HomeMy WebLinkAboutCity Council Resolution 1970-433EXTRACT OF MINUTES OF MEETING OF VILLAGE COUNCIL OF PLYMOUTH, MINNESOTA Pursuant to due call and notice thereof, a special meeting of the Village Council of the Village of Plymouth was held on the 8th day of October, 1970, commencing at 7:30 P.M. at the Beacon Heights Elementary School, 12315 Highway #55, Minneapolis, Minnesota. The following members were present: Councilmen Johnson, Hintz, Kindseth and Spaeth. The following member was absent: Mayor Hilde. Councilman Hintz introduced the following Resolution and moved its adoption: RESOLUTION NO.70-433 (Levy #5094)— A RESOLUTION CONFIRMING AND ADOPTING THE ASSESSMENT FOR NORTHWEST INTERCEPTOR. PROJECT #68-1B WHEREAS, pursuant to due and proper notice according to law an assessment hearing was held on the 8th day of October, 1970, relating to Northwest Interceptor, Project #68-1B . and WHEREAS, all persons present desiring to be heard were heard and their objections, if any, were noted, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH, MINNESOTA, AS FOLLOWS: "1. The Village Clerk has, with the assistance of Bonestroo, Anderlik, Rosene & Associates, Engineers heretofore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for Northwest Interceptor, Proj. #68 -IB , against every assessable lot, piece or parcel of land, in accordance with the provisions of law, and has prepared and filed in his office tabulated 'statements in duplicate showing the'proper description of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against the same, 2. Notice has been duly .published as required by law that this Council would meet in special session at this time and place to pass on the proposed assessment. 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and 5 objections have been filed. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially benefitted by the construction of Northwest Interceptor in the amount in said proposed assessment set opposite, the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. 5. Such proposed assessment is affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land - respectively. 6. Said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessment for Northwest Interceptor Project 068-1B. 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of 82 per annum. 8. Such assessments shall be payable in 30 equal annual Installments payable on the first day of January in each year, beginning in the year 1971, and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectable during said year by the County Auditor. To the first installment shall be added Interest on the entire assessment from the date hereof to December 31, 1970. To each subsequent installment shall be added interest for one year on all unpaid installments. 9. The Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon the ' first day of January in each year."
