PRESENT: Mayor Hi l de, Council men Hutt, Seibold and Neils, ' Manager Willis Attorney Lefler and Engineer Rudrud ABSENT: Councilman Spaeth PUBLIC HEARING: ASSESSMENTS FOR KREATt LAKE STORM SEWER, PROJECT N0. 115 Engineer Rudrud explained the estimated costs and actual costs on this project. Total actual cost wa.s 351,356.92 on 304,626 assessable acres for a total assessment of $168.60 per acre. Pe explained tile, actual acreage was somewhat less than the estimate because final engineering of the pro= ject revealed some areas which had a different direction of floe, from the preliminary report, Actual costs were also. higher than the estimate pri- marily because of tree removal along, Dunkirk Creek and some lowering of water mains to match storm sewer. Manager Willis reviewed the assessment procedures for those in attendance. The Public Hearing was opened at 7:50 p.m% William Pr'bble, 2060 Jervell Lane, stated he felt the Fal endin 1st and 2nd Additions and the Ponderosa Addition should be tircluded in. this assessment 0s benefited parties as the wideni g and deepening of Ountirk Creek bene- fited their property. He also questioned why he was assessed for 10 acres for sewer and water and 12 acres on this project. Engineer Rudrud explain- ed the improvements to Dunkirk Creek were to increase drainage from Kreatz Lake and did not directly effect the plats mentioned, Staff wa! directed to check into the acreage problem. Greg Beckers, 18640 County Road 24, discussed the increase in property value and taxes on his property over the past seven ,Wears. The Council discussed the fact that this is a common problem in Communities in earl steges of development, It was pointed out to Mr. Beckers that there wifl be no further sewer or water assessments on his property, but storm sewer projects are different because you build them only as it becomes necessary to do so. James R. Monroe, 1,7735 26th Avenue North, questioned if the actual cost assessed was totally construction cost, Engineer Rudrud explained that construction costs totaled $48,706.20 plus a 20% contingency factor to cover administrative costs, easements, legal fees, engineering fees, etc. Mr. Monroe questioned why the area Northwest of County Road 6 ant NAghway 101 had not been included in this project ansa and why comnercial i assessed at the same rate as residential. Sorense.4, 14115227's Avenue worth, questioned why the VillageJ set the interes0t rate at 83o Councilman Seibold explained that it has been our practice to allow a 2% fluxuation in the interest charge primarily for another way,of iretiringthe debts as 6hey come due. Any surplus funds arp put into the sinking fuiA . and this is one of the many ways the Village has used to maintain fiscal responsibility. R. C. Burnham, 17315 24th Avenue North, stated he understood it is some- times the practice when subsequent projects are put in downstream the costs of these prnjects are deducted. Councilman Hunt explained that Kreatz Lake is a ponding area. and so much redit is given for ponding areas for future construction. It is likely thAt future projects will have a lesser amount, but no refund. Mr. Rurnham questioned if future projects that may drain into.,this system will effect their Credits to future charges. Councilman Hunt stated the pillage feels we have done a thorough job of taking all the land that drains into Kreatz lake and all other area should drain into another area. James M. Mildes, 2420 Olive Lane, raised a question relative to park land across the street from his residence and some fill the Village is doing along the pond and drainage ditch. Ranager Willis explained assessments will not apply to the park and we do not contemplate the ditch being covered. The fill is to level off the area and to slope the banks to the drainage ditch. Councilman Neils explained the Village attempted to use surface drainage as much as possible in this project to hold down costs. Vernon Peterson, 17425 County Road 47, stated he owns land along the south shore of Kreatz Lake and questioned if the water level of the lake is raised if his total acreage should not be adjusted. The staff was directed to research the problem to dettvmine ifpart of his land is now a flood plain, in which case it should be excluded. Lowell Sedler, 27.75 Shadyview Lane, the South shore of Kreatz Lake that determined this Is Vernon Peterson's previously airected, questioned why there was an area on wa4 being filled in now. It was property and will be examined as The Public Hearing was closed at 8;30 p.m. PUBLIC FARIK%: ASSESSMENTS FOR 1972 WEED DESTRUCTION Manager Willis explained this hearing is to consider the assessments as a result of the Village's weed inspection and cutting program for past year. Mr. Schiebe stetted he would like to see the Village and County cut their own weeds before they cut residents' Needs. Thomas Forster, 11420 County Road 9, (Plat 43714, Parcel 7032)'stated he believed the property he was assessed for is actually Village property. The staff was directed to determine 1f the areo ,,outside of the fen;e is Village property, Manager Willis indicated there were a number of other calls staff has received on the weed assessments (listed below). These are being inves- tigated and will be brought to the Council's 3:tention at the time of ,'the adoption of the assessment roll. STREET LIGHTING PROJECTS Manager Willis explained that following requests from homeowners, public improvement hearings were !geld. Fol Iowin the oroi ring of the improve- ments, the apmropriate utility companies installed toe lights, and the purpose of thin hearing is to review the assessments for these projects completed in 1972. I1 Special Council, Meeting r '1 October c 1972 Page Four 1 Jll Attorney Lefler referred back to the Kr Lake Storm Serer Project No. 116 previously discus ed and lee tots on Itth Avenue brought to the Council's attention by Mr. Qobson. stated that lf\these properties were not inw eluded in the public improvement hearing, it\Vill be necetisary to go through this again. He suggested it would pro ably be better to just re- duce the assessment roll and the Village absorb the difference themselves. Councilman Dunt pointed out ,that if they do in fact drain to the North and are not included in this otsessment roll* the'Village will never be able to include thein in the future project to the Sauth-.
