Why isn't it being considered at the same time? Mayor Hilde sail tho'whole area drain- age design is divided'into various districts which we want ;.o consider all at once. A problem has keen developing in this area and rather, than do it in small segments we,want to hear it all at once;,\ Councilman 11unt said that the storm sewer project in the area of County,lt6ad-#6 and Highway 6101 was long in the works before the Schiebe project over cam%.about. Whether the Schiebe prolect gats developed or not has no bearing on the propose` storm sewer project. There is a severe drainage problem there. This mirely ties in with the cveraal storm sewer project and in accordance with our trdinance they will to required to put in catch basins with street designs and,.iay for it.. Councilman Neils asked the attorney if his impression is coz,'ect;that In an I, open area a landowner has as much right to waterproof his 1A' -%4' vhether he be, developing the first 20 acres or the last 20 acres in a watershed. Attorney Drawz said that is true. In accordance with the law any lanlowner has the right to develop any part of his land as long as he uses caro( in disposing of his surface water. Just because:he is the first one in tie area and waterproofs his land as long as -)he does it in a reasonable autnner and does not drain it, funnel it or collect it onto his neighbor's prrperty it is allowed. Mayor Hilde explained that this is a catch up project. An easement will probably be required between Lots 4 and 5, Block 1. TF.ete are homes on Lots 5 and 6, the corner lots. It is more beneficial to come in through Lots A and 5. Further design of the plan was described. Rev. Oas said he did not understand the trunk sewer assessments on unplatted areas which is not included in the water and sewer laterals, Lhe open area to be sewed by the trunk. In 1,969 we were assessed, is this in addit{on to the Southwest assessment which are paid at that time? Manager Willis said yes, we are talking, about the unplatted poi tion of the trunk and he stated what these figures might be, approximately, which is in addition to the 1969 assessment as covered by the preliminary report for that area. Mr. Harold Birkeland, representing Mr. Taylor of playhouse, Cn., Inc. said he was opposed to the main trunk and where it is located. It is probably loc- ated in a bad spot, when you run a main or trunk down a ditch ur slew there are problems to connect to a lateral. It is an expensive procedure and act- ually works against: the area where it is located and in locating it in a low spot it does not allow for norma. usage. I recommend this be held back if p03Stble to allow time for addit:.onal study for development of this area which is being done noir. The main reason I, am here is to object to the trunk location. Mr. Floyd Olson, 16521, 28th Ave., said he has 10 acres an Highway #55 and County Road #24, north of the ch.irch. We would like to develop this area and need this improvement. NOTION was made by Councilman Spaeth, second by Councilman Hunt directing the manager to order a fiscal study for Project 1206, to see if this is feailvie and how we should go Ao" it, what hits been, assessed and what hasn't. PROJECT 0201: Vicksburg Lane, CSAH M6 to 26th Avenue Street Improvement. Mayor Hilda saia you may want :o hold this project until the fo;mal fiscal study is received for this also to know where we are at. Councilman Spaeth agreed and said we should know what State Aid we will Yoe, if any. MOTION waa made by Councilman Hunt, second by Councilman Seibold to tadopt RESOLUTION N0. 72-52, A RESOLUTION ORDERING THE FINAL PLANS AND SPECIFI- CATIONS FOR PROJECT 0201s VICKSBURG LANE STREET IMPROVEMENT CSAR 06 TO TO 26TH AVENUE. Notion carried 5 aye roll call vote. REDISTRICTING Mayor Hilde displayed a color coded map which he made up showing the District Court's decision on State Legislature Redistricting boundaries. He asked for Council's attention and pointed out the lines along with lines of proposed precinct boundaries. The new line for Precincts #1 and #5 cover a population of 4,000 each and Precincts #2 and N3 cover 5,000 each. There was a lengthy discussion on this subject. WTION was made by Councilman Neils, second by Councilman Spaeth to direct the manager to prepare a redistricting plan, and A. Use the new Court Legislative boundary as the principal village redis- tricting line, and J Amended 2i' 7174; F:TRAL PLANS b SPECIFICATIONS PROJECT 0201 3 RA: REDISTRICTS B. Co, Eliminating that part of the County line running from Highway `#55,,runiking southeast of County Road 06 to County Road #18 and substituting therefore, the line which follows the railroad tracks from Highway 055 to County Road 118 which is the new Court Legislative line. !Motion carried 5 -aye votes. The Manager to have this ready for the next meeting. There was a discussion on whether there should be four`,or six precincts. Mayor Hilde questioned the -short length of time (from now until feb. 22nd3' if it is changed to w1r. precincts for the political parties "to ged aveaniced. Voting machines for the next election and cost for same plus efficiency were also discussed. MOTION was made by Councilman Neils, second by Councilman Spaeth directing the staff to attempt toyprepare a plan that will call for six voting pre- cincts. Motion calrried 3 aye votes. Mayor Hilde and Councilman Hunt voted naye. A further discussion ensued on the number of ptacincts vs. timing. We must heed the Court lines established said Mayor Hilde and consider causing poli- tical partiep serious problems with getting leadership on such short notice.. COM41SSq, ObON APPOINTMENTS MOTION was made by Councilman Hunt, second by Councilman SEibold to 1--%7point RE: APPOINT- Praacis D. Hagen to the Planning Commission, representing District 04, for MMS o three ygar term. Motion carried, unanimous vote. MOTION was made by Councilman Hunt, second by Cuuncilmon Seibold to reappoint Reg Kroskin as.a member of the Planning. Commission for a term of 3 years. Motlon carried, unanimous vote. MOTION was made by Councilman Spaeth, second by Councilman Hunt to appoint Jim Threinen as a member "at large" to the Planning Commiesion for a term of three years. fttirn carried,, unanimous vote. MOTION' was made by Cauucilman Hunt, second by Councilman Seibold to appoint William No Rova to the Building Codes Advisory Commission. Mocion carried 4 aye votes. Councilman Neils abstained. Councilman SCibold repeated his suggestion made last week to send a letter to those who made application to serve on a Commission and were not accepted. He and Councilman hunt both discussed the operation of the present 7 man Planning Commission board instead of the usual 9 with the applicants they interviewed and told them ,it was conceivable we may go back to a 9 man board later. They were asked if they would be willing to attend the Planning Commiasio% meetings pro tem. receiving agendas, etc. thereby keeping in rtep with what has been going on should they be appointed as a memb©r later. They expressed interest but wished it qualified so they knew they were going somewhere. Councilman Spaeth felt they should be doing this on their own. Councilman Seibold strongly recommended Mr. Dvorak and Mr. Schwartz as futute PlaAning U mission appointments. Mayor Hilde said he will write them c letter. Two persons cited incidents to him wherein their cars were towed away and they felt the treatment they received were not juat.Jied. Manager Willis said we have a contract for towing service which Councilmfin Hunt asked to see. Mayor Hilde askud them to get together and review the contract and if they think it should be discussed o make a report to the Council.
