HomeMy WebLinkAboutCity Council Resolution 1970-165EXTRACT OF MINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH May 4, 1970 Pursuant to due call and notice thereof a regular meeting of the Village Council of the Village of Plymouth was held on May 4, 1970 at the Village Hall, 13800 State Highway No. 55, commencing at 7:30 o'clock p.m. The following members were present: Mayor Hilde, Councilmen Hintz, Johnson, Kindseth and Spaeth. The following members were absent: None. Councilman Hintz introduced the following resolution and moved its adoption: "RESOLUTION NO. 70-165 A RESOLUTION AUTHORIZING THE USE OF EMINENT DOMAIN TO ACQUIRE EASEMENTS FOR THE NORTHEAST INTERCEPTOR SANITARY SEWER SYSTEM AND FOR THE MINNEAPOLIS CONNECTION BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH: 1. It is hereby determined to be necessary, proper and expedient and in the interest of the public health, convenience and general welfare of the citizens of the Village of Plymouth to acquire for sanitary sewer purposes the property legally _ described as follows, located within said Village of Plymouth, County of Hennepin, State of Minnesota. Parcell That part of the Northwest quarter of the Southeast quarter of Section 36, Township 118, Range 22, Hennepin County, Minnesota described as beginning at a point on the East line of said Northwest quarter of Southeast quarter 546.64 feet South from the Northeast corner of said Northwest quarter of Southeast quarter; thence West— erly, at right angles to said East line, 100 feet; thence Southerly, parallel with said East line, 99.38 feet more or less to the Northerly right of way line of Sate Trunk Highway No. 55, (Old County Road No. 6); thence Easterly along said Northerly right of way line to its inter- section with said East line of Northwest quarter of Southeast quarter; thence North- erly along said East line to the point of beginning. Parcel 2 All that part of Tract A, Registered Land Survey No. 921 described as follows, beginning at the most Northerly corner of Tract L, Registered Land Survey No. 1251, thence North- westerly along the Northwesterly extension of the Northerly line of said Tract D, also being the Southerly line of 13th Avenue North, a distance of 625 feet; thence deflecting to the left 900 00' 00" in a Southwesterly dir- ection a distance of 15 feet; thence deflect- ing to the left 900 00' 00" in a Southeasterly direction to the most Westerly line of Tract D, Registered Land Survey No. 1251, thence North- easterly along the most Westerly line of Tract D, Registered Land Survey No. 1251 to the point of beginning and All that part of Tract A, Registered Land Survey No. 921 described as follows; bel -inning at the most Northerly corner of Tract D, Registered Land Survey No. 1251, thence North- westerly along the Northwesterly extension of the Northerly line of said Tract D, also being the Southerly line of 13th Avenue North, a distance of 625 feet; thence deflecting to the left 900 00' 00" in a Southwesterly dir- ection a distance of 50 feet; thence deflect- ing to the left 900 00' 00" in a Southeasterly direction to the most Westerly line of Tract D, Registered Land Survey No. 1251, thence North- easterly along the most Westerly line of Tract D, Registered Land Survey No. 1251 to the point of beginning Thoabovo motion was seconded by Councilman Johnson and upon vote being +aken thereon the following voted in favor thereof; Mayor Hilde, Councilmen Hintz, Johnson, Kindseth and Spaeth. The following voted against: None. Whereupon said resolution was declared duly passed and adopted. STATE OF MINNESOTA ) COUNTY OF HENNEPIN ) ss. ) VILLAGE OF PLYMOUTH) I, the undersigned, being the duly qualified and acting village manager of the Village of Plymouth, Minnesota, here- by certify that I have carefully compared the attached and foregoing extract of minutes of a regular meeting of the Village Council of said village held May A, 1970 with the original thereof on file in my office and the same is a 1•.11, true and complete transcript therefrom insofar as the samia gelates to authorizing the use of eminent domain to acquire easements for the Northeast Interceptor sanitary sewer system and the Minneapolis connection.
