SPECIAL COUNCIL MEETING
PLYMOUTHv MINNESOTA
June 12, 1972
A special meeting of the Plymouth Village Coyncil was called to order by Mijiyor Hilde
at 7 3CO o m, on June 129 1972. ,
PRESENT: Mayor Hilde, Councilmen Seibold and Spaeth, and'Planner Overhiser. (Council-
men Hunt and` Neils joined the meeting after the first two resolutions were
passed.)

MOTION was made by Councilman Seibold, seconded by Councilman Spaeth, to adopt RESOLU-
TION N0. 72-202, A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A TEMPORARY SALES
OFFICE, as per Staff'recommendation. Motion72402 4

Amendments to Zoning Ordinance (A-11)
Item 5.A.
Mayor Hilde discussed a letter written by Mr. Jay J. Carpenter of Ban Con Inc., who ex-
pressed concern on the effect of proposed zoning ordinance changges for multi -family and
townhouse zoniq caaegories. In Council's discussion of the points involved, all were
handled in the 'Proposed Amendment" to the Zoning Ordinance,
Mayor Hilde requested that Planner Overhiser check with the Minnesota Housing Institute
regarding market studies on three-bedroom apartments.

Low/Medium Cost Housing
Councilmen Hunt and Spaeth pointed out that low cost housing does exist in various
areas of Plymouth where homes art selling for $22,500. Councilman Hunt pointed out
that a home can be built for this price if the lot doesn't sell for more than $1,000,
but Assessor Pulju evaluates a lot at $5,000 minimum 1 f a house can be built on it.

Mayor Hilde requested:
i. The Staff develop data and a map identifyin4 the location and numter of housi ig
units that would qualify as low and medium income housing,,
2. That 1n the Guide Plan they build a "mix" within a certain development on a devel-
oper's PUD;write the percentage requirement that will be low and medium cost hous-
i ng.
Types of Developments.
Mayor Hilde brought up a point in Ban Con's letter whereby it,was suggested that the
planned unit development" regulations would control '.he type of developments in Ply-
mouth. Councilman Spaeth felt that with *fie additional levels of zoning being planned,
density would dictate the types of buildings. He suggested that credits be given to
the developer for underground parking, 34 story buildings and quality features, so
that under the new Zoning Ordinel,Ice we would exchange densit.for quality.
Mayor Hilde read a letter from the Minnesota Housing Institute wherein Neill T. Carter,
Executive Director, voiced his objection to the regul"ions imposed on builders in the
Village of Plymouth. Mayor Hilde felt that tha association's stand was to lower stan-
dards, not upgrade them. Councilman Seibold felt that they are making a plea for very
liberalized rules and regulations in the Zoning Ordinance on an over-all basis, not just
Plymouth; whereas, the Council and our Zoning Ordinance is inly concerned with Plymouth.
Mayor Hilde requested that Planner Overhiser droft a letter to Mr. Carter, expressing
the Council's intent with regard to the proposed amendments.
Sound
MOTION was made by Councilman Seibold, seconded by Councilman Spaeth, to direct the
Staff to follow the ordinance with reference to necessary deposits for sound testing
walls and floors for each building permit from this point forward and including those
already approved but not under construction, and further that the 4eveloper be charged
only with those costs associated with said testing, with the inspects -ng compare to be
the agent of the Village.
MOTION was made by Councilman Neils, seconded by Councilman Spaeth to request the Staff
to prepare a resolution showing administratively haw they intend to handle it. Motion
carried: Five ayes.
Gare
MOTION was made by Councilman Spaeth, seconded by Councilman Neils, to limit att,tched
garages to common entrances, only, and that the Staff refine the entire amendments all
the way through so as to take this directive into account.
Councilman Neils suggested that they proceed as written on the "Proposed AmendmPow;" and
write into Section 17 an exemption for the attached garage. Council agreed this Mould
be o.k.
Mayor Hilde asked Planner Overhiser to consider redefining multiple, according to ';he
private entrance criteria.
Motion carried: Four ayes, with Councilman Seibold voting nay.

five ayes.

NOTION was made by Councilman Spaeth,, seconded by Councilman Hunt.Ahat the area for a
three-bedroom be dropped down to 600 square feet from 800 square feet, and .that three
bedivoms ha+raised from 5% to 10%. Motion carried: Five ayes.
MOTION was made by Councilman Hunt, seconded by Councilman,Selbold, to change both
references on the terminology of residential units in 1.11 "Trash Disposal" to: "Except
for residences with private entran`des we trasWchute ,for each 60 apartment units shall
be......." Motion carried: Five ayes.
C%;uncilman Neils stated that an apartment unit must have a trash chute directly conpec-
ted to a compactor or an incinerator located in the proper room and provision must'be
made to deliver residual trash to grade level for pick up. Councilman Spaeth suggested
that an enclosed storage area neat the building be made available for pick up. ,
Councilman Nei'5 suggested that rather than tying the elevators to the number of stor-
ies for a multiple, they should go back to the private entrance criteria.
The Staff was directed to redraft the proposed amendments based upon the Council's dis-
cussion and directives. with private entrance criteria.
Planner Overhiser commented that he did not feel "sound" should be in the Zoning Ordi-
nance if it is to be part of the.State Building Code.
