Pursuant to due call and notice thereof a Regular PIeeting
of the Village Council of the Village of Plymouth, Ninnesota, was
duly held at the Village Hall on the 3rd day of October, 1961, at
8:OQ o'clock P.R.
Present; Mayor Anderson; Trustees Kreatz, Theis and Yngve,
the Village Clerk, Engineer and Fsttorney. Absent; Trustee Keefe.

The Mayor announced that the meeting was convened for the
consideration of bids for the purchase of $90,000 Street Improvement
Bonds of 1961, Series D, as advertised for sale. The Clerk presented
affidavits showing publication of notice of sale more than ten days
in advance of sale in the official newspaper, The Minnetonka Herald,
and in Commercial West, a financial paper published in Minneapolis,
Minnesota, which affidavits were examined and found satisfactory and
ordered placed on file.
The Cleric pre3ented the sealed bids which had been delivered
to him prior to tip time specified in the notice of sale, and said
bids were opened, examined and found to be as follows:

After due consideration of said bids, Tntstee. Kreatz intro-
duced the following resolution and Proved its adoption.

Plymouth, Minnesota, as follows:
1. The bid of Piper, Jaffray & Hopwood
to purchase $90,000 Street improvement bonds of 1961, aeries B, of
the village described in the notice of sale thereof is hereby found
and determined to be the highest and beat bird received pursuant to
duly advertised notice ;f sale and shall be and is hereby accepted,
said bid being to purr.: =e bonds bearing interest as foliowas
2.60; for bonds maturing October 1, 1963 throuZh 1965,
2.9% for bond, maturing '966 through 196; plus extra
coupon on each bond at 2.40% for the period frog

the good faith check of the successful bidder pending completion of
the sale and delivery of the bonds, and the Village Clerk is directed
to return the checks of the unsuccessful bidders forthwith,

aeoonded by trustee Yngve, and upon vote being taken therm the

the expenses incurred and to be incurred in making street improve-
ments, pursuant to and in full conformity with the Constitution and
laws of the State of ;•ainnesota, including Minnesota Statutes Chapter
429, and is payable primarily from special assessments against
property specially benfi.ted thereby but constitutes a general oblig-
ation of the Village and, to provide moneys for the prompt and full
pa�rtent of said principal and interest as tle same become due, the
full faith and credit of the Village is hereby irrevocably pleged
and the Village Council will levy ad valorem taxes, if required for
such purpose, which may be levied on all of the taxable,property in
the village without limitation as to rate or amount.
IT IS :MBY MTIFIED AND RECITED that all acts, conditions
and things required by the Cons`_,ition and Laws of the State of
Minnesota to he done, to happen arv. to be performed precedent to and

4. The bonds shall be prepared under the ditection of the
Village Clerk and shall be executed on behalf of the village by the
sign$ture of the mayor and the village clerk and the ec:rpurate seal
of the village shall be affixed to each thereof, and the interest
coupons shall be executed apd authenticated by the pr:Wted facsimile
signatures- of said mayor and clerk. The saki bonds, when ful3,v
executed, shall be delivered by the Treasurer to the purchaser there-
of uponreceipt of the purchas� price, and the said purchaser .hall
not be obligated to see to the proper application thereof.

5. The bonds issued hereunder shall be payable from the
Street improvement Donds aX 1961, Series B Fund, and all. the proceeds

of the special assessments to be :Levied for said impvovements are
hereby pledged to said fund. If any payment of principal or interest
on said bonds shall became due when there %� not sufficient money
it said fund to pay the same, the Treap_rer shall pay such principal
or interest from the general fund of the pillage and such fluid shall
be reimbursed for s+:ch advances out of proceeds of assessments for
said improvements wt-en collected.
b. it is hereby determined that the estimated collection
of special assessments .for the pa;?ment of said bonds will produce
at least five tercent in excess of the amount :"seeded to meet, when
due, the principal and interest payments on the bonds, and no tax
levies are present.l;,- required. The Clerk shall deliver a certified
copy of this resolution to the County Auditor of Hennepin County,
and obtain: his certificate as required by Section 475.63 Minnesota
Statutes.
7. It is hereby determined that the improvements to be
financed by the issuance of bonds hereunder will benefit the entire

8. The officers of the village are hereby authorized and
directed to prepare and furnish to the purchaser of the bonds and to
the attorneys approving the same certified copies of proceedings and
records of the village relating to said bonds and to the financial
condition and affairs of the village, and stitch other certificates.-
affidavits and transcripts as may be required to show the facts with-
in their knowledge, or as shown by the books and records in their
custody and under their control relating to the'validity and marketab-
ility of said bonds, and such instruments, Including any heretofore
furnished, shall be deemed representations of the village as to-,the
facts stated therein.
The motion for the adoption of the foregoing resolution was
duly seconded by Trustee Yngve, and upon vote being taken thereon the

following voted in favor thereof: mayor Anderson, Trustee Kreatz, Theis
and Yngve and the following voted against the same: None
whereupon said resolution was declared passed and adopted.

Air. Myatt, representing Industrial Park 494, appeared

that the work could be commenced as soon as possible.

Mr. Setzle: and Air. Kretchmer, of Northern States lower
Gomspany, appeared to present a street luting plan for the Village.

A three year and five year program was submitted for the installation

at $40.00 each for a total of $12,060.00. Maps were also submitted
showing the location of all the proposed installations. It was
also stated that it was not necessary to order all the installations
at one time as it would be acceptable to make a few installations
periodically. The Council agreed that the matter should be turned

over to the Planning Car--mission for a study by them with the
request that they submit their recomm &dations.
Ernest Saler submitted a plat of Snyder's LakeAew with
