A regular meeting of the Village. Council of the
Minnesota was called to order bN Mayor Hilde at

Present: Mayor Hilde, Councilmen Rindseth, Johnson, Hints and
Humphrey; Administrator Splinter, Attorney Lefler,
Engineer Bonestroo,
Absent: None
Mayor Hilde read a letter entitled "Opiniatod Observations" by
Osborne Springsted to the citizens, so that they would be able
to better understand their government.
NOTION by Councilman Johnson, second by Councilman Humphrey, tf
approve the minutes of June , 1969 amending the word "suggested"
to "requester." in the middle of the second paragraph on page j.
Motion pawed by a five aye voce.
PUBLIC HEARING
Engineer Bonestroo presented his preliminary report concerning water
extension in Beacon Heights, Glen Echo Additions and Plymouth Or-
chards dated April 28, 1969. He explained his Proposal 01 at a
total cost of $36,330.100 and Proposal i2 at si total crist of $118,380.
The Public Hearing opened at 8:00 P.M„ Mr. Richard O'Fallon of
1-20 Oakview Lane North spoke before the Couacil and inquired
about the assessments which were not atated. He felt that should
there be a great variance in these chiirges, the citizens may not
want the service. The Engineer advisled that tho connection charge
would be $175 per .tor. Six inch piping is programmed for the area
with some eight inch averstaing required. Cost for these 8" pipes
mainly in the area of County Road 015 will tie absorbed by the devel-
oper of Gleanluch .Acres. There will be a cflarge to the homeowner
for a water meter and installation which will be about $70. The
meter will remain village property acid be maintained by the village.
Mr. Leonard Vertnik, 1225 Oakview Lane North - stated he was not sat-
isfied with the information given regardit%6 the quality of the water
In respect to it's hardness ,and Iron contamt and is the reason why
he did not sign a petitione tie feels that he might be spending
1,500 on poor walcer. Eugineer Bonestroo said the degree of hard
ness amounts to 12 to 15 grains, with only a trace of iron, and
that the MIP tower to supplied from the Jordan vein. It is our
intention to get service from the Shakopee vein, too, since 30 acres
of land has been selected for well site 02. Consideration should
also be given to fire insurance premium reduction when water is

Mr. Ted Wangensteen, Jr. 1035 Magnolia Lane North - state 1 no one
on Magnolia was approached to sign r. petition, This is a street
ending with a cul-de-eac and Iota varyifrom 50' to 2009. 6 wished
to go on record as opposing water on M4 8nolia Lane and assessments
on anything other than on a lot or unitl basis.

from th71r are& and asked if a decision would be made tonight. Hr.
O'Pallem stated he did not get to all t e residenta in the area to
sign a petition because it appeared so solid and posltl%,,' eveity-

No one further appeared, and the Public Hearing closed at 8:15 P.N.
MWION by Councilman Humphrey, second by Councilman Johnson, to
approve Proposal /1 covering 15th Avenue to Oakviev Lano and 11th
Avenue to Pineview inasmuch as the other areas did not seem to want

Mayor Hilda asked if the Oakview area is trepresentative of all the
others whereas many are interested in uator but do not want to
assume the financial responsibility of it. Also, hip said that due
to the cost advantage if we do the whole project now, the aitisans

MOTION by Councilman Hints, set.ond by Councilman Johnsenf to approve
Engineer's proposal 02 to supply water to lWacot, Heights and Clen
Eche.
Councilman Johnson said the park charge nhould be assumed by the
village and asked why 8" piping was noceseary in some areas. The
Engineer said that 8" pipes „ere necessary 1.* the overall improve-
ment plan because oversising is necessary in case of fire as a
greater flow of water can be supplied. Anseosmert charges in re-
lation to parka, deleted lute and 8" pipes will set a precedent so
Mayor Hilde stated the staff should be 4irected to prepare recomm-
endations based on sound logic and history and how other jurisdictions
are doing it. Councilman Johnoon withdrew his second and Councilman
Hints withdrew his motion. Mayor llilde asked the Engineev if it was
necessary to make an immediate decision. He replied that it should
be Stade within 7 to 3 weeks. A cop; of a repwrt will be available
the Thuruday preceding the July 7th, Council maeting and this subject
to be dei:ided on at the July 7th meeting.

Administrator Splinter cited various problems regarding the keeping, of
hoofed animals in residential areas. Categorically they are as follws:
1) horse back riding on boulevards and right of ways, (2) loose assimals,
3) keeping horaPs in confined areas with a number of homes nearby with
unsanitary conditions, smell.and keeping them In areat too small. Most
complaints received by the village were generally regarding the Ridge -
mount area towards County Road #15 and Vicksburg near Waysate High
School. These problems are difficult ones to deal with and the Council
will attempt to control the abuses here.
Attorney Lefler explain ed contents of the proposed ordinance. Council-
man Humphrey commended the Plymouth Livestock Association for making a
star! in solving the problems.
The public hearing opeved at 8:45 r.M.
Mr. Howard Hcmt of Hamel, representing the nev Plymouth Horse Owner's
Club, stated that Dr. C. D. Adtk,ins gave the Council a letter regarding
their %trganiaation, their rules,, their purpose, their membership and it
was brought out that they intend to police their own club moberA. Mr.
Hunt display<_i a color coded map, vhtch they will use with appointed
individuals *esponstble for certain designated areas, to handle comp-
laints received from that particular area. They propose to establish
an educational rrogram to teach respect for property and gardens,
riding etiquette, safety precautions and cooperation with non -horse
owners. They will work towards establishing trails and riding areas.
Councilman Hints rerArked abort horse riders cominR into Plymouth from
an outlying district, namely, Minnetonka. Mr. Hunt said they are
working presently with a Minnetonka hcrse group.
Mr. Ronald Milbrath, 4305 W. Medicine Lake Drive, said that the R.dge-
mount area and horses from M`.nnetonka are creating the nuisance. Mayor
Hilde apked if he had any success since discussing this problem with
him I-rA t and he said a problem created by a girl tiding on the boulevard
was handled by the police, but thought the problems could be solved by
priople themselves. Mr. Hun: n. -id the Association, would be able to hnodle
a complaint if the name of the person creating the problem is supplied.
Mr. and Mr::. Mel Boettcher, 11616 Ridgemount, solid he fusels there is no
legal police action. His children refuse to play in their backyard be-
cause of the bad smell there from neighboring horses. He supports the
ordinance proposed, with gorses allowed where there is adequate acreage,
not like his problem of hiving the nuisance 15 feet from his windows and
the smell avO odor due to liquid waste not controlled, drawing rate and
flies. Mrs. Boet'cher feels jomething should be done regarding sanitary
conditions.

Mr. Claude Lien, 5125 Pineviev Lane, said this is not a new problem.
He feels the present ordinance should be sufficient and sees no need
for another ones
Mrs. Jane Horstmen. 15325 County Rood 47, Hamel, said the guilty ones
should be peralised, not the others.
Mr. its Hart, 4725 Vicksburg Lane, is in sympathy with people having
trouble wish horses on their property. Peels we have a lav covering
these nuit,ances and said the Minnetonka people, are creating problems
and act gstting punished at all.
Beryl Halldorson, 5703 Dunkirk Lane, Nemal, feels it unjust to punish
all the people, some other means should be used to tate care of the
situation.

E. J. Petechl, 128118 16th Ave. V.. said during the last 30 years he
has owned horses and did not have as much trouble with the% its the
ouncil Rives him. (He later apoligised for this remark) He sees
no reason why he should be ppmished by what sows others have doata.
Mr. Len Vertnik, 1225 Oakview Lane N. is not against the people and
said maybe there to a.,ma way of identifying the horses; with licenses
stallar to dog licenses.
Mrs. J. A. Poole, 100 Kingsview Lane N., Requested to hear the ordinance
pertaining to manure. Attorney Lefler read fres Sec tion 3. .402 of
the Code. She asked `chat to considered to be accumulation and the
Attorney told her it depends upon the case being prosecuted and degree
of offense to that person cow#laining. She asked if she would have to
file and sign a co ipla-lit against a neighbor. The Attorney said a
p.161ce officer could uu.ke a pr jonal observation, but if you are not
willing to come forward and Must the degree of offense, they cannot
do such. The police are hPl.pleas if no one comes forward with a tonal
complaint. She thought the restriction should be sufficient in order
not to make trouble with neighbors.
Mrs. Boettcher said they have a neighbor who has made no attempt to
clean up and asked what can be done. Mayor Hilde asked why we cannot
help them out with their problem. Even if the manure was cleaned up,
the nuisance. to be completely eliminated, oould have to be done by
eliminating the horses.
Mrs. Ruchols, 11201 Ridgemount, stated she is the neighbor of Boettcher's
and has never received anyy notice of the condition complained about.
She feels they should have received some communication. at least by
phone6 about the odor so it could have been corrected. They live In
Minnetonka and were not swa:e of this meeting. They never reeeivod any
contact either about their daughter.

Mr. rassler is for an orituance regarding the building of stables and
keeping of horses. TIvr Attorney said there is no ordinacce for the
keeping of horses, beet building of stables is covered in the R-1 Zoning
Ordinance. Mr.Fasn ler asked what the Inspector is doing about violations.
The Attorney said the ordinance was adopted in May, 1968 and any barns
built prion to Chit date are allowed to remain. Mr. Paseler said 3 or 4
horses with girli riding them wrecked his garden.
Mfrs. Donna We..+..9: ,:rand .said that in answer to Mr. Faseler's complaint he
should take his complaint up with his granddaughter.
Mr. Hunt said it is tiring when people say they do not want to get
Involved" when turning in a complaint. They should back up the police
department so they can go into court. If they do not nigh. they don't
have the "guts" to -to anything. yr. Boettcher wondered how many were
objecting to the ordinance who did not live in a R-1 none.
The public hearing closed at 9;40 P.M.
Councilman Humphrey pointed out that this was a big problesa and it was
a good thing to be brought out into the open. For one thing it has
brought together a group of people into forming aw association in a
very short time, Maybe soma hoses, where there is a big problem now
could be moved to another area.
Councilman Johnson felt the main problem is no: with the horses, but
with the people riding them. He suggested licensing riders for two
reasons; (1) The Association would have some control by a membership
list. (2) There would be a source of knowing who a guilty party is
when checking their license. As to how to clean up the area around a
horse. probably the Association could, through a committee, with a
report on barn conditions, direct enough pressure on menbers andif a
complaint coma into the police department, advise the Avc,ociation to
resolve the problem. If they do not, the jxwlice departaint can take
it from there.
Mayor Hilda said they met with the horse Owner's Association about a
month or so ago and these was a discussion along those linea. The
discussion was on what the problems were going to be and asked too
If it waan't the idea that if the police received a complaint they
would go to the Association before acting on it. Mr. Ron Mil raith.
President of the Association. said yes and people have been assigned
to certain areas to receive these complaints and take action.
Coun cUman Kindseth sympathized with people having problems, but at
the same time we have ordinances and they are plain and simple violations
not taken care of. To have a horse in the backyard is a rapidly growing
trend and he flaked why there uiouldn't be restricted trails where these
horses can be rode. An ordinance can further protect the horse owner
and non -horse owner. He feels the ordinance can be drafted with stable
construction according to BuilAng Code. type of fencing, number of
horses per acre and night rtdtnp restriction. Golden Valley has a trail
to Clara City and a noth-ar one eloewhere goes to LeSeuer. He feels we
should not act too hastily on thio subject.
Councilman Hintz said some people cant an ordinance covering the sant-
tation problem. Our present ordinAnce divas protect the person so con -

corned. but as Attornsy'Lefler stated this has failed. Riding seems
to be a main problem. there are, nonew shoulders on Ridgevount
causing riders to go auto boulevards. It we recommended the Horse
Owner's Ameoeiatlan p04ee the area and educate the riders.

A discussion followed c;oncorning staff personnel to enforce our
ordinances, fines, posting of signs, effectiveness of the Horse Owner's
Association, citIzens %ho are faced with an extremely aggravating situ-
ation and horses coming into Plymomth from outlying sroas.
NDTTOH by Councilman 1uwphroy, second by Councilman Johnson that (1) As
far as any new ordins ce.is concerned. we postpone any action for six
months from'today. ( camber 16th), (2) That the Horse Owner's Association
camcoback within th six month period in relation to the subject. of
licensing, (3) That'we give this Association this six iMnth period to get
themselves better orguni:ed and get some of the problems they mentioned
resolved, (4) Tha the people who have real complaints, bring thou to the
attention of the tillage and direct the Council along with this, that the
Village staff. Ift'luding the police, do everything to see that these
offenders bo prosecuted, with it firut being brought to the attention of
the Horse Owner's Association and if not taken care of by then. to be
taken care of by the Village, Motion pasoed 5 aye vote.
MOTION by Covmzilman JohnNon, second by CoungAtman Hint: to amend and
add to the ;ortt&n of our ordinance pertainin* to sanitation and clean-
liness also an ordinance reRardtng loose horses and trespassing, Mayor
Hilda, second by Councilman HuENhrey, made an amendment to the above
motion to direct the Attorney to draw up said ordinance within the next
six months. Amendment passed S aye vote and main motion passed S aye
vote.
Administratur Splinter will instruct the staff to pror.ecute he Boettcher
complaint to the full limits of the ordinance and proceed with every
effort to test it. This was referred previously to the Assoclotion.
Len Swedlund appeared before the Council regarding his request for final
plat approval. Council discussed the park proposal, bond anjunt, road
completion, paving. curbs and gutter. The EnRtneer agreed to advise
Nr. Swedlund between August 15th and September let if the roads cannot
be completed by this fall. so Mr. Swedlund can be released from the
contract and do the job himself.

Mr. Kenneth Schisbe and his attorney. Tom Dohertym appeared bsfore the
Cowell relardi.og his rezoning request from 14 to Do -2 for a shopping
center efts at County Ro&A 0101 and 06. Administrator SrIlnter Xave a
report on Plot Plan A. The plan presentad by Mr. Wierty was a re -
vista plan wi.h their desired buildings for commercial development. He
acted then was not much elact that could be said that had not been
said before.
Councilman Johnsov said the Council has attempted to layout a Plan which
would 4e becefi.tlal to the Village at 0101 and 06 with discussions with
our Plaarner for the best layout of this particular sitar, which also has
been gow over thoroughly by our Planning Commission and our Plan A is

Mr. Mattin Hichatski, 1020 Evergreen Lane N., stated before the Council
that the 1.1 acre of 14%d that Dr. J. Hunder asked be rezoned from
R-1 to 8-1 was zoned raoldential when developed with studies by the
Plantar and a new comprehensive zoning ordinance established, agreeing
that this area be residevtial. He asked why, after all this research.
did the Council decide to mace this acre corwrcial. Many people
purchased homes feeling this would always bo residential and this
action allowing rezoning tv not according to the ordinance. 50 reai-
dernts signed a petition opp ising it. Now they nottead at the Arvi.1 30th
planning Commission meeting this request was 4ented. The hi-gh elevation
for screening was not of, con%\ern. but traffic and spot zoning was. He
does not feel Mr. Samuelson V.19 qualitied to sav there would not be a
traffic problem created tl tre. He requested the Council rescind their
action taken at the Jima 2nd council meeting to approve the rezoning
request.
