SPECIAL MEET'I'NG OF THE VILLAGE COUNCIL.
PLYMOUTH-, MINNESOTA
JANUARY 6- , 1970
A special adeting of the Plymouth Village Council was called to order at 7;30
P.M. by Mayor Rilde on January 29, 1970.
RESENT: Mayor Hilde, Councilmen Johnson, Hints, Kindseth ani Spatth, Engineerb
Hagew and lonestroo,,Attorney Lefler and Village Clark sarnee.

Mr. Olsen was auked what other cim munities are doing in regard to assessing
developers. He said he made a si:udy for the overall financing over a five
year period va. a 10 year parted and finds that the time differential does
not haw -much effect. Neighboring municipalities have a different way of
treating these dt+velopments as they occur, some allow 15 to 20 years and
others assess over a very short pa.riod. He would like to make a further Amended 2/16/70
study on this subject, but recommends going up to ton years. Today's money
market presents a problem foY developers. He made a comparison study of
Egans Township, who assess 1002 of the cost and spread the assessment over
20 years on improvements. He will give Council a report on this study.

would occur if a flexible approach was used. Attorney Lefler sola this
would be putting a burden on the Council and would be apt to create a situ-

you do this for we and thus be accw;ed of discrimination. There was a diam

Hilde said it appears: that our policy is unduly conservative. He questioned
reducing the down payment and extending the period From 8 years to 10 years
and requiring a bond for the balance. Councilman Hints wanted to know how
the bond rate would be affected. Jim Olsen said it will be sometiwe before
we will get back to the old rato. Tho more debt you have is reflected on
the bond interest. There was a discussion on making it 10 years for utility
Improvements and 5 years on streets, curbs and gutters &ad prepayment i.t the
time of building permit application. 1't was mentioned securing a bond in
lieu of a down ptyment. Attorney Lefler asked what the bond would cover.
Engineer Hagen said it mould secure payment to us. Bonding was discussed,
it's rewtrictions and cast which is $1.5.00 per thousand payable in cash,
not backed by collateral. Councilman Kindseth said this in itself is indi-
cative of the risk involved.
A hypothetical case agar given and Golden Valley's policy was mentioned, but
co-ald not be considered because it was set before money becomes tight. A
gt:estion vara raised as to whether or not we are more anxious to promote
commercial and industrial development or residential. Councilman Johnson
said the Council should be moreconcerned with what we want rather than
what the developers want, and this was discussed.

Engineer Hagen said where platting occurs the cittsen on the other side of

uq:qur problem and asked how other covaunities handled this situation.
Councilman Spaeth asked if it was Council's intention to help industry to
come out and develop or 1-e uta status quo. There was a discussion then on
Mayor Hil,de's question on whether or not v* should remeiin conservative or
move towards a more liberal. policy to encourage indu(etrial development.
Councilman Johnson brought up the question of security if we required 202
down and the belan;:e assessed at 1002 over 10 years. He asked if there is
more security than no dam payment and obtaining a bond? Attorney Lefler
said the more money a person: has invested the mora likely he will not go
delinquent, Various calculations on ass::ssment programs were discussed end
M:yor Hilde said an attempt should b• mile to arrive at an agreeable plan
and this question should be given to the Finance Director and Engineer 11agen
to discuss with Jia Olsen and Attorney Infler for their comments and report.
They would study a plan requiring 15% dimm for industrial and commercial
developments, asseautag over 10 years for water, seder and storm sewer and
S years for roads, curbs and gutters, with full payment on the unpaid bal-
ance of the parcel at the time the build;.ng perrAt is acquired. It was
agreed that residential assessments shou;.d remain as ie.
Mr. Cavanaugh discussed with Council the land he is willing to donato for a
park site lying north of the future civil: center site. Mayor Hilda stated
that it is understood that Mr. Cavanaugh generally agneas with the central
plan concept particularl; our lineal park site and commercial site lying
west of and adjacent to the civic center site and because of this he will
talk to the staff and attorney in terms i)f dedicating the area x'd on the
map, which will be 10 plus acreb. There will be a period of time required
to settle this because Mr. Cavanaugh said he does not want to Jeopardize
his mortgage. Furthermore, this is a relationship which will have to be
Worked out and agreement will be made subject to transfer of title.
lir. Cavanaugh mentioned that his brother-in-law would like to sell moble

Mr. ,Tim Olsen reported on bondi•ig and said he presumed Council is aware
of ,,.he present bond market. This bond market was the highest it has ever

long period bonds for 30 years are difficult to move. The force main in-
stallation Will have to be bonded over 30 years, but by March there pro-
bably will not be any concern in this ragard,

Lond.ing for a shorter period was discussed and Mayor Hilda asked Attorney
Lefj.er if a 20 or 20 year band could be reftwded or ballooned. Attorney
Lefler said it could be done but only after the first 10 years. Jim Olsen
said a contract must be awarded before you can sell bond*. Engineer
Eonastroo said a wait of 45 i sys for the force main will hurt, however,
the force main vill,not have to be bid on as one job. This was not discusaed
further because scheduling is not the question at this time.
Regarding the appliciits for Park Director the Park Commission has proceeded
to interview a numb*_ of applicants and are considering three. Mayor Hilda
mentioned previous success by Committee interviews and Attorney Lefler said
this procedure could cg.etinue unless an Intek Manager is selected. Payor

Councilman Kindeath said h. had no criticism of the man to be selected but

contract. A better scheduling should also be set up for the purchase of

Councilman Hintr said Council should know hod much thr village cars are

Councilman KInts called Council's attention to the a-nou-mobile ordinance vio-
lations th^t a.A ocrurring, especially around and on Medicine Lake. He said
a warning el ould he made to them. He recommended contacting the Water
Safety Dept. of the Conservation Dept. immediatly to lost Medicine Lake
and not allow them to drive in full throttle near fish houses, Councilman
Kindseth .sited an incident where he was ordered out of the way of a snow-
mobile on his own property, and Councilman Spaeth told council there have

stitches. CauncU. agreed to take a very serious look at cur ordinl..ince and

MOTION was made by MAyer }tilde, second by Councilman Johnson directing the
staff to prepare a plan of notifying snowmobilers. including sign posting
wherev,ar it is feasible for the purpose of attempting to reduce untoward
ochavxor in Plymouth Vill.igs. Also, contnet the Hennepin County Water
Patrol and the Comissioner of Conservation and request them to patrol

Counc,ilmriti Kin1seth @&id there has been discussion regarding the Planning
Comminsion's rules if proce.ure which they apparently have not adopted.
Thoay appear to he a,ixed up on committee respansihi pities. Councilmen
3ohnnon and Kindseth were asked to check into this matter with Ed Egan.
