Q 0 n G I MINUTES SPECIAL COUNCIL MEETING MAY 149 1973 A special' -,meeting of the Plymouth Villge Council was called to order by Mayor Hilde at 7:35 pm. in the Council Chambers of tl;e Public Works Building, 14900 Twenty-third Avenue North, Plymouth, on Nar l4, 1973. PRESENT: Mayor Hilde, Counci!*h Hunt, Spaeth.,Seibold aPd,Neils, Manager Willis, Engineer Goldberg and Planner,3verhiser, ABSENT: None MOTION was made by Councilman Seibold, seconded by Councilman Neils, to approve the -minutes of the May 79 1973 Regular Meeting. Motion carried, five ayes. The Manager reported on a meeting held the previous week with staff members of the Metropolitaft Council relat've to the Land Use Guide Plan, Sanitary Sewer Plan and EPA Grant. These three items will be before the Development Committee on the 6th of June and hopefully before the full Council on the 14th. He reported the Metropolitan Council staff is not recommending a favorable housing profile because of their Policy 31 review. They are basing that decision on their interpretation of Policy 31 which stresses actual commitment in terns of accomplishments of the municipalities, i.e., actual PUO ordinances, an active HRA, and a supply of low and medium income housing equal to the supply in the metro area (30S). He stated there are two things we must stress: (1) we have the commitment to providing mixed housing supplies in our community based upon the adopted Goals. Objectives and Criteria and the Land Use Guide Plan, and (2) the EPA Grant is an environmental concern as the present force main is nearing capacity. The staff presented to the Council a proposed assessment roll on this project to be used at the public hearing on May 21, 1973: It was the staff's recommendation that because all the property is zoned industrial, assessments should be applied at the same rate even though some of the properties have residential dwelling units on them. Street assessment on 15th Avenue was broken up two ways because of the different design on Xenium. All the property was assessed previously for some form of area charge; however, the MIP proper was assessed as residential at that time, The assessment ro 1 reflected a charge for the difference between residential and industrial for that property. The Engineer ex- plained that the staff had also tabulated the assessments on an acreage basis and presented these figr,r;es which would reduce the assessments on these four lots. Nayor tilde questioned whether there was some way the bulk of these charges for theJ,,thoroughfare could be charged to Northwestern Bell in a defensible wgy and In a manner that would be acceptable to them on the rational that they need it before the Village and their neighbors r,n afford it. He stated the only other alternatives would be to do'i, `she way the staff proposed or to terminate Xenium Lane at 15th Avenue at"' this time. Councilman,Spaeth stated he would like to see further inform motion on the acreage approach. Councilman Neils suggested splitting the improvement costs for Xenium Lane half to the west and half to the east side. and on the east side use the acreage approach for all the street assessments. MOTION was made by Councilman Spaeth, seconded by Councilman Hunt, that the public hearing be withdrawn until something is worked out with the \ assessments. Councilman Seibold suggested the staff negotiate with Northwestern Bell to see if there is same way they would subsidize arty part of the:e costs. Cou0cllman Hunt questioned the quantative figures which were usi and asked to see comparative figures from other projects before going to the public hearing. Notioe to withdraw the public hearing failed on a vote of 1=4 with Mayor Hilde and C#juncllmen Hunt. Seibold and Neils voting nay. MOTION aas made by Mayor H11de, seconded by Councilman Spaeth, directing the staff to make another attempt at an assessment approach for this project Which would consider: (1) a method of allocating excess costs to the parties who need this premature project; (2) develop a policy for oversizing in industrial situations considering the policy already in existi nce for residential uses; (3) credit for oversizing based upon that policy and (4) alternatives of financing the corner lot without going on both sides, Motion failed on a vote of 14 with Councilmen Hunt. Spaeth, Seibold and Neils voting nay. NOTION was made by Councilman Seibold. seconded by Councilman Neils, to go to the p iblic hearing with the figures as presented by the staff 1n their report dated May 10, 1973. Motion carried on a Mote of 4-1 with Councilman Hunt voting nay. The staff presented a proposed contract as previously directed by the Council. The Manager explained that the language of the con- tract was such that it could be entered into on each project with an appendix setting forth the fee schedule. There was//concern expressed over the 20% fee for the preliminary report in the event that a project is not ordered. The'Englneer explained this gets into the problem that we do not go into a public hearing un- less we are pretty sure of ordering the pro$ect. He also pointed out that the Council previously determined that they would be more careful in the future about ,ordering orerl im1 nary reports and would require more , h1 ghual i ty reports, Councilman Nei 1 s stated he felt the prel i - minary reXt should be strictly on a time and materials basis because 1t is a function of the project, and the Council should, -be in a position to be able to pay for what,they getft MOTION was made by Councilman Hunt, seconded by,Councilmen Seibold, directing the staff to develop a different approach on the preliminary report phase of the consulting engineer's contract for the reasons as stated in the foregoing=jiscussion, suggesting that perhaps there could be devised two different kinds of preliminary reports - c rough draft report on a time and materials basis and a full report on a percentage basis when the Council has full intentions of pursying the project. Motion carried, five ayes. MOTION was made by Councilman Neils, seconded by Councilman Hunt, that the contract be drafted as a general engineering service agreement for various categories of service such that it 1s appropriate to a particular project and would be evoked by a letter of agreement or purchase order. Motion carried, five ayes. MOTION was made by Councilman Neils, seconded by Councilman Spaeth, that the contract section 5.6 and its corresponding section in terms of work ty others to be provided by the engineer be reconciled. Motion carried, five ayes. The Council again reviewed the Land Use Guide Plan and pointed put areas which they wished to view the next day in their bus tour of the Village. The areas were basically those 13 areas where the Planning Commission recommended some changes be made refer to minutes of April 23, 1973 Special Council Meeting) and thi following were points of discussion in these areas: Soo Line Industrial Area. Councilman Hunt stated he felt the no ern limitmof the ndustrial area should follow the railroad tricks all the way to Holly Lane because of the topography of V -at area on the north side of the tracks. It was felt the area to the north should be given some density to preserve the woods possibly all the way to the first bend in Peony Lane.
