NOVEMBER 24, 1969
A special meeting of the Plymouth Village Council was called to order by
Mayor Hilde at 7:35 P.M. on November 24, 1969.
PRESENT: Mayor Hilde, Councilmen Humphrey, litntz, Johnson and Kindseth,
Engineers Hagen and Bonestroo, Acting Clerk -Administrator Barnes.
ABSENT: None
R:ayor Hilde presented to Council a Resolution Opposing Takeover of Local
Assessing functions by the County of Hennepin which he had previously
presented at 4 Mayor's meeting.
MOTION was made by Mayor Hilde, second by Councilman Kindseth to adopt
RESOLUTION NO. 69-4330 A RESOLUTION OPPOSING TAKEOVER OF LOCAL A,1iSESS-
ING FUNCTIONS AY n1E COUNTY OF HMNEPIN. Notion passed by 5 aye roll
call vote.
WHERLAS, the Nayors Association of Hennepin County is favorably
diaposed to the probable intent of recent state enabling
legislation to provide .for improvad tax equalization and
will, in the near future, begin studies to provide a
sensible and workable solution; and
WHERLAS, the probable intent of the law was to permit the County
to perform the assessing function for smaller communities
which are not able to adequately perform the task; and,

would cause greater problems; and
WRERVIAS, homerule of local governments is a proven practical and
necessary part of good quality government; and
WHEREAS, the direct representation with a minimum of bureaucracy
is also essential to good quality government; and
WHEREAS, citizens are hest served by the most direct anti simple
type of governmental services; and
W1RN;F.DS, there are certain aspects of the proposal wlil.ch remove
the entire assessing function from local municipal gov-

in a most unsettling way all of the above tenants of
good government; and

authority is to give to Minneapolis, who being d. City
of the first class docs not itself fall under the purview

the 5 County Commissioners are elected either in whole
or in part by Minneapolis constituents);

1) that it hereby serves notice of its' most strong
opposition to the proposed takeover of our assessing
authority and responsibility by the Hennepin County
Assessor; and further,
2) that it is very concerned and questions the judge -
meat of the state Legislators who, despite the obvious
move to return moKe responsibility and power to 'Local
government, voted in favor of the enabling legislation
passed during the 1969 session of the Minnesota State
Legislature."

WHEREAS, good communications between the citizens of Plymouth and
their elected officials is essential for understandinR
Issues and problems, and
WHEREAS, poor communications in same instances have resulted in
misunderstanding, false rumors, frustration on the part
of citizens, Council and village staff, and
WHEREAS, this resultant turmoil has caused loss of council ind
staff efficiency, and
WHEREAS, it is our sincere desire to provide the mobs effective
and profesaional gloverament services pussible at the
leant expense to the taxpayer,
THEREFORE BE IT RF.SOLVL:D, that the Plymouth Village Council herehv
directs the Acting Clerk -Administrator and the Village
Engineer to develop an efficient mailing list procedure
whereby communications from the village council or staff
may be quickly and efficiently mailed to the "Ower and/or
Occupart" (no name necessary) of residences and bualn.sses
according to gtreeta within a designated area. '''$%is list
should also be used to send legal notices where vaquired.
The size of the area to which leRitl notice for changes in
zoning are sent should be increased from 2nn feet to 50O
feet. Further, that the rezoning notice shall include
language and terminology that may be eas:ly and readily
undurxtood by the general public.
Further, it shall henceforth be the poltcv of the village
counnil to either selectively or in mass mailings, which-
ever is deemed appropriate, routinely and autoelatically
serge to our citizens notices and memorandums toncerninR

A discussion vat held concerning a letter received from Attoroley Lefler RE: LEVER CASE
relating to a request for a $500 contribution as a nuisance payment to
close the Leaper at al. vs. Hampton Hills, Inc. litigation.
Councilman Hints said the village was completely exonerated and now we Amended 12/1/69
are being asked to donate $500 and we should take a stand and not buckle
under. Counc!tlmao Kindeeth said he did not think we should be involved
any further.

adopt RESOLUTION N0. 69-4350 A RESOLUTION THAT IN ORDER TO SAVE MONEY
AND TIME FOR THE VILLAGE THAT A PAYMENT OF $500 BE MADE IN ACCORDANCE
WITH ATTORNEY LEFLER'S LETTER OF NOVEMBER 1', 1969 RELATING TO THE
LEEPER ET AL6 VS. &%MPTON RILLS, INC. LITIGATION. Amendment was made
by Councilman Humphrey. second by Councilman Johnson to change the
amount to $300, tjmadment passed with 3 ayes, Councilmen Kindseth and
Hintz voted nay. Motion passed 3 aye roll call vote, Councilmen
Kindaath and Hints voted nay.
NOTION was made by Councilman Kindeath, second by Councilman Johnson to
adopt RESOLUTION NO. 69-436, A RESOLUTION TO SCHEDULE A PUBLIC HEARING
BEFORE THE PLANNING COMMISSION CONCERNING AN AMENDMENT TO SECTION 19
OF THE ZONING ORDINANCE RELATING TO THE BOARD OF ZONING ADJUSTMENTS AS
SOON AS POSSIBLE. Motion passed 5 aye roll call vote.
MOTION was made oy Councilman Johnson, second by Councilman Humphrey to
adopt RESOLUTION NO. 69437, A RESOLUTION APPROVING THE CHA4GE ORDER OF
PROJECT 49-160-7 FOR STREET SURFACING ON 6'TE AVE. AND UPLAND LANE EAST
OF VICf.SBURG LANE IN THE AMOUNT OF $8,301.50. Motion passed 5 aye roll
call vote.
MOTION was! made by Councilman Humphrevs second by Councilman Johnson to
adopt RESOLUTION NO. 69434, A RESCLUTION APPROVING THE CHANGE ORDER FOR
THE ELEVATED TANK TO INSTALL A 3011x60" HATCH TYPE DOOR IN 8' DRY RISER
IN LIEU OF V x7' DOOR TO ALLOW PROPER ALIGNMENT OF RISER RESULTING IN A
CREDIT OF $125.00. Motion passed 5 aye roll call vote.

Mayor Hilda stated that due to the experience we havae had in the past
year with the Southwest Improvement Progtam we should concentrate on
the degree of inspection, barricades and the aggravAting matters, how-
ever small, by providing as much area inspection that the Engineer and
two other people can give to establish better communications and coor-
d4.nation for a more finished and professional job. Engineer Hagen
feels that the problems experienced in the Southwest will be minimized
In the Central Plan because it will be installed in more or less open
country. '_Where will be less cause for harrassment due to streets
being torn .jp. etc.
Engineer llagen said that with the hiring of a part time Planner to take
over part of his workload in Planning and the hiring of an assistant
with temporary inspection help as well as assistance ,from,Bonestroo b
Associates'{he expects to be able to handle the proposed 1970 Construction
Prugram, provided the bonding is obtained. There is 411so the f.ct that a
Manager is -likely to be added to the village staff in 1970.

man Johnson said we are only a month away from the first of the year and
suggested the Engineer be directed to look for a draftsman to start after
January first. Mayor 11ilde asked the Engineer to submit a plan for
bringing revenue into his department.

revised report will be presented at a special count ll meating to be held

N., and Mr. Richard Lunde, 205 N. Trenton Lane. Motion passed S aye

MOTION was made by Councilman Hints, second by Councilman Johnson to
submit to Judge Douglas K. Amdahl of the 4th Judicial District Court
that Carl Hadaedy of 1120 Urbandale Lane, Wayzata, be appointed to
the Charter Comission. Motion passed 5 aye vote.

Mr. Kaman will Contact developers and send out notices regarding an-
forcement of the ordinance pertaining to land fill. Councilman Johnson
said there to a problem existing at 4th Ave. in Hawthorne Ponds. There
has been road work there and a certain citizen has complained of mis-
treatment by a builder working in this area. Councilman Johnson will
follow through on this problem.
PARKS: Councilman Hints said a committee is workinb on the hiring of
a Park Director. He is to make it: clear to the committee teat their

SCHOOL DISTRICTi Councilman Kindamth said theatre i'. -i a question abrt
snow removal on eAhool District 0281 property. There is not adequate
snow plow equipoont owned by thy Villagr. Mayor Hilda said we sihould
be concerned for the safety of children that walk to school. Hs, rec-

Councilman Ki.ndseth was present at the meeting held by citizens and
develooet of Sunny Acres 3rd Addition. They arrived at a plan
whereby it was dec:'.ded to sacrifice Lot ?Q for an entrance.
Councilman Ifintz told Council that the Chamber of Commer:e have their
books printed to be provided free of charge. He asked if Council
would maks: a donation to help defray exv)enses. Mayor ttildo suggested
