PLYMOUTH, MINNESOTA
August 7, 1967

A rogular meetirgof the Village Council was called to order by Acting
Mayor Richard O'Fallon at 7:30 p.m.
Present: Aetia; Mayor O'Fallon, Councilmen Hagen and Hunt, tho Village
Administrator, Attorney and Engineer.
Absent: Mayor Staples and Councilman Duntley.
Acting kiWor O';i?allon requested the Council and audience to rise for a
moment of silenuo prayer.

LOTION by Councilman Hunt, second by Acting.hayor O'Fallon, to approve
the minutes of the regular mostiufi-of July 17, 1967* kozion passed by a
three aye vote. Mayor Staples and Councilman Duntley absent*
kOTION by Councilman Hagen, second by Councilman Hunt, to approve the
minutes of the special meeting of July 24, 1967. Motion passed by a
three aye vote. Mayor Staples and Councilmen Duntley absent.
PUBLIC HFARING
Acting Mayor 0' Fallon opened a Pablie Hearing to consider the extension RE: INPR. OF 13TH
of 13th Avenue forth from Cowity Road 18 to South Shore Drive and the AVE. & SAN. SEWER
installation of sanitary sewer in said road. The Village Engineer THEREIN
reported that *'yin street improvement would consist of excavation, cub -
base, base, curt and gutter and a plant mix surface, all of which are
equal to a nine ton road, 44 feet from face to face of curb, at an
estimated coat of =63000. Acting kayor O'Fallon opened the hearing to
questions and comments from the floor and the following appeared:
Vic aruuan. J. Oruma.?k Steel Co. - Wanted to know which cost for
newer would apply, the $22,000 or the $35,000 figure which
appearec, in the preliminary report.
The Engineer informed him that the cost would be $22,000 for the sanitary
sewer and $631000 for the road for a total cost of =35,000, which would
provide a shallow sanitary sewer to provide first floor drainage. Dir.
Gruman stated tt.at first floor never service would be epAisfaetory.
Acting Nayor O'lallon declared the hearing closed at 8:00 p.me and due
to the lack of a, four-fifths majority of the Council prsoont, no action
could be taken to order the improvement. The Engineer requested Council
approval to have a Registered Land Survey done on this property.
MOTION by Councilman Hunt, second by Councilman Hagen, to authorise RE: AUTH. ENO. TO
the Village Engiieer to hire a Registered Land Surveyor to do a survey HIRE REUt LAND
of the property ;nvolved in the improvement of 13Th Avenue North. Motion SURVEYOR
passed by a throo aye vote. Xayor Staples and Councilman Duntl4y absent.
Acting Nayor O'F:,llon opened a Publtki Hearing to consider the vacation
of a portion of lerkshire Lane and South Street beginning at the inter-
section of Berkshire Lane with the South right-of-wey line of tho
Minneapolis Industrial Ruilway, thonoo Northerly to the intersection of
Berkshire Lane ant South Street, th4noe easterly approximately 250 fent
to the point of ittersection with the proposed new Zinnia Lane. Northern

RESOLUTION N0. 67-137, A RESOLUTION VACATING PORTIONS OF BERKSHIRE LANE
AND SOUTH STREET as described in the resolution. Notion passed by a

KOTION by Councilman Huit, second by Councilman Hagen, to direct the
Clerk -Administrator to vtithhold the filing of the resolution until they
agreement has been executed for the provision of the temporary road and
the road is constructed. motion passed by a three aye vote. Mayor

PETITIONS, REQUESTS & CCOUNICATIONS
William Dickey appeared Yo request finai approval of the plat of Plymouth
Square. The Engineer re-riewed the plat and stated that he would have to
compute the bund requirements and draw up the subdivision development
contract before the finai, plat could be filed but he did recommend
approval of the plat.

dell Addition. The Administrator stated that he had not received a
recommendation from the Er„gineer as yet and requested that this be put
on the August '4th aenda.
Roy Klausman requested a subdivision waiver on Lots 12 thru 16, Blook 4o
Klaustan's Addition. Coun,3ilman Hunt stated that he fait that this wF43
a reasonable request due to the site of thews lots.

Ernest Snyder requested a subdivision waiver on Parcel 351•, in Scetion
30. Thia would move the two property linea and allow a future easement
for the extension of Shadyview Lane.

Ray Johnson appeared to request a 8-1/2foot sideline waiver for an
attached garage at 325 Maga Lane+. H, presented a letter from the
neighbor at 31.5 Niagara Lane stating that he had no objections to the
requested waiver.
MOTION by Councilman Hunt, second by Councilman Hagen, to approve the
t3-1/2 foot sideline waiver for an attaphed garage at 325 Niagara Lane.
Motion passed by a three aye vote. XFWor Staples and Councilman Duntley
atasent.
Tri-State Drilling requested a parmit to construct a warehouse -n their
property at 16940 State Highway 55. They also requested 6—rmission to
construct an;ei,ght foot cedar fetee along the property lines abutting
Sate Highway 55. The Building Inspector report-.', that some time ago,
Tri-State Drilling had stated that they would }-i.wt a hedge •to shield
the parking lot, however, the hedge is not growing. The Council
questioned whether an eight foot fence would be high enough to shield
the rear parking lot. It was unanimously &greet to postpom this
request until August 14th when the Building Inspector and Engineer could
determine how high the fence should be.
REPORTS OF OFFICERS, HOARDS & CaWTTLES
Attorney's report received on three awu%d in Condemnation Nov, 560 for
sanitary sewer easements. The Attorney stated that he felt that three
of the awards were extravagant enough to warrant appeal and requested
authorisation from the Council to appoal awards on Percele No. 61 12
and 40.
NOTION by Councilman Hunt, second by Acting Mayor Olftllon, to adopt
RESOLUTION NO. 67-1211 A RESOLUTION AUTHORIZING THE VILLAGE 0TORNEY
TO APPEAL CERTAIN AWARDS IN C(NDEMNATION N0. 560 and obtain appraisals
to determine the values of the awards. Motion passed by a three aye

toga Lanea. He stated that the only temporary solution avail%ble is the
installation of eight inch drain the all the way across quaker Lane at
a total cost estimate of $1500 with the use of Village crews and equipment*
Dennis l,ongren appeared and stated that he felt that the people in the area
would be in favor of this solution.

The Building Jnspector reported that a building permit had oxen applied
fax to construct a shelter building at the P13 mouth Park and requested
that the $15 building permit fee be waived,
kOTION by Councilman Hunt, second by CouncilLuut Hagen, to waive the $15
building permit fee for the shelter building in Plymouth Park. Kotion
passed by a twee We vote. Mayor Staples and Councilman Huntley absent.
The Building Inspector reported that the Village is still using the 1961
Uniform Building Cods and in view of new and different methods of con-
struction, requested the Council to adopt the 196'! Uniform Building
Code. The Attorney suggested that the Building Inspector and Building
Codes Advisory Committee go through,Chapterm 2, 3 and 6 of the Ordinance
Code which adopts and amends the 1961 Uniform Building Code and stated
that if the Village is to adopi thea 1967 Code, it will be necessary to
adopt an ordinance to amend the Village Code.
Building Inspector's report received on storm d muted cabin owned by
krs. D. Soderberg, and located at 9615 - 18th Avenue North. He presented
pictures taken of the structure and stated that in his opinion it is
unrepairable and more than 50 demolished. He recommexded that the
Council take action to condemn this structure. The Attorney requested
that the Building Inspector ev.Lmit a written report listing all the
damages. Acting Mayor Olftllun 14ugg+erted that the Building Inspector
compile a report on all properties within the Village to be condemned
sand report back to the Cc•ancil.
Building Inspector's report received on "privy study" as requested by
the Council.
Engineer's report received on `yid opening for the Juneau Lane Seal
Coating Project. He stated that the estimated cost of the project was
1,600 and recommended acceptance of the low bid of Armor4oat Company,
Ina., in the amount of =1681.00.
MOTIJN by Councilman Hunt, second by Counoil,man Hagen, to adopt
RESOLLTION N0. 67-123, A RESOLUTION AWARDING BID FOR JUNEAU WTE SEAL
COATING PROJECT to Armor -Coat Comparyr, Inc., of St. Paul, for a total
bid of =1,581.00. Motion passed by a three aye vote. k ayor Staples
and Councilman Duntley absent.

renewal of Cesspool Pumping Licenses for Armstrong Cesspool, Osseo, and

that they are very concerned about the darn propoe#d to bo built on Rice
Lake as drainage in the northwestorn portion of the Village is very

LOTION by Councilman Hagen, second by Councilman Hunt, to appoint Bonnit
Krone as Police Secretary starting August 9, 1967, at a salary of $300
per month with an increase to $320 on January 11 1968. kotion pswW by
