineer Goldberg answered that residentiAl property was not being assessed for
sidewalks and Mr, Finn would be assessed SO percent of the cost of the curb and
gutter on Vicksburg,
Frank Ferrin, 715 Vicksburern Lane, asked fo, an explanation of the $15,00/ft.
charge for the street assessment,
Engineer Goldberg explained that normally the total cost of the street construction
would be passed on to residents but in this case MSA was available to pick up a
portion of the cost,
Arthur Hart, 815 Vicksburg Lane, stated he felt he was being discriminated against
since only residents with driveway access to J cksburg were being assessed for the
street ar.d he was not deriving any benefit from the tiew street since the former
street was ample to service the area. He registered complaints about speeders
and illegal parking on Vicksburi and bikers using the sidewalks, He also ques-
tionedd his assessment for stowm Viewer,
Mavor Hilde answered that the City tries to be fair in making street assessments
by assessing residents only for a residential street benefit. The rate of
arrests for speeding on Vicksburg has 'acause it is being patrolled more
than usual in an Attempt to control the speed limit on the street, State law
states that bicycles must use the streets, The City hopes to mark the street
with bike lanes soon to encourage hikers to use the streets. The Mayor sLaCed
that Mr, Hart's property is well within the drainage district,

Jim Bradley, 16135 Ninth Avenue North, questioned his property's inclusion in
the drainage district and why the lots behind him were not being assessed for
storm sewer. He asked if he would be assessed again in the future for storm
sewer on Ninth Avenue North. He asked why proaerty owners who benefitted from
the drain Tong the Luce Line were not assessed.
Engineer Goldberg answered that his property is in the drainage district now
being assessed and his water is draining into the pipe that drains to Gleason Lake.
He alt) stated the property along the Luce Line is beyond the assessment boundaries.
Engineer Goldberg stated there are no plans for storm sewer on Ninth Avenue North
but if something is done to Gleason ^reek the whole Minnehaha watershed area would
probably be assessed.
Barbara Franzen, 16130 Ninth Avenue North, questioned her assessment for storm
sewer since she feels water is draining to the back of her lot where the City
is negotiating for an easement for ponding rather than draining into the system.
Engineer Goldberg answered that her property drains to the low pond area and
through the pipe outlet to Gleason Lake. He indicated that their land would
only be flooded during a 100 -year storm and for a short period of time. He felt
therefore that their property benefited f=rom the storm sewer improvement.
Frank Ferrin, 715 Vicksburg Lane, questioned the benefit being received from
the new street nn Vicksburg Lane since the former street was adequate for the
residents and the $15.00/ft. was too high. He also asked when the public
hearing on the tree lots that had been omitted would be.
Attorney Lefler answered it was a concept of "legal" benefit. The Council
must make a judgment of whether an existing street needs improvement and decide
what "legal" benefit must be determined. Anyone that feels he is aggrieved
may seek remedy in an appeal to the District Court,
Councilman Hunt restated the fact that MSA funds were available for a portion
of the cost for the street bringing the assessment to residents down considerably.
Mayer Hilde stated this was the first time residents on Vicksburg were being
assessed 'for a residential equivalent street.
Manager Willis stated that the public hearing on the three lots omitted from
this assessment roll would be held on October 6, 1975.
Richard G. Swanson, 16230 Ninth .Avenue North, questioned whEther his lot was
in the drainage district ai,id what part of the $280,000 assessment wds for sto+nl
sewer.
Engineer Goldberg answerd that his property wits in the drainage district and
approximately $88,000 of rhe cost was for storm sewer.
Dennis Haux, 15505 Severe th A,ie§%ue North, is 1 rn,a tad on the edge of the drainage

Engineer Goldberg answered that he would not be assessed again.

sewer pipe was taking- water off his lot. He also questioned who was paying for
the work done along t:he Luce Line.
Mayor Hilde answexbed:'that Plymouth had an overall storm sewer plan established
is 1.973 whose goal was to preserve the envirt r--men:t and keep down casts to a.minimum.
This was; being accomplished by trying to -'keep as much wader in Plymouth as possible.1
and -by laying astlittle pipe as possible., Thus the system was designed utilizing
open ditches almig with sewer pipe wherever possible.
Eng6eer Goldberg answered that the cost of the pipe being laid along,3the Luce
Line was included in that portion of cost being picked up by MSA funds and was.
not included in'the cost being assessed under this project.
Russ Almquist, 15903 Fourth Avenue North, represented his mother who resides
at 42,110 Vicksburg Lane. He claimed hi°s mother has requested a hook-up for water
sevq'.ra_l times but never received it and questioned the assessment if water is
not accessible to ,her property,
Engineer Goldbewg said water is available to her property and he would check into
the matter further.

Councilman Hunt agreed to accompany Engineer Go1'dberg on field check
of the questionable lots on Vicksburg Lane.;
Engineer Goldberg reviewed the assessment ,ebl'l on the H64hes-Johnson
Addition Projects 304 and 304-001. He pointed ovt'the final' assessmcnt3\
f^r Tani tary sewer and eater main area assessments were higher than' t4el
original estimates\because the development contra:t did not reflect the,,,
newly adopted rate for sewer and water area charglVs.

Mayor Hilde agreed that if the contractor was at fault Engineor Goldberg ;

Roger,L. Johnson, 3225 Highway 101 North, stated he signed a development
contract for $225/iot for sewer and water area charges. He questioned
the proposed area charges a $250/lot. He also stated Lots,1,:i and 3.

Willard Johnson, 10030 C.R. 9, stated he felt he was receiving SEWER TRU11K PROJECT 401

and water was brought in h yond 45th Avenue North.
Engineer Goldberg answe0etl that his assessment for water and sewer
on the front portion of hi, property was deferred At the time since
the land was vacant and a1'1 services were not available to'Iiim.
Ile stated Mr. Johnson would not be assessed further for serer and

t Consulting Engineer Olson explained°that°the Water main was run through
the middle of the' property because there was'an existing easement there
for telephone utilities aiid it was their best judgment as 'to where it '
should,be placed,. He noted that the water main easement was adjacent
to; the existing telephone utflity 'easement.
Mayor'Hilde)commented that Plymouth has consistently followed a development
plan for sewer and water and specified the following types of charges
incurred for services: 1) SAC Metro charge, 2),Plymouth area charges !y
acre, 3) hook-up charge, 4) individual lateral charges and 5) charges
fob individual 11.1ne into building.

the assessment were distributed to the Council.

Enginebr Goldberg reviewed the following deferred assessments
under consideration: 1))'Plat 43721, Parcel 1430; 2) Plat 219 ,
Parcel 6810; 3) Plat 45800, Parcel 5210; 4) Plat 44320, Parcel
800-; 5) Plat 44320,,Parcel 1300 and f,) Plat 44320, Parcel 1700,
Mayor Hilde opened the public hearing at 10:28 P.M,.
Dean Dahlin,1040.5 South Shore Drive, Plat 443209 Parcel 1700,
claimed Lots 8 and 9 should be, combined, since Lot 8 was too
small for a building., He stated he previously paid for. water
on Lot 9 and questioned what the lateral charge was for. 'He
also protested being chargod for interest -on an assessment
he was never charged,_fdr.
Mayor Hilde answered the lateral charge he previously paid was
for hook-up and directed the staff to investigate whether the
lots were divisible.
Mayor Hilde closed the public hearing at 10:35 PX
MOTION was made, by CouncilmanjHunt, seconded by Councilman Spaeth,
to direct staff to research Mr. Dahlin's plumbing permit and
determine whether the parcel was assessed for one or two hook-up
charges and bring back information on October 6.
Motion carried, four ayes.
Mayor Hilde stated the Council would consider the interest charge
at that time.
Councilman Spaeth questioned whether residents had a choice at
the time to defer assessments on a lateral charge.
MGTION was made by Mayor Hilde, seconded by Councilman Spaeth,
to direct staff to come back with more information on Item 5
on reason for this deferred assessment.

Frances Scallon, 2335 B Larch Lane North, stated she lived on a
short, dead-end street that did not need additional lighting.
Engineer Goldberg answered that the assessment covered lights
already installed and no additional lighting was planned.

Planner Dillerud reviewed the Planning Commission's proposal
for a neighborhood park in Imperial Hills, explaining that
they hoped to apply this concept of a neighborhood park to
all future parks throughout the City, using a consultant
to supervise the bidding ano construction of the parks and
taking over the maintenance at completion.

Bill Short, landscape architect, reviewed the plans i'n detail for Council.

Council discussed various aspects of the park design and considered some
alternatives to reduce costs.
Roger Burton, Park Director, stated some'of the items included in the
design of this park were intended as examples,of what,could he done in
other parks since this park was a protctype for fbture parks.
There was further discussion on the funding of this park, the money
available in the Park Dedication Fund neighborhood park account (:61,0,00)
and the present formula being used to govern that fund -- 50 percent,to
central parks, 25 percent to community parks and 25 percent to neighoorhood
parks. Mayor Hilde suggested the Council consider using a greater percentage
of this fund for community and ne;ghborh00%l parks and relying on bond money
for central parks.
Planner D;llerud stated development plans ca11,:G for the avers a Jze of
the neighborhood parks to be 8-9 acres, serving a radius of 1/ mile --
a waking guide plan.
Councilman Hunt stated since new development in Plymouth is providing the
money for the Park Dedication Fund he felt the present division was
equitable.
Councilman Seibeld agreed with the present policy also.,
Councilman Spaeth agreed with the present policy but felt there could
be some variation.
After further discussion about methods of funding this park, Mayor Hilde
asked Council for direction on what limit to set for post of nei hborhood
Parks, Council responded as follows: Councilman Hunt - $26,000-127,000;
Councilman Seiboid - $25,0Q0 -$40,00b; Councilman Spaet-i would nut commit
himself until he saw the bids on the construction; Maytr Hilde - $25,000-
409000.
