Staples, Jr. at 7:30 p.m. Present: Mayor Staples, Trustees Duntley and Hunt, the Village Administrator, Attorney and Engineer, Trustee Hagen arrived at EL00 p.m. Absent; Trustee O'Fallon. Invocation was given by Father Louis of St. Mary's of the Laic Catholic hunch. MOTION by Trustee Hunt, second by kayor Staples, to approve the minutes of the regular meeting of June 51 1967. Motion passed by a three aye vote. Trustees O'Fallon and Hagen abeenv. MOTInN by Trustee Runt, second by Trustee Duntley, to approre the minutes of the regular meeting kf June 12, 1967. FUBLIC HEARINGS Mayor Staples opened a Public Hearing to consider the basswork and sur- facing of Foreetvi m Lane from Ridgemount Avenue to County Road 15. Mayor Staples sta%.sd that the original improvement of this road in 1961 was ordered and made prior to the present Ceuneil ant.'. Village Engineer. Unfortunately, the people who have just paid for this improvement did not get what they paid for and the Council is aware rf this, however, the Council, visited t&'s site about a month ago and came to the conclusion that this read does need improvement. Mayor Staples intrarlueed the Villabv Engineer, Otte Bonestroo, who reported that upon investigation they had found that for most parts of the road there is very little if any base under the road and this is the reason that it is breaking up. They propose to take the existing mat and pulverise it and use it as a base to construct a seven ton road with an ultimate of nine tons. The total cost is estimated to be $11000 and with approximately 4,150 assessable flet, the cost per foot would be $2.80. Following the Engineer's presentation, members of the public present were invited to ask questions and make such comments aa they might have. The following appeared& Russell W. Falletad, 330 Forestview Lane - questioned method of assessment, supervision of construction and why the original improvement did not stand up. He stated that he thought the road must be repaired but he can see no reason w1W the resiClents should be assessel for it. Benodict i4nasso, 404 Forestview - stated that he felt that the trucks used in the construction of Ridgesmount Avenue had broken up the 141acktop on Forestview. William Duenow, 18 Forestview - felt that the assessment for the improvement should be spread over the entire Village because of the church sod school traffic on this road. Father Louis, St. Mary's of the Lake Church - questioned if this was to be the last public hearit.g on this matter. Chuck Dahlens, 400 Forestview - proposed that the Counoil see this as a maintenance problem rather than an assessable improvement project. He was informed that this road wili have to be comma pletely rebuilt. Mayor Staples poled the audience and it was the general agreement of those present at the hearing that -..hay would like to ase the road im- proved but they aro u.1certain as to the method of paying for this improvement. There being no ft"ther responses to call, Mayor Staples declared the Hearing closed at 9130 p.m. Trustee Hunt stated that he did not fool that the Village could pick up 100% of the assessment but he felt that we could finance some portion of it. It wax unanimously Wood to hold an informal hearing at Ste kary's of the Lake Church to try to determine what agreement can be reached. Mayor Staples opened a Public Hearing to consider the grading, basswork, surfacing and curb and gutter f;r 25th Avenue North from Magnolia Lane wset`'lto vacated Pineview Lane. The Engineer reported that this project includes excavation, fill, Class 5 gravel, surmountable curb and guttprg a two inch plant mix surface and two culverts for a total cost of x19 0. Only a portion of the corner lots would be assessed, therefore,, the assessment would be =9.50 per assessable foot. Following the Engineer's presentation, members of the public present were invited to ask questions and make such comments as they might have. The following appearod: Wayne Quast, 12410 - 25th Avenue North - stated that there are only two homes that use this road at the present and he would suWat that this roPA improvement be delayed until the housas are built so that the road will not be broken up by heavy trucks during; the construction of the homes and Storm sewer in the area. He suggested that a gravel base be installed. 'rhe Engi:fier stated that it would be feasible to eliminate the curb and gutter and mat and the project cost would be reduced to approximately 35.00 per assessable foot. Herb Swanson, 12435 - 25th Avenue North - stated he was very much in favor of a gravel road and felt this would be of great benefit to persons living on this road. Gerald Eraser, Elmhurst Realty - stated that he had petitio ted for this .improvement and would be in favor of the gravel road. Jon Parker, 2505 Magnolia Lane - stated he would be ir, favor of a gravbl road. He owns a corner lot and wanted to know how tuis would be assessed. The Engineer stated that he would be assessed for ot;:y 90 feet on 25th Avenue. MOTION by Mayor Staples, second by Trustee Hagan, to adopt RESOLUTION N0. 67489 A RESOLUTION ORDERING IMPROVEKXKT AND PREPARATION OF PUNS for the inetallatioc of sanitary sewer in Orleans Lane from 26th Avenue North to 26th Avesue North. Motion posed by a four eye vote. Trustee O'Fallon absent. I Mayor Staples opened a Public Hearing to consider the installation of sanitary sewer in County Road 15 from Lanewood Lane to Juneau Lane and Kingsview Lane from County Road 15 to Niagara Lane, The Engineer reported that this project includes sanitary sewer laterals, servicer, lift station and force main, and road resurfacing for a total of 847000. The lift station and force main would be deducted from the assessable cost for a total of 831,200 with approximately $115CO assessed against each lot. Following the Enginoe rla presentation, members of the public present were invited to ask questions and make such comments as they might have. The following appeared: Philip Halbert, 14815 County Road 15 - objected to the fact that they were; left out of the original srwnitary sewer project in which the assessments were $7 or 88 a foot, and stated that he was definitely ag=ainst the project at the proposed assessment figure. John Ye, 85 Kingsview Lane - apposed to the project. Russell Hauser, 14716 County toad 15 - in favor of the projects Richard Rohl, 14709 County Road 15 - stated that he feels that they need sanitary sewer in this area but he would like the Engineer to review his esti:.wte to tree if it would be possible to reduce the cost. Dennis Heinsen, 70 Kingsview Lane - wants sanitary sewer but not at this cost. William Kelley 14804 County Ro&A 15 - wants sanitary sewer but not at this coat. 2wr RE: INSTALLATION OF SAN. It was unanimously agreed that argr decision on this project be por+ponnd until word is received from Minnetonka whethor they are interested .in partiel gating in the project and from Golden Valley whether they will allow us to serve with sanitary sewer five additional lots in the Village of Minnetonka,. This would reduce the cost on a front foot basis approximately 20%o There being no further response to call, Mayor Staples declared the Hearing closed at 10,35 p.m. Mayor Staples opened a Public Houring to consider the installation of sanitary sewer in Lots 1, 2, 12 and 13, black ?, and Lots 1, 2 and 3t. The Engineer was directed to investigate this and report back to the Council on his findings.
