Pursuant to due call and notice thereof a Special Keetirv; of tno `.'i Hage
Council of the ViliaZe of Plymuuth, Minnegota, was duly held at the Village Hall on
the 23rd day of Uecenber, 1964s at, 7:30 o'clock `. N.
Present; Mayor Staples, Trustees Curtis, O'Fallon, and Clifford, the
Village Clerk and Attorney. Absent: Trustee Humphrey.
Ylayor Staples called the meeting to order.
The meeting was called for the purpose of taking action against dill E.
Townsend, dba Fledici:ie Inn, 2106 Fast lb.edicine Lake oulevard, for jervirtgy and selling
3.2 beer to minors in violation of Ordinance No. 60-12, Sect. 3.04.
Present at the hearinwere 6111 E. roosend, proprietor of the eCvstablishment,

purchased and were served the beer.
The said violation tock place on October 14, 1964 at 11135 o'clock P. R.
The girls admitted that they had been in the Fiedicine Iran ei-ioral t.Laes and
had been served, artd also, in oth& taverns Li the Village of Plymouth in which they
were served beer. Fir. Townsend admitted that he was negligent in chacknM the girls'
ages and }.he one ID card that was presentea by them; the t; iris in al:. ,instances had
stated that they were 22 years of age, and Kr. Townsend stated that they could be
taken for that age or older. He stated that he had not had a great deal of exper-
ience in operating an a stablishren-4 of this type but that he has attempted to apide
by the Villaolre regulations and conduct an orderly business, which Chief Lien stated
he would confirm, and that he had not had any problems arising; from tate place of
business.
On the evening of the offense, Officer Osier went in the tavern and asked
sir. Townsend how old the two girls wertr and hc.; Stated that they were 22 years of age,
after which Officer Osier asked the girls to come out to the car where hf questioned
them. Neither had any iaeans of identification or driver's License as evidence of
their age. Mr. rownsend stated he had questioned the t,irls previously at another
time, when they stated they were 22 year -s of age, and he felt this to be the truth.
Harry Stafford, on behalf of Mur. Townseald, stated that he works at the
premises daily and that he had never seen the L,irls ire there at any time and that
they have not been bothered by an y juveniles attempting; to make purchases of beer.
Mr. and Mrs. Devens also testified that they have frequented Air. T ownsend's estab-
lishment gi1te often turd that it was patronised mostly by elderly people and they
have known a. no juvellile problems.
Trustee Curtis stated teat he felt that Er. Townsend was inexperienced in
handling; a business of this nature and also it appears that other taverns have been
negligent in checkirk, and obtainink information cn minors that have been served.
Considerable discussion ensued after which the follcwing motion 'As presented.
Motion made by Mayor Staples that the On and Off -Sale null, Liquor license
i,oaued to dill 1::. Townsend, dba Medicine Inn, 2416 Fo. t, Medieinu Lake kulevard, be
suspended for twenty days affective at 8:00 A. M., Uecember 24, 1964. Trustee
Clifford moved that the furoa ,niN; motion Tae ;ar tended acid that thR suspension of the

Trustee OfFallon stal.dd that the suspension of thu licw-tsu for a six-month
period would be thu s=,i as a perinanunt, revocation as it would put the man out of
business; he also stated that Mr. Townsend Should not bo charted for the presence of
beer bans alorgt road ditches as he is not rospunsible for this situation any mora than
any Wier operator. Ho furthe. stated that the Polico Uervirtman't. c onfirtnod that Mr.

Trustee Curtin also . tat ad that hu felt ho could not vot -i in Moor of a

by Mr. Townsend,, dba ,edicine Inn,, 2416 East Medicine Lake Boulevard, be sus-
pended for 20 days cormencinS at 8:00 A. 1`1., December 24, .1964. to 8:GD A. }:.,
January 1.3, 1965. notion seconded by Trustee Curtis and the followint; voting
in favor thereof: Mayor Staples, Trustees Curti, and O'Fallon. Opposed:
Trustee Clii'ford, fcr the reason he felt -the time o suspension was too short.
Absent: Tnistee Humphrey. Notion carried.
On motion the meeting; adjourned at 9:45 o'clock P. N.
