(1-4) j BOARD AND COMMISSION ITEMS Mitzi Heath has submitted her resignation from the Human Rights Commission. She has been offered a teaching assignment at Fond du Lac Tribal College, which will conflict with Commission meetings. Mitzi thanks the City and indicates that her heart is with the Commission and its vitally important mission. She will be available for consultation if needed. We are currently advertising to fill vacancies on the Youth Advisory Council, Park & Recreation Advisory Commission, and Public Safety Advisory Board. We will add this vacancy to that solicitation. If approved, the EQC needs to forward a recommendation to the City Council to allow composting of food waste. 8:15 PM Medicine Lake Watershed Subcommittee Recommendation. Adjourn Next regular meeting — September 13, 2001 :n\parks\staff\e ric\prac\ag endas\jAug0l .doc SUBJECT: NORTHWEST BOULEVARD IMPROVEMENTS BASS LAKE ESTATES ADDITION STORM WATER TREATMENT POND AND DRAINAGE PLAN REVISION CITY PROJECT NO. 9004 Dear Resident: On June 26, 2001, the Plymouth City Council approved the final design plans and Construction Cooperative Agreement for the County Road 61 (Northwest Boulevard) Improvement Project. They also directed City staff to work with Hennepin County to research the feasibility and overall benefit of relocating the required Wetland Mitigation Pond, which was proposed on the Bass Lake Estates Outlots, to an off-site area. Hennepin County and City staff were also directed to research options for handling the water coming from Maple Grove by either relocating the large pipe that was proposed, or by regrading the existing channel and providing proper erosion protection. Based on the direction given by the Plymouth City Council, the design consultant has prepared five layout drawings, and estimated the increase or decrease in cost to the project and the advantages and disadvantages of each option. These impacts include the amount of trees that will be saved under each option either by installing storm sewer piping, constructing a stone -lined channel along a new alignment, or using the existing channel. All of the options include the required stormwater treatment pond without the original mitigation pond. The treatment pond will be relocated to the "open" area where the mitigation pond had been originally proposed. The wetland mitigation pond will be located off-site. You are invited to attend a presentation on Monday, August 13, 2001, at 7:00 p.m. in the Plymouth City Council- Chambers located at 3400 Plymouth Boulevard, that will be given to explain the five layout - -options that have been prepared for the Bass Lake Estates Outlots. In addition, questions about the overall County Road 61 Improvement Project will also be answered. The contractor, C.S. McCrossan, will be starting work on the project on August 13, but not within the outlot area in question. If you cannot attend -this meeting but wish to learn more about the options that are being presented, please call Dan Faulkner, Director of Public Works, at 763-509-5520, or Dan Campbell, Sr. Engineering Technician, at 763-509-5522. A recommendation will be given to the City Council at their regular meeting on Tuesday, August 14. The Plymouth Youth Advisory Council has openings for one- year terms. The deadline to apply is Fri., Sept. 21. Call 763-509-5054 for an application. Be sure to leave your name, mailing address and telephone number. The Youth Advisory Council provides the City Council with a youth perspective on diverse issues, not just youth issues. The Youth Council offers students leadership opportunities, knowledge of local government and hands-on experience working with municipal issues and programs. The Youth Advisory Council has seven members, one from each of the four wards of the city, three members at—large, plus an alternate member. The Youth Council meets every other Monday at 7 p.m. Applicants should: • Be in at least 9`h grade and under age 21; 1 • Be able to attend Youth Advisory Council bi—weekly meetings on a regular, committed basis; • Serve a term of one year (you can be re -appointed); and Participate in an interview with members of the City Council and advisory board members. The League of Minnesota Cities recently recognized Plymouth's Youth Advisory Council as a leader in the state. The league awarded the group a City Achievement Award in the category of Citizen, Youth and Community Involvement. During its three year existence, the Youth Council has -sponsored: • Two Youth Jams, outdoor concerts featuring local bands. • Youth Town Forums, which have enabled young people to exchange thoughts on current topics with peers, elected officials and City staff members. • Youth Service Awards, a program that recognizes outstanding service by teens in the community. Among the issues the Youth Council has addressed are changes in curfew, operation hours for public transit, new drivers license laws, the City's overnight parking ordinance, the labor shortage, the city water quality program, zero tolerance policies in the high schools, DARE program, cigarette/alcohol accessibility, gang influence, Y2K issues and local government career shadowing programs. The group has also worked to improve communications among Plymouth's four school districts and expand recreation programming targeted at teens. Rep. Jim Ramstad, R_ Minn., met with' Kelner and 100 other •youths from across the country Wednesday to dis- cuss a bill that* Ramsta_d re- cently drafted. The bill, named after Kelner, calls for the creation of a.Youth Com- mission that would make rec- ommendations to Congress and the president. Kelner said news of the bill was "very humbling." "Many leaders In [Rain- stad's] position may have written the youth of America off as unimportant, just be -- cause they cannot vote. .. They are the future leaders of this country, and it is about time we started treating them that way," Kelner said at a Capitol Hill news conference. "The number of issues Congress is debating today that affect future generations is almost endless, but the in- put of young people is almost nonexistent," Ramstad told the crowd. He said the eight -person Youth Commission, which would be- open to anybody younger than 18, would make recommendations on every- thing from drug -use preven- tion to higher education fi- nancing. It is important to remember that 1) a DNR permit is not necessary for treatment of waters not on the "protected waters inventory"; 2) MPCA has authority to regulate alum additions but, instead of exercising that authority, has chosen to provide review/input into DNR permits, 3) the practice of using alum to manage water quality is evolving. 4) the DNR and MPCA are large organizations and that there may be differences in perspective between regions of the state. You asked: 1. What are some of the major factors that you consider in reviewing and permitting an alum treatment application? The DNR and MPCA view the use of alum to treat lakes/ponds as a restoration (not an on-going management) tool. The Agencies believe that alum can be an effective tool to reduce the rate of internal phosphorus loading and accelerate the recovery of lakes/ponds from poor land use practices that occurred in the past. As such we look for evidence that: 1) there are water quality problems caused by excess phosphorus; 2) that the internal loading of phosphorus from lake/pond sediments is occurring and is contributing significantly to existing water quality problems; 3) that significant reductions in external loads of phosphorus have occurred which would, over time, lead to a reduction in internal loading and improved water quality conditions (ie. the current high rate of internal loading represent a historical artifact); 4) long-term water quality conditions, post-treatment, will show significant improvement; b) the proposed treatment method and dose minimize impacts to nontarget organisms. 2. And, how often or frequent can alum treatment be applied in a lake? The current expectation, because this is a "restoration" not an "on-going management" technique, is that a single treatment will be sufficient. There might be some exceptions to the "single" treatment rule, e.g. if post-treatment monitoring demonstrated that the initial dose was insufficient or unusually weather conditions negated treatment benefits. However, the current expectation is that alum will be used once and that the lake/pond will then reach a new water quality equilibrium which reflects lower rates of external loading from the watershed (In contrast, continuous alum dosing is allowed for stormwater treatment). There are municipalities that have asked us to consider allowing alum to be used as an on-going management method. They have argued that binding phosphorus once it is in the lake is cheaper than enhancing its retention in the watershed, particularly in already developed urban areas. This is certainly a valid concern and an issue that the City of Plymouth deals with in various forms everyday. Public use and access is an important factor in evaluating and assessing any lakes condition and its priority in spending public dollars to improve its condition. Last February, the Plymouth City Council approved the newly developed Plymouth Water Resources Management Plan. As part of that management plan, the City needed to evaluate, assess and prioritize our eight major lakes within the City. Public use, including public access and public park facilities, was one of the major factors in developing our lake prioritization. For each of the major lakes, we looked at public use along with their in lake and watershed condition before we ranked and prioritized them. As you may be aware, the two major public water bodies in the City, Medicine Lake and Parkers Lake, are the City's highest priority in addressing water quality issues and funding will be appropriated for making improvements to these two lakes. While the City's initial efforts with implementing projects funded through the surface water fee will be toward these two lakes, funding from this fee will also be used to protect streams and wetlands throughout the City. In addition, the fee will also be used to address drainage and erosion control problems, public education, storm water pond cleaning and excavating and other water quality and flood control problems as necessary. It is certainly the City's intention to only spend the funds from the surface water fee on worthwhile projects that have public benefit. Your request that the City use the storm water fee to improve and/or establish more public access to the "private" lakes in Plymouth is not part of the current program. While this may be something the City Council would address in fiiture years, there currently is a significant amount of public access to many of Plymouth's lakes. I had previously sent a letter to David Bremseth, President of the Heather Run Homeowner's Association, dated July 23, 2001, requesting the opinion of the Heather Run Homeowner's Association regarding the requested closure of the pathway, currently located midway between Medina Road and County Road 24, from the subdivision to County Road 101. I subsequently contacted Mr. Bremseth on August 2, since I had not heard from him: Per our conversation, he indicated he had not received my letter, but we conversed about its content and he indicated the Heather Run board had taken an official position on the issue of the trail closure. The official position of the board based on a survey of the homeowners was that the trail connection should remain open based on the survey results favoring this option at approximately a two to one margin. In my subsequent conversation with Ms. Marczak, I explained that I was aware of the trail connection concern and explained that the City staffs' position is that the trail connection from their subdivision to County Road 101 should remain open. I explained that this connection was included in the original approval of the Heather Run Subdivision and was also shown on the County Road 101 Improvement Plans which were both approved by the City Council. I also explained that I was aware that Fred Moore had met with the two affected property owners and proposed mitigative measures for keeping a trail connection from the neighborhood to the county road trail. These measures include reconstructing a portion of the trail at an angle in order to, lessen the straight sight line from the roadway down the trail corridor, and also this will enable an area for additional mitigative landscaping, as well as some retaining wall to, accommodate the additional berming and landscaping. I further explained that we will involve Ms. Marczak and her neighbor as the road improvement gets to this stage of the trail connection. In the past we have been in communications with Mr. Fred Moore but are now directing this letter about the Highway 101 project to you since Mr. Moore's retirement. We are writing to request the closure of the bike path from Heather Run Subdivision out to the path along Hwy. 101. We live on either side of the path access off Olive Lane North and will be affected by this entrance opening since the road at this particular point with be 8-10 feet closer to our homes. We are concerned about the increased noise, traffic speed and the safety of our children and pets due to the fact that the entrance and Hwy. 101 will be so close to our backyards. We, as Heather Run residents, surveyed our neighborhood regarding their opinion about closing the path access to Hwy. 101 (per the knowledge of our Heather Run Board). We received 81 signed cards back in the mail (73% response rate of the neighborhood), of the 81, 62 residents (77%) responded that it was okay to close the path access and 19 did not want the path closed. We would like the city of Plymouth to consider closing (berming) the path access. Heather Run residents would still have access to the Hwy. 101 path via the new path being constructed along County Road 24 from the Heather Run entrance and the path already along the Medina Road entrance. We live in the Heather Run development, and discussed the height of the proposed berm, the trail between the Marczak and Powers properties, landscaping plans, fencing, and the proposed location of the roadway and trail. The following specifics were discussed: ➢ Berm Height- We all agree that we would like the berm to be as high as possible to reduce the noise associated with a 4 -lane highway. The fact that the road is moving closer to our homes is added justification for a high berm, a berm higher than what is actually planned. ➢ Trail Access= As you know, we have requested that the city consider closing the trail access that runs between the Marczak and Powers properties. The fact that kids use this trail access to cross 101 into the Boulder Crest development is a safety issue that the city must take into serious consideration. In addition, the noise level from the 4 -lane highway will be increased by the "tunnel effect" due to an opening in the berm. You proposed several options which included the construction of retaining walls to allow a higher and more continuos berm, and curving the access onto the trail in a southbound direction. These are good proposals and definitely supported if the trail access is kept open. However, we feel strongly that the trail access should be closed and will be undertaking an aggressive campaign to obtain signatures from other homeowners to support the closing. ➢ Landscaping- We understand that landscaping is one of the last items for completion, but want to reiterate our position per the discussion we had during your visit. If the trail is to remain open, we requested that landscaping be started at that location first. This will ensure that budget money will be available to reduce the "tunnel effect" noise caused by the berm opening. In addition, we requested involvement in the placement of trees and landscaping to maximize the noise reduction for our homes. We have already moved several trees at our expense in anticipation of the noise increase. ➢ Fencing- We understood that the fencing proposed is only associated with restricting access to water or wetlands. This may however be an additional noise abatement option in our case. . We recognize the need for improvements to 101, but have concerns relating to increased traffic noise from a 4 -lane highway and the physical safety of children and pets due to the fact that the roadway is moving closer to our homes. We will gladly meet to discuss these concems, and participate in any way to achieve optimal solutions to these concerns. Again, thank you for your time and consideration.
