PRESENT: ,Mayor Hilde gouncilmen Hunt, Spaeth and Neils, Manager Willis, Planner Overhi-ser and Village Asse4.sors Pul ju and' {larrol l ; ABSENT: Councilman Seibold MINUTES - JUNE 4. 1973 REGULAR MELTING 1 I MOTION was made by Councilman Hunt.Xseconded by Councilman Neils, to approve the minutes of the June 4, 1973 Regular Council'' i eting, notion carried, four ayes. CONTINUATION OF BOARD OF REYIEh' The Council reviewed the Assessor's report on the two appeals heard at the -June 4 Board of Review meeting. MOTION was made by Councilman Hunt. seconded by Councilman Neils, acknowledging receipt of the letter from C. H. Mitchell, 18025 County Road 6, withdrawing his appeal. Motion car- ried, four ayes. With regard to the_ appeal of the Rauenhorst Corporation. the Assessor reported he felt the 1,298,000 valuation was a fair market value when compared to other commercial tracts sold in the general area during W1 and 19)2, It was pointed out that the unpaid special as- sessments and the 1972 taxes assumed by the buyer would bring the purchase price to approxi- mately $14,000 per acre. MOTION was made by Councilman Neils, seconded by Councilman Spaeth, to accept the 1973 assessed valuation of $1,298,000 on Plat 43721, Parcels 815, 1017. 2110, 2310. 5800. 6000. 6200 and Plat 439506 Parcels 4400, 4800, 5300, 8000, 8400, 88006 a3 recommended by Assessor Pulju and presented at the Board of Review on June 4. 1973. Motion carried on a Roll Call vote„ four ayes. i LAND USE GUIDE PLAN The Manager reported on the results of the Metropolitan Council Physical Development Com- mittee meeting held June 6. Both the EPA grant and the Comprehensive Sewer Plan were approved and will be before the full Metropolitan Council on June 14. 0 Special Council Meeting June 11, 1973 Page Two On the,gdestioA of the Land Use Guide Plan, the discussion concerned the definition of A what a guide plan should contain., The plan was criticized for not showing how the Zoning Ordinance will be revised, not including a flood plain zoning ordinance nor how the storm sewer plan will apply to zoning. It was the Village's<,position that Pych of this planning >> is sequential and that these matters will be dealt with after adoption of the land Use Guide Plan. Action on the guide plan was deferred until the staffs of the Metro Council and the Vill'*ge can have a meeting to resolve some of the Metro Council staff comments. The 60 days Which the Metro Council has to respond to our plan has now elapsed, and it was indicated to them that the Village would proceed with adopting the plan. J The Council Ooncluded their review of the Land Use Guide Plan at this'mretiing, and the following were changes made to the plan: Soo Line Industrial Area MOTION was made by Councilman Hunt, seconded by Mayor Hil.de, that the area wt$t of Holly Lane north of County Road 9 remain industrial. MOTIOR,;was made by Councilman`Aunt, seconded by Mayor Hilde, to an&d the motion to add that the LA -2 area be exterr ed along the north side of the tracks south of the quarter section line of Sections 7 andN\\8 west of Holly Lane. Motion as amended failed on a vote df 2-2 with Councilmen Spaeth'and Neils voting nay. MOTION was made by Councilman Neils, seconded by Councilman Hunt,;to eliminate the indus- trial north of the tracks and west of Peony lane but to leave the area west of Holly Lane north of County Road 9 as industrial. Notion carried, three ayes with Councilman Spaeth voting nay. MOTION was made by Councilman Neils, secondtid by Councilman, Hunt, that the area north of the tracks be 'eft as LA1n1 all ' t *4thewavtoHollyLane. Motion failed on a cote of 2-2 with M*ar N t 1 de and Councilman Spaeth voting nay, MOTION was made by Councilman Spaeth, seconded by Council- _ man Hurt, that the area north of the tracks b_ LA -2 all the w way to Holly Lane. Motion carried, three aye:; with Council - man Neils voting nay. CountX Road 100 & Cooy,%tv Road 18 MOTION was made by .'ouncilman Spaeth, seconded by Council= man Neils, to leave the neighborhood shopping center, highway service and limited business areas as shown on the plan which was held up for public h4aring. Motion carried, four ayes. Bass Lake Area MOTION was made by Councilman Hunt, seconded by Councilman Neils, that the Hanson prop- erty at the northwest corner of Bass Lake be changed from LA -2 to LA -1. NOTION was made by Councilmen Hunt, seconded by Mayor hilde,lto,approve the change recommendeJ by the Planning Commission % their plan dated 3443 except extend the LA=3 area south to 49th Avenue along the west side of the industrial area. LOTION was made by Councilman Neils, seconded by Councilman Hunt, to amend the motion to reduce the, LA -3 area as shown on,,",the sketch. Notion as amended carried, four ayes. NOTION was made by Councilman Hunt, seconded by Council- man Neils, to change the LA4 and the highway service area southwest of 49th Avenue and County Road 16 to limited business, Motion carried, four ayes. NOTION was made by Councilman Hunt, seconded by Council- man Spaeth, to change the 20 acres southwest of 26th Avenue and Pineview Lane extended from LA -2 to LA -1. Motion carried, four ayes. MOTION was made by Counciiman Hinit, seconded by Council- man Spaeth, to change the arP:, bounded by Highway 55, Vision of Glory Church, 261-n Avenue, Plymouth Creek and Pinevlew Lane extended from LA4 to LA1*3. Notion car- ried, four ayes. Munsingwear Site MOTION was made by Councilman Hunt, seconded by Mayor Hilde, to leave the Munsingwear site as industrial as presented at the public hearing. Motion carried, four Ayes. Mission Farm Property that the area= west Jof LA4. Motion carried, MOTION was made by Councilman Hunt, seconded by Councilman Neils, that the area between Xenium Lane and West Medicine lake Drive be la -1 south of proposed County Road 61 and east of Plymouth Creek, and LA4 north of proposed County Road 61. Motion carried, four ayes. MOTION was made by Councilman Spaeth, seconded by Councilman Neils, to leave the Juneau Lane area east of the nofth extension of Medicine Lake and south of 35th Avenue as LA01. Schiebe/Humphrey Property WION was made by- Counc4man Hunt, seconded by Mayi;- 'Hilde, to approve the cypansion of the limited business district. (cha,mge(#;2) as recomnmded by the Planning Commission in their plan dated 3443. Motion carried, three ayes, with Councilman Spaeth voting nay. NOTION was made by Councilman Neils, seconded by Councilman Spaeth, to extend the limited business district to the north side of proposed County Road 15. Motion carried, four pins. 1 NOTION was made by Councilman Hunt, seconded by Councilman Neils,, to nuke no changes in the Ravenwood area because of the commitment made to the present owners of those homes when the single family platting of this area was approved. Motion carried, four ayes. MOTION was made by Councilman Neils, seconded by Council, man Hunt, to approve the Planning Commission recommended change which would locate the highway service area north west of proposed Xenium lana and proposed County Road 15 and change the area northeast of :-494 and proposed Coun Road 15 to industrial, Motion carried, four ayes. Community Shopptig Center Area f There was discussion regarding the guiding for the community shopping center site,and the pr.ssibility that this tenter may not eventually be located in the northwest quarter of Section 21 as shown on the guide plan. Mayor Hilde suggested a footnote be added to the plan to indicate that a community shopping center is desired in the vicinity of I494 and Highway 55 and that there appers to be multiple possibilities for a good location and that the Council would not feel bound to have to go in precisely the location shown an. the guide plan if someone else came along with a better plan, Councilman Spaeth expressed concern that there 1s too much commercial use in this area along Highway 55 and stated he felt !t would be more feasible to change some of this area to !A-4. Councilman Hunt stated he considered the guide plan map as a broad scope view with the proper mix and pointed out that the Village still has the flexibility to make changes within this guide plan as long as it does not go against the adopted Goals, Objectives and Criteria of Village planning, MOTION was made by Councilman Neils, seconded by Councilman Hunt, directing the staff to prepare two footnotes to this guide plan map to indicate (1) the plan in its entirety represents the best estimate of the course of future land use that can be stated at the present time and that 1t will bt revised periodicdlly, and (2) specifically for the community shopping center area there 1s a lot of commitment on the part of the Village to this area; therefore, careful study must he made of the planning and legal rami0w cations of its locationt j 0 l Special Council June 11, 1973 Page Five Meeting J There followed discussion whether it was arise :o designate the areal shown on the guide plan as the,preferred site for this center, and the foregoing motion was withdrawn and the following action taken: 11 NOTION was made by Councilmen Neils,, seconded by Councilman Spaeth, to extend the'LA4 a 9 to the northeast of Vicksburg Lane and County Road 9 south of Plymouth Creek; change the proposed limited business area southeast of,Vicksburg Lane and proposed County Road 9 to LA -4; and change the proposed community, shopping center area northeast of Vicksburg There followed discussion whether it was arise :o designate the areal shown on the guide plan as the,preferred site for this center, and the foregoing motion was withdrawn and the following action taken: 11 NOTION was made by Councilmen Neils,, seconded by Councilman Spaeth, to extend the'LA4 area northwest of Vicksburg Lane and proposed County Road 9 to the northeast of Vicksburg Lane and County Road 9 south of Plymouth Creek; change the proposed limited business area southeast of,Vicksburg Lane and proposed County Road 9 to LA -4; and change the proposed community, shopping center area northeast of Vicksburg Lane and'Highway 55 to limited business. The staff was further directed to prepare a footnote to the guide plan map',making reference to the plan in its ta•j Pntirety as previously stated in the previous motion whicn was withdrawn and to draft a second footnote Fps which would indicate that it is the pian of the Council that there be a cannity shopping center 1n the vicinity of 1 494 and Higtiway 55 and that a good plan will take precedence over the present P guiding.
