HomeMy WebLinkAboutCity Council Minutes 08-14-1963 SpecialAugust 14, 1963 Village Co� due call and. notice thereof, a Special Meeting of the�Village� Pymouth, Minnesota, was duly held at the Wayzata Senior High School, on Wednesday, August 14, 1963, at 8:00 o'clock P.M. The meeting was called in accordance with official publica- tion for a public hearing for the purpose of considering a trunk sewer system in the Southeast area of the Village of Plymouth, and ident fled as District No. 1 Present: Mayor Keefe, 'trustees Curtis, O'Fallon, Reinan and Tart, the Village Clerk, Curtis Pearson (Attorney), Messrs. Harry Mayeron and Sam Huston of Orr-Scht.len Mayeron & Associates, Inc., and Mr. Dison of T. C. Evensen & Associates, Inc. Mayor Keefe called the mating to order. Approximately 300 persons attended the meeting of which a large percentage were residents from other areas in the Village than District No. 1. District No. 1 A map was on display identifying District No. 1 as to the Public Hearing plans of the pillage. A number of petitions were presented which on Sewer Project. totaled. approximately 125 names, requesting that sewer service be sada available as soon as possible in their areas. A letter was presented by J. E. Brill, Jr., attorney representing a number of residents from various parts of the Village, in which he stated their opposition to the presently proposed sewer installation. A considerable number of people requested permission to express t!eir opinions which were approximately equally divided for the sewer and against the sewer although most objections came from residents outside of the District being considered, as they were opposing any possible future tax mill aseessmnt against them. Attorney Pearson, on behalf of the Village Attorney, submit, - tad resolutions to the Mayor for considered on by the Council at the time of the Hearing. These resolutions were as follows: 1. Resolution Ordering IiWovementa and Preparation of Plans; 2. Resolution Ordering the Improvements Yot to be Made; 3. Resolution Ordering the Adjournment of the Meeting to a Later slate for Further Consideration by the Council. Motion made by Trustee Curtis that a decision be made at this meeting as to whether or not the sewer project should be adopted. Motion seconded by Trustee Reinan and passed by all Council members voting aye. With no further comments from the public, the Mayor declared the Public Hearing closed. Trustee Curtis stated that he had attended practically all the meetings which were held pertaining to the sewer project; that he had received numerous phone calls against it, and that he still f Olt that additional information should be made available Nefore he would recommend a decision in favor of the project. Motion Wade by Trustee Curtis that the aewer decision be delayed for a period of not more than one year. The Mayor called for a seconding of the motion but after three requests, no seconding was received and the motion died for a second. Augast 14, 12W. - Cont' d. Trustee Reinan introduced the following Resolution and moved its adoption: RESOLUTION U-53 RESOLUTION ORDERING IMPROVIP110iS AND P #EFARATION OF PLANS Resolution 63-53„ Resolution Order if Improvements and Preparati, an of WHEMS, a resolution of the Village Council adopted the 8th day of Jul;, 1963, fixed a date for a Council public hearing on the proposed improvement of: Construction and installation of trunk sanitary sewer lines, as follows: 1. Frac T.H. 55 and County Road 18 NW along T.H. 55 to the right- of-way of the Chicago, Northwestern Railroad; thence westerly along said right -of -war to Niagara Lane; 2. From T.H. 55 and Cody Road 154 northwesterly to 26th Avenue; and WHEREAS, ten days' published notice of the hearing through two weekly publications of the required notice wqs given according to statute; and WHEREAS, the hearing was held thereon on the 14th day of August, 1963, at which time all persons desiring to be heard were given an oppor- tunity to be heard thereon; NOW THEREFORE, FSE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF PLYMOUTH: 1. Such improvement is hereby ordered as proposed in the Council Resolution adopted July 8, 1963, and as described in the Notice of Hearing published July 25, 1963, and August 1, 1963. 2. Orr-Schelen lMayeron & Associates, Inc., engineering con- sultants, are hereby designated as the engineers for the improvement and shall prepare plane and specifications for the making of such improvement. Motion for adoption of the foregoing Resolution was duly seconded by Trustee Tart and upon vote being taken thereon, the following voted in favor thereof: Trustees of Fallon, Reinan, Tart and Mayor Keefe.
