April 8, 1971
A s;ieci al meeting of the Plymouth City Council was called to order by Acting
Mayor Hunt at'7:40k P,1t. in the Council Chambers of the Public works Building,
14900 Twenty-third; Avenue North, Plymouth, on April 8, 1974.

PUBLIC HEARINGS
Acting !Mayor Hunt explained the purpose of the meeting.
ManagerWillisstated the process whereby notice was given for
this meting: (a) notices were published in the official City
newspaper, the Plymouth S, per St,ite Law; (b) written notice
was mailed to each property owner in the improvement area, as
shown by the records of the Hennepin County Auditor's tax
statement mailing list,-. $end (c) announcements and discussions
at Council meetings, Ve also outlined the assessment
procedure, and the procedure for tonight's hearings.
Engineer Goldberg explained that Projects 123, 123-001 and
303 included water main construction, sanitary sewer con-
struction and street restoration, Total cost to be assessed:
183,521.81. All items were assessed on an unit or per
lot basis, to be assessed for ..i period of 20 years; 8% per
annum,
Acting Mayor Hunt opgt ped the public hearing on Projects

Steven L. Brim, 2730 Nathan Lane, objected to the way units
were measured. He also commented that the contractor took
too long in installing the main,
J. Svenkerud, 0'8th Avenue and Orleans, asked If th+? assessment
should have be :n on a per foot basis, Er;gi neer Goldberg
stated that because of the near uniform lot size, i# per lot
bosis was used,
Paul Hanson, 9705 27th Avenue North, asked a question rt his
particular lot. Engineer Goldberg replied that Mro. Hanson's
property would be assessed for water main and street restoration
only,

for his property, and was referred to a staff person available
with the specific assessments,.
Acting Mayor Hunt closed the pub 1 i c hearing on Projects 12311

public hearing on the above project, and Council Tian Spaeth
presided over the meeting.

Engineer Goldberg explained that Project No. 107 was assessed
or a front foot basis to the p*operty abutting on Vi c4sburg
Late, between County Road 6 and 26th Avenue extended, except
that ZinAl Addition frontage on" 'the west side of the. street,
adjacent to County Road 6, would be picked up by the City.
Total cost to be assessed: $211,798.62. Assessment would
be for a period of five yearsc, 8140, per annum.

Councilman Spaeth opened the public hearing on Project No. '
1107
at 8:OS P,M.
Hans Hagen, of Bancon, 905 Parkway L!rive, St. 'Paul , complained
that Zinal Lane has not beer assessed, and Westin Lane has.
He said that neither should be assessed. Engineer Goldberg
explained that the lots of the Zinal' Addition which back up
to Vicksburg Lane have no direct access.
Councilman Spaeth closed the public hearing on Project: No. 107
at 8:10 P.M%
Acting Mayor Hunt returned to the Council Chambers at 8:11 KM,
Engineer Goldberg explained that project No. 142 was split
into two assessments: the a4va wast of West Medicine lake
Drive was assessed on an unit basis, with the lots pro-
rated as per size into three groups; the area east of Wast
Medicine Lake Drive was assessed on a front foot basis, with
an additional unit cost figure to defray the additional
construction costs incurred on 28th Avenue Immediately
east of ,West Medicine lake Drive. Total cost to be at;sesse :
324,49 .37, to be assessed over a ten year period; 6% per
annum.

Acting Mayor ,Hunt opened the public`'hearing on Project No. 1l
142 at 11:15 PWM.
Clayton Ziebarth, 2715 Sycamore Lane North, complained of
the -1 eggth of time i nvol ved -- the proj':ct began i n pri ng,
19729 4'nd assess -.%n,,,#. is being made in Spring, 1974. `He
also complained of the, difference in cost from the preliminr,ry
estima s. Mr. Ziebartn'felt there should be an adjustment
on the 'interest charge.
Mr. Zitbarth also submitted & letter from himself, as,
President of the Creekwood heights Concerned Citizens
Association, in which he elaborated on some of the comments
above cited, and noted defects in the final construction,
Engineor Goldberg explained that from the time a project is
completed, a contractor is borded for a period of one year.
The colitractor is thereby respcnsib.le for repairs in the event
of problems of construction for th?.t period,
Engineer Goldberg also explained that it is the policy of
the City to assess for a project lanly after completion of that
project,
Brad Truelson, 2735 Oakview Lane, stated that his lot is tht
only one without a driveway entrance. He asked if this was
his responsibility, Acting Mayor Hunt said that this would
be chocked out, and that the staff would get back to him
on the question,
George Zenanko, 12850 28th Avenue North, complained of the qua'Sty
of the work done, citing the followin(a) patching had begun
before the project was completed; (b?patching around the man-
holes had not been done properly; (c) there were soft spots in
the street; ;d) there was sinking and heaving; (e) there are
areas where the asphalt is above the curb, and areas where the
asphalt is below the curb; (f) there are many cracks, many of
which go entirely across the street; (g) there are numerous bird-
baths; (h) when patching is done, it dies not match; (i) many
people have to do re -sodding; and (j) on his personal property,
despite his submitting a detailed drawing, there are errors on
the apprnachway to his and his neighbor's property,
Lorraine Mullan, 11845 28th Avenue North, asked (1) if the City
absorb$ any of the cost; (2) why the costs were as high as shown;
and (3) who would pay maintenance,
Engineer Goldberg stater that the City does not absorb any cost
in the street construction. He also commented that the costs Vl-
volved were not excessille on the current market,

Consulting Engineer Cook,f?xplained that shifting will continue to be a problem
for the City; the area will continue to settle for several years. He also
noted that the costs would have been prohibitive, had the street been handled
in a manner similar to a major street.
Robert A. Essig, 2770 Norwood Lane North, complained rf the difference between
aortic pated and actual costs. He also felt the unit Lasis for assessment was
unfair as it pertained to his and his neighbor's 1 ots, Councilman Neils
said that the staff would investigate the particular question.
Sergio Manancero, 12515 North 28th Avenue, complained, of problems with flooding*
Claude Heisch, 11735 28th Avenue North, asked for more information on the
preliminary cost estimate.

George Hoyt, 2635 Sycamore Lane, complained that the percentage of increase in
sctual costs over anticipated costs was too high, Mr. Hoyt asked for an explanation
of how the unit charges were calculated, Engineer Go', dberg explained thd: process.
Mr. Hoyt,iasked why the actual costs were so much highe.n than the preliminary cost
estimates. Manager Willis stated that at the time of itis preliminary r?port j
extensive soil enlorations were not done. The.,Council has adopted a new policy
which provides for more extensive preliminary work, and` the engineers ane providing
Oe added data, thereby giving the Council better cost estimates,
Mr. Hoyt noted that Creekwood Heights, First Addition, did not have the benefit
of deep base design, ,Acting Mayor Hunt replied that that is the reazon for
the splitting of the assessments,
Dan Belcore, 2625 Sycamore Lane North, commented that he believed the 10terest
che;rge of 8% was excessive. Councilman Spaeth pointed out that if sinking
rind monies are not used as "front money" for such pr,)jects, the City would
find it necessary to borrow the money from banks. Also, he noted that the
City does absorb certain losses.
Mr, Belcore questioned the way in which the projects are bid. Manager Willis
explained that bids are made on a unit basis, Councilman Neils pointed out
that quantity breaks are included,
Mr. Belcore asked if the engineering, legal and administrative costs are direct
charges. Manager Willis explained that some regular staff is budgeted into the
project; the balance is based on pro.ect charges.
Paul Sylvander, 3824 Independence, who is a proper V owner but not a resident
of tree City, asked what the amount of base was on Norwood Lane when done. Consulting
Engineer Cook replied that it was 7" gravel, 3" class 5 and 2" blacktop, Mr.
Sylvander also asked why blacktopping is done the same year as the initial work
on the street, Several Council members agreed, but noted tha,'. the public
demands immediate blacktopping,
Gene Ritter, 12710 27th Avenue North, asked when the first payment was made on
the project. Manager x,11is said the first pkymeot was made March e, 1972.

Mr. Ratter also asked what percentage of total costs went
to the `consulting engineers. Engineer Goldberg replied:
8.7%. kting Mayor Hunt noted that it was more economical
to employ & consulting engineering firm than have a large
engineering " staff.
Dennis Anderson;; 12620 28th 'Avenue North, asked if a percentage
of the assessment\ can be paid in the 30 -day interest fr :e
period, Manager Wfl,lis replied that State statute requires
that the payment be total or not at all on that basis,
George Hoyt, (see above for address), asked why the assessment
roll was not drawn last year, Acting Mayor Hunt replied that
all costs were not known.
Mr. Hoyt noted what he considered to be an error in the assess-
ment of his property. Acting Mayor Hunt said Engineer Goldberg
would checl: it out.
Gene Ritter, ( see above for address) , ,said that his and his
neighbor's property had not been blacktopped, and had been originally.
Al Soeffker, 2805 Sycamore Lane, said the residents have a
legitimate complaint, in that they are beano asked to pay an
involuntary interest figure.
The public hearing on Project No. 142 was closed at 9:43 P.M.
by Acting Mayor Hunt,
Acking Mayor Hunt noted that the staff would have to come back
to the Council with a report on the comments noted tonight,
Manager Willis explained that at the time the City of
Plymouth constructed the Northwest Interceptor, the
residential lots were assessed sanitary sewer area charges
in the amount of S125A acre. Because lateral sanitary
sewer service in the streets was not available, the City
did not assess the connection charge, With the installation
of water and sanitary sewer as par. of the,, West Medi ci nc
Lake Sewer and Water Project, the charges should have been
assessed and were not, The City has notified the Creekwood
Heights Homeowners Association, and this assessment roll
would collect the RIC charges, The assessment would be
for a period of one year,
Acting Mayor Hunt opened the public hearing on the Creekwood
heights First Addition Sanitary Sewer RIC charges at 9:46 POM,
Clayton Ziebarth, (see above for atdress), explained that the
residents thought the amountthW had paid initially for the
Northwest Interceptor had been the total charge,

because of industrial zoning. Council members and the Manager
agreed that two rolls might be drawn,

for his pc•operty was based on frontage of 117o5 Net, which was
the orig4a.l frontage, The frontage has now decreased, hviOver,
to 77,5 fent, because of permanent easements on Nathan Lane.
Acting Mayor Hunt said the matter would he checked out, and

one-party agreement between the developer apd the City.

on Project No. 142 to bring the project to a ,satisfactory
condition; and that this roll be adjourned to the Special

Councilmah;,Neiis presented a report on1the Shallman appeal,,
and recommended granting a,varihnce of 33 feet.
MOTION was made`,by Councilman Neils, seconded by Councilman
Spaeth, to adopt A RESOLUTION TO RECONSIDER RESOLUTION NO,
73483 AND GRANT A VARIANCE OF 33 FEET OF THE PROPERTY LINE
TO THE SHALLMANS.
MOTION was made by Acting Mayor Hunt, seconded by Councilman
Spaeth, to amens" the,,resolution to state that the front
of the garage be no closer than 22 feet from the property
line. Motion to amend carried, three ayes. Councilman
Neils voted nay.
tpTION to adopt resolution, as amended, failed 1 - 3 on a roll
call vote. Councilmen Neils, Seibold and Spaeth voted nay,
MOTION was made by Councilman Seibold, seconded by Councilman
Neils, to adopt RESOLUTION N0. 74.189, A RESOLUTION T'

RECONSIDER RESOLUTION NO. 73-383 AND GRANT A VARIANCE OF
17 FEET OF THE PROPERTY LINE TO THE SHALLMANS, Motion
carried on a roll call vote, three ayes. Acting Mayor Hunt
voted nay.
Acting Mayor Hunt asked what road restrictions were in
effect on Dunkirk Lane. Engineer Goldberg explained thou
the street was posted for four ton, and the City was
allowing seven ton by permit, to those contractors who
had posted bond with the City, Road damage was cited,
and Engineer Goldb Mi notified the bonded parties that the
four ton iestricti%)n was in effect.
MOTION was made by Councilman Neils, seconded by Councilman
Spaeth, to direct the staff to contact the builders who have
cash bonds or certified checks on deposit, to notify those
parties that they may be granted continued access to Dunkirk
Lane, at the direction of the Engineer, and bonds will be used,
for street repair, as directed by the Engineers and that
concentrated enforcement will be considered on the street,
so that those who have not posted bond cannot get benefit
