PRESENT: Mayor H11de, Councilmen Hunt, Neils and Seibold, Manager Willis, Engineer Goldberg, Finance Director Lloyd Ricker and Attorney John Drawz ABSENT: Councilman Spaeth and Planner Iverhiser MINUTES MOTION *ab made by Councilman Seibold, seconded by Councilman Neils, to approve the minutes of, the September 24, 1973 Special Council Meezing. Motion carried, four ayes. ASSESSMENT HEARINGS The Maxtor called the special assessment hearings open at 7:47 p.m. The Manager reviewed the special assessment procedure, a copy of Which is attached. Mr. Steven Brown, 1730 Nathan Lane, wanted to know what his assessment would be per foot and was ad- vised of the rate bythe Village Engineer. No one appeared concerning these proposediassess- ment s . No one appeared concerning these proposed assess- ment s . Mr. Tony Appelget, 12715 275 Avenue N., wanted to know if his property was included in the assessment district and what his assessment would be. The Manager reviewsd his assessment with him. Ms. A. Gepner, 1628 Comstock Lane, asked about the possibility of having a street light installed at the intersection of County Road 6 and DuOirk Lane. The Mayor ekplained the Village's street ?.ighting policy to her and suggested that she contact the VillRge Manager if she is Interested in pursuing the matter. SEPTEMBER 24,-1973 SPECIAL. Dore, 8801` Nicollet, Ave.., Bloomington, complalvaed about the proposed delinquent assessment against 2445 West Medicine Lake Blvd. She indicated that the hou e on this property had been demolished in 1972 and that no assessment for utility charges should be wade. The Manager was directed to look into this matter,and re- port back to the Council., Cliff Well oe, 230 Niagara Lane N., indicated that their account had been paid up but that he hadn't been able to straighten the account out with the Village. Tho Manager wao directed.to Investigate this matter and report back to the Council. 11 0 Mr. Dor? Russ, owner of the Fox Meadow apartments, FOX MEADOWS appeared !lef6re the Council and indicated that he AREA CHARGES did not objent to being assessed, rather that he be (SEWER WATER) assessed the appropriate amount. He asked why his property was not assessed along with the Fernbrook Lane frontage two and one-half years ago. Tho Mayor indicated that at the time of the previous hearing, the Council assessed property in a different fashion and his property was treated consistent with other similar property. Mr. Russ also asked that -the area used in calcu'Lating the proposed assessments be checker+ because his surveys indicated less acreage than was shown on the Village roll. He indicated that this was due to,easements for streets and walk- ways. The Manager was directed to check the reported prat in this regard and make the necessary adjust- ments to the acreage bated upon those data. No one appeared to speak on these proposed assess- MERRIMAC ESTATES merits, WATERWATER SEWER REC CHARGES No one appeared concerning these proposod assess- SOUTHWEST SANITARY merits. Notion carried on Q Roll Call, Vote, four ayes, MOTION was made by Councilman Hunt, seconded by Councilman Neils, that the staff be dir-tcted to re- turn to the Council on October 9 with'responses to the questions rained by the public concerning the delinquent sewer and water taill3 and further to re -check the roll to detemine that; new homeowners in the Tiburon, Shenandoah e:d Chelsea Voods i projects are not being assessed for utility charges which should be borne by the developers. Mayor Hilde opened the rubiic hearing on the PUBLIC HEARI O ON 1 74 1974 proposed Village budgets at 9;25 p.m. PROPOSLO VILLAGE BUDGETS The Mayor reviewed the Village's budget practices. He also indicatied the several reviews which the Council had previously given the budget and that the public hearing was an opportunity for the public to Melee their questions on proposed budgets pr.or t, the time that the Council made IVs ftaal re- views. Tho Village Manager reviowed the rev- enue and expense portions of the budget in- dicating major changes In it over 1973. Gerard Knight, 17640 25th Avenue N.: asked questAons concerning how much of the Village tax money stays in the Village and how Much goes to finance the General Hospital and other County functions. The Mayor Indicated that the tax monies raised by the Village goverrment for Its operations stay with the V,iliage, This Amounts to approximatel;A 11% of the total property tax which our citizens pay. The balance gees to .finance both the County and School Districts, Norm Torrison, 12910 27th Avenue N., inquired as to where the Village revenue sharing monies were going and was informed that in.1973 the Village appropriated money from ourplus to cover the anticipated receipt of revenue sharing monies,. All revenue sharing monies are maintained in a separate fund whi.%h is antleipated to awnount to approximately $140,000 by the end of 19' 3.. Mr. Torrison commented that: he believed that sealcoating should be on ad valorem rather than LPecial assessments and also suggested that street lighting 0 Special Council Meeting October 4, 1973 Page Five be paid for on an ad, valorem basis. MOTION was made by Councilman Neils, seconded by RESOLUTION N0. 73-383 Councilman hunt, to adopt RESOLUTION NO. 73-383, A RESOLUTION APPROVING THE LIST OF DISBURSEMENTS FROM THE GENERAL FUND, CONS"UCTION FUND, WATER FUND, SEWER FUND & SPECIM, ASSE~;SMENTS IN THE TOTAL AMOUNT OF $11,1 G.33 FOR THE PERIOD ENDING September 21, 1973. Motion carried on a Roll Call vote, four ayes. Councilman Hunt indicated that he had been contacted by a Mr. Anderaon who resides in the Tiburon development concerning the speed lliglt through the development. It was suggested that the Village install speed limit signs on Pilgrim Lane through the proposed development. The Manager indicated that';he had corresponded with Mr. Anderson and representatives of the ,homeowners Association concerning their request for reduction in the speed limits as well as walkways. Councilman Neils pointed to the need to complete 34th Avenue from Pilgrim east to Kilmer Dane. Councilman Hunt stated that he had been contacted by residents residing In the vicinity of tho North Central Aggregate plant regarding the smell from the manufacturing process. Councilman Neils indicated that this matter was already being reviewed by the company and the FCA and that Improvements were being made. Councilman Hunt and the Village Engineer are to contact the plant manager and discuss this problem with him along with the dust control problem on East Medicine Boulevard near 41th. The Council continued the review of the proposed REVIEW OF PROPOSED budget reviewing the Manager's report of 1974 VILLAGE BUDGETS October 3. I i Specit? Couyicil 'Meetlrg October 49 1973 Page Six k0TION was made by Counci4m Hunt, seconded by Councilman Neils, directing the staff to prepare a pollcjr statement indlca'ting the Council's Intent to establish a sealcoating program to be ftaianced by ad valorem taxation on ari approximate four-year basis and to Include in t.;ut policy criteria to he used in designating the streets vhich,':puld be sealcoa.ted, and further that for 1974 that the sealcoating allocation in the budget be ieduoed from =200,000 to $100,00-,*.' Motiop carried, four ayes. Following a review of the Manarer's repgrt including his recommends tions for revisions in the budget, the Council indicated that it concurred; in his recommendations, as follows: 1) Reduce sealcpating frau $200,000 to $100,000 2) Reduce contractual services in the Environmental Pro- tection budget From $7,000 to $3,500 3) Delete interdepartmental labor in l"'unlelpal Building from $500 to -0- 4) Include $54,000 ir the revenue portion of the budget f, or M.S.A. construction funds to finance this proposed street semaphores. The Council discussed the adjusted budget at thili point including the amount of money propc43ed to be appropriated From surplus.. Following this review thit Council indicated that they would con- sider the final adoption of the budget on Jruesday , October 9. Councilman Neils indicated that he would not be present at the meeting of the 9th but 'indicated that he was in favor of the budget as It stands following th, aforementloned changes. Copies of the individual rolls are available for your inspection. 2. Notices of these heaxings ware published in thePlyw ooh Sun, official Village newspaper and a notice was mailed to the owners of each parcel described 3n the assessment rolls. For the purpose' Of giving 'Wiled notice, owners are those persons shown to be such on the records of the County Treasurer and these cords are used in addressing and mailing notices. If you ito making a. payment to your mortgage company which includes a deposit four real estate taxes, it ia probable that the address shown on the County T ee'eeasurer's records is that of the mortgage company and not your "I. i".some of you did not receive a notice this may well be the reason. 3o following these hearings, the Council will decide whether, any adjustments in,the rolls are necessary and will, by resolution adopt,each roll.. 4. The first installment shall include interest at the rate of is per annum from the date of the resolution adopting the roll until December 31, 1974. s. If a property owner pays his assessment In full within 30 days of the date of the resolution adopting the roll,, no interest will be charged. Such payment should be made to the Village Treasurer. b. If a property owner pays his assessment in full prior to November 15th o any year, interest will be charged to December 31st of the year of payment. i T: such a payment is made after November 15th, interest will be charged to December 31st of the following year. s: 7. If after the hearing, and after the adoption of the assessment tolls by Oe Village Council, you feel that your assessment is unfair, you any appeal to the District Court of Hennepin County. Yout appeal must be served upon the dayor or the Village Clerk within 20 days from th; date of the resolution of the Council adopting the particular assessment roll. Your appeal must be filed with the Clerk of District Court within 10 days after it has been served. 'Riese rules with respect to time are jurisdicvional and the Council may not extend them. Failure to serve and file your appeal as set out above will result in We, dismissal. 8. The above procedures are digested frim Sections 429,061 and 429,081 of Minnesota Statutes which govern the Vill;)ge Council in their asti-3ssment for public laprovements.
