HomeMy WebLinkAboutCity Council Minutes 08-18-1971 SpecialO MINUTES OF A SPECIAL COUNCIL MEETING PLYNDUTR, MINN$SOTA' AUGUST 18, 1971 A spocial,mating of the Plymouth Village Council was called to order by Councilman Hints at 7:40 P.M. on August 18, 1971 in the Onkvood Slowntary School for the public hearing on Project 171-2,H, Kraets Lake'Drainage Area Storm Sever. PRY.SENT: Councilman Hints, Runt and Spaeth, Manager Willis, Engineer Rudrud, Consultaut Engineer Olson and Attorney Drawt. Councilman Johnson and Mayor Hilda arrived late. ABSENT: None r Councilman Hints iutroduced msabers,.)f the Council and staff. Manager Willis stated the purpose of calling the public nearing and reviewed 'the agenda distributed to the citizens. He told them that if the project is ordered and installed that at Roe later date they will be sent a notice of an assessment heaping. At this time they will find out the amount of the assessment that.' will be levied for the improvement. 30 days from that date, at which time the assessment roll will be adopted, the aP . y can pay up the assessment lutereet free. Thereafter the roll will be forwarded to the County Audi,u to appear on your nest years tax statement. You can also avoid having it appear on your tax statement by paying jit up in full by November 15th .if any ye+tr incl- uding the interest to the and of that year. Engineer Rudrud said this improvement will be an outfall pipe from Kraets Laks. Flooding of the lake has inundated many trees and could cause considerable property damage. In 1908, approximately, the County placed a drainage pipt to control flooding of the lake with no maintonanee of the pipe intended. There was probably just one landowner in the area at that time. Through the years the clay pipe has become badly in need of repair or replacement, silt has built up in- side which has reduced the drainage capacity of the pipe and prevented the take from returning to its' normal level at the :regular length of time. When reports were received regarding the high lake level a preliminary report was ordered in 1970s Four alternates were considered to relieve the situation. He described the alternatives. It was decided to select alternate 01 which will construct a now line generally along thin same property lines and acquire easements wherever necessary, Kraets Lake vtll be a holding pond. The water will still rise about two feet during peak runoff pertuds but after three days will revert back to its own level with this improvement, which presently takes several weeks. Slide& covering the area were projected and described by the Engineer. Attention was called to the estimated pro;ject cost and estimated assesssaat report attached to the agenda. If ordered, the pipe should he completed by March 1, 1972 &A cleanup finished by June 15, 1972s Public hearing procedure was explained and opened at 8:15 P.H, Mr. William Pribble, 2060 Jewell Lane, aakeO if the Cooncil has explored or exhausted study of the sewer and water berm or if a fzasibility study was dove on the watershed district. Engineer Olsen said the berm was put there for construction of the sewer line. It does provide drainsgt co the outfall line and does not have any significant effect on the water retention. 0 Page 2, August 18, 1971 Special Msetinig Mt. W, R. Jones, 2270 N. Highway 1101, said he was concerned because he owns five acres to'be assessed and asked if there were any options on this. He could not see any improvement for his. property. The alternate action, said Engiueer Olson, was to just repair and clean the line, but the Council reviewed the costs and fait this not a solution to the problem. Mr. Melvin Getten, 710 Righway 01019 asked how such lower the now pipe will be than the other'one. Engineer Olson said it will be placed roughly the same elevation as the existing one but will be designed to a tighter -grade, have access to manholes, periodic examiaetioae and be of 24" reinforced concrete. Mr. Gotten asked if more lareo will 1» reclaimed and will people benefit around the lake! Engineer Olson said the project is to prevent inundation of abutting propoity, not reclaimation. The normal level ie. 971.25 and we hope to maintain that elevation. Councilman Hunt gave the various elevation figures which the lake rose to in previous years and in 1970 It 'was as high aw 974.1 after a heavy rai,nfall. Haw it is proposed to maintain the normal level was explained. Mr. Gotten questior_A any land reclamation created and if an 4assessment would be ride fc-r addic owd usable land. Manager Willis said this would have to be decided by -tht Council after the project is completed, but that no land re- clamation was anticipated because the now pipe would be set to meet the normal level of 971.25. Mr. F. Loughman, 2640 Olive Lane, said in Candlelid:.; Terrace 29 lots are Involved and 15 out of the 17 homeownere have signed a petition against the Improwwnt which he submitted to Manager Willis. Mr. David L. Woldt, 2205 Troy Lane, said he represented the Imperial Homeowners Association and only two residents received the hearing notice. Engineer Rudrud told his sow notices may have gone to the mortgage holding firm. Mr. Woldt asked when the elevations were takin. Engineer Glean said they used the Nark Hurd 2' topography saps, submitted grading permits and made physical field checks to check the flow direction, using preliminary boundaries. Mr. Woldt caked why the County doesn't take care of it nowt Engineer Rudrud explained the circumstances concerning the original pipe Installation. Mr. Woldt asked if the harsh is privately owned and the Manager said evidently, because it Is not owned by the Village. Mr. Woldt said you mentioned that sooner or later everyone will, be getting store seer, won't that take care of the problem then? Ranagu3r Willis said the 15 people who signed the petition are saying they do taot want the improvement at all. Sooner or later storm sever will be put to other areas of the Village. Mr. C. J. Stehlik, 2112 Highucy #1011, asked if the 971.2 level is correct. He surveyed it and the top of the pipe now is at the 971.2 level and water is standing there now. Engineer Olson said part of -the work is to relieve the pressure of that outlet. Mr. Stehlik then asked if anyone brought this up to the Highway Dept. Engineer Olson said it was and he explained what is being done with respect to grade. Mr. Stehlik asker if nix investigation was made on why it does not go down to the Fasendin Development. Engineer Olson said this is the cheapest route. Mr. Stehlik said people cannot understand why they are I LJ 1 it o Page 3, August 18, 1971 Special retina assessed for something away from their house, you should point, out that when land is develcped 18 to)20x of that property gets waterproofed - b'afore that the'rain soaked the whole property. but now water runs :off from the developed area and is a liability and responsibility of the landowner. Mrs, Getter, asked if sesameis will have to be purchased through the Fasendin property. Engineer Rudrud said the Fasendin property is dedicated park land And we want to get this in before it is improved as a park. Some people have asked what will happen,if this project is not Improved and he explained what has occurred and the reasons for it. Mr. M. Diets. 270S Urbandale Law, said if the'first slide that you projected showing the responsibility of the drainage into the lake is valid and that later we will have to have more storm sewer why will this have to be assessed to us and not split throughout the Vill *e now? the Manager told him that property within the Minnshaha Creek Watershed can be assessed for the runoff to the Minnshaha Creak Watershed Districts, Councilman Hunt displayed a map showing the four watershed districts and their boundaries in Tlymouth. 'Mr. Diet: asked hov many,timss they will be assessed. Manager Willis said as,many times " you v.11 be affected ty the watershed drainage area. These problems however are not that immediate. Sewer and water is the priority at this time Mrs Erickson asitsd'if you put a 24" pipe in and later get a storm ewer will we get another 24" pipet Engineer Olson sa±d based on a 100 year store study we predict a two foot variation of the lake level for holding purposes. The lake will store it for a period of tive and he explained this subject further. Mayor Hilda said •tors severs give the Village representatives the most difficult challenkie. They an hard to explain and sometimes there is no way to give an answer, especially where people live on h#4her ground. This pro- ject will be taken"up at next Mondays Council meeting.
