HomeMy WebLinkAboutCity Council Minutes 04-26-2004 BOEAdopted Minutes 2004 Board of Appeal and Equalization Reconvened April 26, 2004 The Reconvened Meeting of the 2004 Board of Appeal and Equalization was called to order by Mayor Johnson at 7:00 p.m. in the City Council Chambers, 3400 Plymouth Boulevard, on April 26, 2004. This meeting was reconvened from April 12, 2004. COUNCIL PRESENT: Mayor Johnson, Councihnembers Black, Stein, Slavik, Hewitt, Neset and Bildsoe. COUNCIL ABSENT: None. STAFF PRESENT: City Manager Ahrens, City Assessor Bye, Senior Appraiser Olsson, Appraisers Kingsbury, Bowman, and Henderson, Finance Director Hahn, and Deputy City Clerk Gulbrand. City Assessor Bye stated the council has received written recommendations from staff on appeals received at the Board of Equalization meeting conducted on April 12. Phil Klone, 18700 28th Avenue North, (19-118-22-33-0026), stated he has reviewed the sales of comparable properties and has spoke with a realtor. He feels his estimated market value is too high and he is concerned about the increase in property taxes. He presented to council a listing of work that has been done in the last five years and addressed potential future repairs. Mr. Klone requested to have his 2004 estimated market value reduced. Mayor Johnson asked if he has had a market analysis. Mr. Klone replied no. Councihnember Bildsoe stated that the comparisons compared well and he didn't feel the assessed valued should be reduced. Mayor Johnson stated that the condition of the subject and comparables was listed as average. She feels that comparable #3, 17920 30th Place, should be listed as excellent condition and requested staff to recalculate the adjusted sale price of the comparables if the condition is listed as superior or excellent. Without objection staff will prepare the calculations accordingly and report back to council. Carol Burgess, 16705 12th Avenue North, (32-118-22-21-0059), presented a packet of information to the council and reviewed the staff report and recommendations in detail. She stated that her increase in valuation was higher than any of the houses in the area. Her value increased 15% versus the neighboring properties, which increased 4% to 13%. Ms. Burgess stated that she does not agree with the properties that were used as comparables, since they have more square footage. Ms. Burgess is disputing her value being raised $80,000. Adopted Board of Equalization Minutes April 26, 2004 Page 2 of 3 Councilmember Bildsoe asked if she had a realtor do a market analysis. Ms. Burgess replied no. Councilmember Slavik stated that the lot size of the subject is larger than the comparable properties. City Assessor Bye stated that there is not a lot of difference in the square footage; but Ms. Burgess's house is located on Gleason Lake. Mayor Johnson asked staff what is the process for assessing homes. City Assessor Bye stated that homes are assessed every five years. City Assessor Bye stated that the older homes on Gleason Lake have sold; which makes the market in that area extremely strong. Councilmember Neset asked Ms. Burgess if her house has lakeshore access. Ms. Burgess replied that she has 75 feet of lakeshore. Councilmember Neset asked if there are other houses with similar value on other lakes in Plymouth. Senior Appraiser Olsson stated that the lots in Serenity on Hadley Lake are selling for $475,000. Councilmember Neset feels that the assessment may be too low and should be assessed higher because of the lakeshore. Councilmember Neset asked what is the average price of a city lot. Senior Appraiser Olsson stated that a 1/3 -acre city lot would sell for $130,000 to $150,000, which is not on lakeshore. Senior Appraiser Olsson stated that they are addressing the Total Market Value, not the Land Market Value. Councilmember Neset stated that he feels Ms. Burgess's assessed value is fair. Ms. Burgess reiterated her house is assessed exceedingly more than the houses in her neighborhood. Councilmember Stein stated that the map depicted all of the Gleason Lake lakeshore properties. He stated that Ms. Burgess's value increased 15% and the other lakeshore properties had increases between 18% and 35%. Mayor Johnson stated that with the information Ms. Burgess presented, the value is close to what staff has prepared. Appraiser Bowman stated that she recalculated the adjusted sale price on Mr. Klone's comparables and with the $10,000 adjustment the comparables average price is $338,000. Appraiser Bowman stated that she recommends Mr. Klone's value remains unchanged at 329,900. Motion was made by Councilmember Black, and seconded by Councilmember Hewittto approve staff's recommendations. With all members voting in favor, the motion carried. Mayor Johnson feels that Ms. Burgess's property has been assessed fairly; but feels that the land value should be adjusted upward. Adopted Board of Equalization Minutes April 26, 2004 Page 3 of 3 Motion was made by Mayor Johnson, and seconded by Councilmember Bildsoe, to amend the main motion to exclude Mr. Klone's report. With all members voting in favor, the motion carried. Mayor Johnson stated that Ms. Burgess has the right to appeal to the County Board of Equalization. Motion was made by Mayor Johnson, and seconded by Councihnember Bildsoe, to reduce Mr. Klone's market value from $329,900 to $319,900. With all members voting in favor, the motion carried.
