HomeMy WebLinkAboutCity Council Minutes 05-23-2006 SpecialAdopted Minutes Special Council Meeting Tuesday, May 23, 2006 Deputy Mayor Slavik called the Special City Council Meeting to order at 5:30 p.m. in Meeting Room A & B, 3400 Plymouth Blvd, Plymouth, Minnesota, on May 23, 2006. PRESENT: Deputy Mayor Slavik, Council Members Willis, Stein, Black, and Hewitt, Bildsoe arrived at 5:47 p.m.), and Mayor Johnson (arrived at 5:45 p.m.). STAFF PRESENT: City Manager Ahrens, Park and Recreation Director Blank, Community Development Director Hurlburt, Administrative Services Director McGann, Public Works Director Cote, City Attorney Knutson, and City Clerk Paulson. Consideration of Liability Claim The Council discussed the liability claim of Tom Uhde. This liability claim was denied by the City's insurance carrier due to there being no evidence of negligence on the part of the City. The claim related to hit and run damage to parked vehicle. Mr. Uhde stated that his insurance carrier covered the damage to his vehicle with the exception of his $500 deductible. Since the City instructed him where to park while his driveway was being constructed as part of the street reconstruction project, and someone hit his vehicle, he felt that the City should be liable for the damages. City Attorney Knutson explained that he has also reviewed his claim, and he agrees that there is no negligence on the part of the City. He stated any payment to Mr. Uhde would be considered a gift which is not an authorized expenditure of public funds. A "gift" of public funds serves a private rather than a public purpose. The Council was in agreement with the recommendations received from its liability insurance carrier and City Attorney, and no action was taken. Meetina with Excel Ener Dave Anderson and Darrin Lahr from Excel Energy discussed with the Council reliability issues. They discussed with the Council how they operate and interact with communities, how their electrical system operates, and how underground cable failures occur. They acknowledged that there are some problem locations in Plymouth where there have been a significant amount of power outages, and they would continue to investigate these occurrences in order to remedy those situations.
