Mayor Hilde brought up the subject of "Furcher Developments Concerning
Property Tax Levy Limitatione". The Leepas of VAnnesota Municipalities
sent a memo on December 23, 1971 contarning the most recent developments
on this 14ave. Pecause it to believed that the Coasatlosione; of Taxation

The Mayor a Council raviewed and discussed the Mayor's Project List R.E: PROJECT LIST
Procedure :mo of -December 27, 1971. Councilman Johnson suggested that
the Manager make a report on what he feels are project• of hiRhest

Manager Wilts said this is being prepared and will be forthcoming.,
Council Hunt felt there are a lot of loose ends in the list that

Nay6r Hilde asked for Counc!19s reaction to his list which still requires RE9 PROPOS®
several "responsibility" designations and refinement. Councilman Hints PROJECTSO 1972
asked for cclarifi.tation of the "responsibility" designation which Mayor
Hilda explonnd. Councila o Johason felt there were wore projects listed
than should,bat , He felt tniat Civic Center site plans should be considered
which was biscuased. Councilman Johnsas questioned the development of
water rates for the Village: Manager Millis said this is to be part of the
Forecast. Councilma SW%ith said the Charter Commission should be reactivated
so a village charter can be established in order to not up a constructian ro•`
volving fund. Payor Hilde said thb Chatter Commdsston is already to proceed
with a full membership.
Cowmcilmmn Johnson felt the Planner should "ve involved and supply a supple-
mental list to be used as a guide for the Council for their thinklag in tatwa
of planning next near. They should be protected and have a strong basis for
saying "no" to something in a critical area* leo will. hove taken the first
step there. Councilman Hina saUt. the Planner acts as a checkmate at the
Planning Condesion meetings. l tayor HlUe said we are waiting for the goals,
policies,and criteria. The public hearing an criteria will be held Jan. 26th.
Councilman Johnson saki there are areas waiting to be developed and regard-
less of the work we are doing, sounane will come in with something we do not
like, but if the Planner comes up with something we will be prepared for it.
Councilman Hintz said critical. areas have !seen taken out on our contract.
Councilman !curt said we have a guide plan. Planner Overhiser said there are
only 3 or 4 such areas.
Councilman Hintz felt the project list r1presented three years work, the
Council should make tare they know whalr- hey are doing. Councilman••elect:

things for a decent guide plan. rnuncilman Hun paid he twould like to see
where we are finat.cially. Mayor Htlde suggested that he and any other council-
man who wants this infamatipn go to the village hall and sit down with "tanager
Willis in his office and go over and discuss these figures.

Couneilman Hunt said Dr. Lee Kochenderfer called his and asked if,he
could appear before the Council and he told his he could con. D*.
Rochende:rfer told his that he wanted to get an answer an his reacming
petition while Councilman Johnson and Hints. were still in office,, as
they are familiar with his petition. Dr. Kochanderfer said he first
called the Manager but was told items of this nature could not e put
on the agenda for the last meeting of the smooth in accordance with
Council's instructions and that this specific request was resolved.
So he called the other Councilmen about tttie, each said they were in
favor of the rasoning and would vote in favor of his petition. Mayor
Hilde said he was not familiar with the last action taken by the
Council. `tanager Willis gave a rundown on the action that was taken
by the Planning Commission and Council.
tOTI(V was made by Councilman Hunt. second by Councilman Hin.ts to rescind'
the action taken on October 18, 1971 denying the request for R-1 zoning
at 10875 South Shore Drive by Dr. Lee Kochenderfer.
Mayor Ililde asked the Planner for his comments. Planner Overhiser said
there are ways to allow offices in residential districts but they should
be set % in ordinance forst. Denial was recommended becauas it is in the
middle of a F-4 dist.xict, which would set a precedent for 4loving a bus-
iness in tl e middle of as R-4 d:atri,ct. This may be detrimeptal from a
4eveloper's standpoint. `tayor !tilde referred to the Conditional Uses per-
mItted in the Ordinance Code. He said he did not agree with the Planner.
Councilm-elect Nails reiterated the Planner's stateawnts and added that
the 75' sel:hack requirement could not be ma+<., and a question of it being
a clinic M1ks raised. Dr. Kochenderfer aatd it would ovt be a alinit. just
an office vith himself and an office emplo}ee. Posathly, some dad, he M4
add a couple chairs. Ito hoped his son would follow his profession.
Councilman Spaeth t;aid a response has not been receivet' to their No%temho r
fi4•st request asking the staff to invertigate the possibility of allowtng
offices in residential areas. The Planner said the PlanninR CommlRalon did
not change their original recammendatlou when they reported hack to the
Council on Novemher first, and it was true thtt the staff did not respond
to the staff neferral made on Noveml,rer first. Cauncilman-elect Fells
confirmed this, Motion carried 1 aye votes, Councilman Johnson and Mayor
Itilde abstained%

Councilman -elect Neil* said the Planning Commission recommended denial because
it would be spot soninR, special treatment for a certain piece of land and it, !
could not meet setback requirements. Councilman Hints felt it would be compat-
able with R-4 zoning. Councilman Runt 4uestioned her &A.iadividual business
man can pt set up to Plymouth. ranagor Villas read 0o motion made ^n
November first and said he dtA not perceive that this meant further action
would be taken on this particular request, just an overall study of ordinances.
The attorney advised his that an ordinance would htac to be drafted to amend
the cooing ordinance to permit this type of business operation. Manor Over-
hiser said to amend the zoning ordinance req«irts a request from the Council,
Planning Commission or a citizen in the form of a petition.
