MOTION by Councilman Humphrey, secrad by Councilman Johnson, to adopt as an assessment policy the equal division of assessable cost among the Lots in a subdivision when it is -ander a si.ngle ownership. MOTION by Councilman Humphrey, second by Councilman 1Iintz, to adopt RESOLUTION N0. 69-849 A RESOLUTION AUTHORIZINU A PRELIMINARY REPORT ON THE FINAL GRADES OF 6TH, VH, b 10TH AVENUES AND NATHAN LANE IN THE AREA OF COUNTY ROAD #18 AND HIGHWAY #55. Motion passed Sy a four aye vote. Discussion on this motion followed and the Administrator requested a review meeting to pick up all these loose ends on projects that we have made final decisions on. Administrator Splinter suggested that possibly May Sth would be a good time and the council agreed. The Mayor and Council had the letter from Mr. ('erald and the letter from the Poi:^e Department. Attorney Lefler reviewed what Ordinances were violated and why the Ordinances were needed. This alas a viola- tion of zoning of parking a vehicle over 4.5 ton weight on his prop- erty. Mayor Hilde reminded the councilmen that at the time of the passage of the Ordinance there was a lot of discussion ref!arding the weight or limit to be placed in :his Ordinance; what size limit to put on a vehicle of this type. Mr. Gerald spoke in his own behalf. Attorney Lefler stated that the Or,iinance prohibits the parking of these vehicles in all residential areas except in an R -O district. Mayor Ililde stated that there being no intention on the part of the council to move action to change the Ordinance or grant a waiver to this individual, the situation will have to stand as it is. Discussion was held on the matter of blacktopping of Holly Lane and the Administrator stated that this was a recurring problem in this area. There is a golf course, Hollydsle, located here and Engineer Olson told about Rome of the history of this particular toad. The people in the area too); it upon themselves to put a seal coat and as predicted it did not hold up. The Administrator recommended no beer license because of the vicinity to the park. The Council concurred with the Administrator's recomm- endation for denial on the 3.2 bee:: license. MOTION by Councilman Johnson, second by Councilman Hinta, to adopt RESOLUTION NO. 69-86, A RESOLUTION STATING: (1) THAT WE DENY THE REZONING REQUEST AS REQUESTED FOR #6 AND 11101. (2) DIRECT THE PLANNING Ct)MSSION TO CONTINUE TO STUDY THE ENTIRE: PLAN AS DEVEL- OPED BY THE PLANNFR WITH TIIE OBJECTIVE BEING TO INCORPORATE IT INTO THE COMPREHENSIVE GUIDE PIAN. Mr. I)nle Peterson, 402 P11grim lane appeared with the petition which was acknowledged by Mayor llilde, who invited Mr. Peterson and members of the Homeowner's Association to come back on April 14th so that he ecald make his presentotion when the subject was due for detriled discussion. Engineer Bonestroo was out of town and he could not find this report so he recommended that this item he put on the Zouneil Agenda for April 219t.
