GAUGHAN COMPANY HARBOR LANE APARTMENT APPEAL -- The State Fire Marshal has informed Lyle Robinson that he will be conducting a hearing as requested by the Gaughan Company. The Fire Marshal has also indicated that because of this appeal, he plans to work for legislation to eliminate his department from the appeal process. TRANSIT SERVICE CHANGES -- Attached are the results of a survey conducted by the Metropolitan Transit Commission regarding the 4:40 p.m. homebound trip from downtown for Route 93 (northwest Plymouth). CITY COUNCIL INFORMATIONAL MEMORANDUM a September 28, 1990 Page 3 ' As the Council is aware, we have received numerous complaints that the evening route is "too slow." As a result, we have attempted to speed up this service by eliminating portions of the downtown pickup area, i.e., 12th Avenue, from the route. As a second step, we have asked riders whether or not they would favor moving the departure time downtown from 4:40 p.m. to 4:35 p.m. We believe that by departing earlier, our buses are less likely to hit the "peak of the peak" period congestion. The attached survey results show that 43, or 77 percent of 56 passengers responding, favored the 4:35 route time. Thirteen, or 23 percent were opposed. Four of the 13 said that they would be able to use the 4:35 vehicle. Nine indicated that they would have to wait for the 5:10 or 5:45 p.m. departures. While it is clear that we will not please all passengers, we intend to try to serve the majority by moving the departure time up to 4:35 p.m. We are sharing this information with the Council at this time because you may receive calls from the nine persons who will be forced to shift from the 4:40 p.m. to the 5:10 or 5:45 p.m. departures. (I-6) 7. WETLANDS TASK FORCE -- The Wetlands Task Force is planning to make a "wetland tour" in Plymouth. A specific date has not yet been selected, although Thursday, October 11, or Thursday, October 18 appear to be the most promising. Councilmembers have been invited to attend. I would appreciate your letting Blair or me know Monday evening as to whether or not you would be interested in joining the tour and more specifically, which of those two dates might be more convenient. It is anticipated that the tour would begin in the late afternoon and would be conducted on a Metrolink bus with a light supper being served. 8. WATERMAIN FLUSHING -- City crews began flushing watermains in the industrial areas along I-494 on Wednesday, September 26. Residential watermains west of I-494 will be flushed from October 1 - October 12. Watermains east of I-494 will be flushed from October 15 - October 25. The fall program will conclude October 26 with watermain flushing in Lake Camelot Estates. A copy of the flushing schedule is attached. (I-8) 9. TRAFFIC RADAR ASSIGNMENTS -- In response to speeding complaints, traffic radar assignments were conducted the week of September 12 on 48th Avenue near Trenton Lane. Attached is a report from Lt. Times have been set with both firms for a pre -Council meeting conference on assumptions used in their respective studies. The Polson firm will be available to present their assumptions at 1 p.m. on October 1st in the Council conference room. At 3 p.m., the Rebanks firm will be present to present their assumptions used to determine space needs. Near the beginning of the regular Council meeting on October 1st, the Rebanks firm will present their complete study before the entire Council. Approximately one-half hour has been allotted for their presentation. The Polson firm will be sequestered during the Rebanks presentation. The Polson firm will then present their space needs study. Rebanks will be sequestered at that time. Robinson, Fire Chief/ SUBJECT: GAUGHAN COMPANY, HARBOR LANE APARTMENT APPEAL I spoke with State Fire Marshal Tom Brace yesterday and he informed me that he will be conducting a hearing as requested by the Gaughan Company. He anticipates contacting us within the next ten days and setting up a time for the hearing. We will be requested to testify at the hearing as well as the Gaughan Company representatives. He feels as Dick and I do also that this will end up in the court system before the final resolution. In that regard the Fire Marshal is going to work through the legislative process during this next year to eliminate his department from the appeal process and allow the cities to make the final determination. That of course would still be subject to the court proceedings. I will inform you as soon as I hear further from the State Fire Marshal. LCR: df cc: Richard J. Sheryl McRoberts, 2345 West Medicine Lake Drive, presented a letter containing a list of problems on West Medicine Lake Drive including excessive traffic volumes and speeding. She suggested the Council consider rerouting West Medicine Lake Drive to Forestview as the thorough street, keeping the present road open as a scenic drive, much like the roads circling Lake Calhoun and Lake Harriet in Minneapolis. Public Works Director Moore described the history of the project and stated that three construction options were considered in 1988. The Park and Recreation Advisory Commission (PRAC) held two public hearings in order for residents to comment on the various alignment options. Following public input, PRAC recommended Alternate 2 which would reroute West Medicine Lake Drive to create a larger park area. He stated the cost to completely reroute the roadway, as suggested by Ms. McRoberts, is estimated at $1.6 million. The cost for preferred Alternate 2 is estimated at $500,000. Manager Willis stated the Police Department periodically conducts radar on this section of West Medicine Lake Drive and the accident experience to date has not been excessive. Ms. McRoberts stated traffic in the area has increased this year over last and will continue to increase in the future. She stated it is difficult to use the bike path for safety reasons. She'suggested that the speed limit be reduced in this area. Councilmember Helliwell asked the status of the construction project. Park Director Blank stated Alternate 2 is the recommendation from PRAC. Actual construction is proposed in the Capital Improvements Program for 1993. Director Moore stated that if a speed study were conducted, the speed limit would likely be raised rather than lowered. The City is constructing the path because of the large amount of pedestrian traffic. Mayor Bergman thanked Ms. McRoberts and stated the Council will consider her comments. 2. Kieran A. Stapleton, 17210 County Road 6, asked the status of a library and community center in Plymouth. circ SEP 23'90 Mk*:)0-b MINUTES PLYMOUTH HOUSING AND REDEVELOPMENT AUTHORITY AUGUST 30, 1990 The regular meeting of the Plymouth Housing and Redevelopment Authority was called to order by Chairman Crain in the City Center Council Conference Room on August 30, 1990, at 6:40 p.m. PRESENT: Chairman Crain, Commissioners Ludovissie, Gutzman, Palmer, Ricker ABSENT: None STAFF PRESENT: Community Development Director Tremere, Housing Specialist Dale, Finance Director Hahn, and City Clerk Rauenhorst MINUTES MOTION was made by Commissioner Ricker, seconded by Commissioner Gutzman, to approve the minutes of the July 19, 1990, meeting. Motion carried on a roll call vote, five ayes. PRELIMINARY FINANCIAL DATA ON SENIOR HOUSING DEVELOPMENT COSTS Steve Apfelbacher and Mike Grossman, Ehlers and Associates, presented a report on financial projections they have run for development of a senior citizen housing project using the pro - formas previously outlined by the HRA. These pro -formas include two basic construction types; what operational costs would be; income generated based on buildings of different sizes utilizing two different ratios of bedrooms and rent schedules. They also added options for tax exempt or taxable financing. Mr. Grossman explained the basic assumptions that went into the financial calculations and responded to questions by Commissioners. Mr. Apfelbacher briefly described the financing options available for the project. He stated that in addition to General Obligation taxable financing or tax exempt financing, a third option would be a tax exempt mortgage revenue bond issued by the HRA. This option would result in an interest rate somewhere between the other two options. Commissioner Gutzman stated he would support further study and consideration of.the tax exempt mortgage revenue bond option. Commissioners Crain and Ricker stated the repair and maintenance projections seem low. Commissioner Ludovissie stated the costs could vary depending on the type of construction chosen. Masonry cim SEP 28'90 Mayor Bergman stated the City is continuing to pursue construction of a library in Plymouth. A Financial Task Force has been formed to consider strategic planning of the City's current and future finances. A Community Center may be addressed in the park and recreation element of that research. Manager Willis reported that Councilmember Helliwell and he met last week with County Commissioner Tad Jude to discuss the library issue. A Plymouth library is not currently contained in the County Administrator's or Budget Committee's budget recommendation to the County Board. cine SEP 25"'90 HRA Minutes August 30, 1990 Page 2 Z ab construction would cost more initially, but would yield lower maintenance/repair costs in future years. Commissioner Gutzman questioned the projected repair and maintenance expense of $138 per unit per month. The St. Paul Housing Authority experiences $236 per unit per month expenses; however, that is for all structures including up to 5 -bedroom units and single family homes. Commissioner Gutzman asked if any actual expense figures are available from the Dakota County project. Mr. Grossman stated it is too early in the project to determine whether the preliminary expense estimates were accurate. Commissioner Ricker discussed the legal authority of the HRA to levy for the project. Community Development Director Tremere stated that an opinion may be needed from the HRA Attorney to identify the extent of the HRA's statutory levy authority. He noted that a portion.of the total allowable levy would continue to go toward HRA operating expenses and maximum levy would not be available for the senior project alone. Commissioner Gutzman stated he thought the levy for the senior project would be separate from the levy for other HRA activities. Finance Director Hahn stated it is all part of the same levy. He explained that there has been a special levy for HRA about the last 10 years in the range of $20,000 to $30,000 per year. Mr. Apfelbacher stated that he has spoken with the City Attorney regarding the maximum levy authority of the City and how an additional HRA levy would affect that. He indicated that tax exempt bonds could be issued without a bond referendum, but there is some question of whether a taxable issue would seed referendum authority. Commissioner Ricker stated that he believes the HRA levy for the senior project should remain low in the early years and balloon in future years. Commissioner Ludovissie asked if Ehlers believes there is any possibility of the senior project eventually becoming self- supporting and free from a levy in the future. Mr. Grossman stated no, the projections indicate that the project will always need a subsidy to rents received. Commissioner Gutzman asked why tax increment is discussed in the report. Mr. Apfelbacher stated there is an option of using the City's tax increment authority without using actual revenues to build the project. CIM SEP 28'90 HRA Minutes August 30, 1990 Page 3 Commissioner Gutzman stated that at some point the HRA must address the process to be used --how to get public input and whether and/or when to hold public hearings. Commissioners asked Mr. Apfelbacher which project scenario he would recommend based on the projections. Mr. Apfelbacher stated from a purely financial perspective, he would recommend the following project: Rent Schedule No. 2 outlined in the report on a tax exempt basis, 20/80 ratio for two-bedroom units to one -bedroom units, 75 to 100 units. He stated with 75 units, another phase could be added to the project in the future. Also, it appears likely that market demand is in place for 75 units. A project as large as 100 units would also work financially. The type of construction is optional. He agreed with Commissioner Ludovissie's earlier comment that frame construction would be less expensive initially, but will have higher future maintenance costs. Masonry construction would be more expensive, but have lower future costs. Commissioner Ludovissie asked about the marketability of the proposed 20-80 two-bedroom/one-bedroom split. Housing Specialist Dale stated that he receives many requests from individuals wanting two bedroom units. He believes the demand would meet the supply with a 75 or 100 unit project. Commissioner Ludovissie stated that this project will serve the City 20-30 years in the future as well. He supports moving cautiously with a 75 unit project with the option of a future addition. Commissioner Ricker stated that the demand level has yet to be proven. The HRA needs to know how many people need housing assistance and to what extent the HRA is able to meet that demand. Community Development Director Tremere stated there are indications through Housing Specialist Dale's contacts that sufficient demand exists for a project. Commissioner Gutzman noted that the market study conducted several years ago indicates there is need for senior housing. Director Tremere stated further surveys could be conducted using senior citizen utility billing information or a general questionnaire. Commissioner Ludovissie stated a prototype project should be established before asking residents to comment. The Commissioners discussed the possible timing of a project. Commissioner Ricker stated a decision would have to be made very soon if a tax levy in 1991 is anticipated. Director Tremere* cim SEP 25'90 HRA Minutes August 30, 1990 Page 4 f ! 4 stated the City is also operating without a formal agreement with Hennepin County with respect to the property proposed for the senior housing site. He stated there are options available where the City could purchase the land to completely eliminate the CDBG connection with the property. Commissioners concurred that they are anxious to move ahead with a project. Commissioner Ricker suggested that the commission determine whether further information is needed from Ehlers and Associates. Chairman Crain stated the initial projections indicate a project would be feasible. He does not feel additional financial information is needed from Ehlers at this time. Commissioner Gutzman stated he would support the concept of a 75 unit, concrete structure with rent levels as proposed in Ehlers Option 2. He supports concrete construction for lower long-term maintenance as well as fire safety. Chairman Crain stated he will attempt to develop a survey or questionnaire which could be used to determine the demand for senior housing for consideration by the Commission. He will coordinate the survey using available City data and other resources he can use. MOTION was made by Commissioner Gutzman, seconded by Commissioner Ricker, to request an opinion from the HRA Attorney on the HRA's statutory authority and whether the HRA has levy authority independent of the City. Motion carried, five ayes. Community Development Director Tremere stated the HRA recently received the proposed Annual Contributions Contract (ACC) from the HUD office. This contract would extend the existing Section 8 Housing Certificate Program from June 30, 1991 through June 30, 1992. As leases and contracts with apartment owners run for a period of one year, it is important that the contract be executed and submitted to HUD as soon as possible. Commissioner Ludovissie stated he is concerned that the HRA is entering into leases that exceed the current contract period. Director Tremere shared the concern and noted when the ACC was received from HUD. Director Tremere stated there is a very significant change in the Section 8 program relating to the portability of Section 8 certificates and vouchers. He stated that portability may be an cite SEP 28'90 HRA Minutes August 30, 1990 Page 5 advantage to some agencies, but to others it could present an administrative nightmare. The most difficult aspect of portability is the uncertainty as to how many certificate holders will move into or out of a community during any given time. Director Tremere stated that portability could lead to an influx of certificate holders to suburban communities. Portability also involves the matter of billing other public housing agencies for housing' -assistance payments and administrative fees. Other issues have not yet been clarified and little formal guidance has been received from HUD. He explained that the city has provided the HRA services for administering the Section 8 program via a Management Services Contract. This has been founded on the premise that City Staff could absorb the demands of the program as well as other activities relating to housing and redevelopment. With the addition of portability and the additional certificates solicited by the HRA, the City may no longer have the staff needed to administer the volume of applications and certificates received. Director Tremere stated he believes staff support will need to be increased. Commissioner Gutzman stated he was disturbed by the tone of the staff memo and Director Tremere's comments which he considers an overreaction to the portability issue. He stated that portability has been mandated by court action, and Plymouth could actually gain through portability. He recommended renewal of the contract with an assessment of the situation after one year to determine the effects of portability. Chairman Crain agreed that the effects are unknown and should not be distorted or blown out of proportion. If the Section 8 Program is discontinued by the City and the certificates are turned over to the Metro HRA, the majority of current Section 8 households would not be Plymouth residents. This would be inconsistent with the goal of the Plymouth HRA to provide affordable housing to residents. Director Tremere stated that was the point of the memo: portability, as it is being administered, could result in a 'customer base' beyond just Plymouth residents. Acceptance of the new ACC is an acceptance of the portability administrative practices and regulations. He explained the purpose of staff's analysis was solely to signal a significant change to the HRA. The HRA traditionally has pursued the Section 8 program itself, unlike many suburbs, because of the concern that Plymouth residents might not be as well served by, say, the Metropolitan HRA. cine SEP 28'90 HRA Minutes August 30, 1990 Page 6 He explained that staff is not `recommending termination of the Section 8 program. ., Commissioner Ludovissie stated that the quality of the local program should be maintained, rather than turning the program over to another agency. In response to a question by the commissioners, Housing Specialist Dale reported on the experience with the interjurisdictional mobility program in the metro area. This will diminish as portability as directed by HUD is more widely implemented. Director Tremere stated that renewal of the ACC will require reconsideration of the Management Services Contract the HRA has with the City of Plymouth, because the portability issue and the possibility of the City receiving a number of new certificates will require more services from the City. MOTION carried on a roll call vote, five ayes. Housing Specialist Dale reported that interest in the Housing Rehabilitation Grant Program has been significantly less this year than in previous years. He suggested that a public hearing be held in October to consider options for expenditure of Year XV funds. One option could be to the Scattered Site Homeownership Program for purchase of a lot in 1990 and development of a house during 1991. Director Tremere stated a portion of the funds could be used for administrative costs for development of the senior housing project. Most employees let their people leave at 430pm, 445pm, or 500pm.. Why should the bus leave earlier just to satisfy the people that are lucky enough to catch it at Marquette & 7th. I would be able to catch the 510pm departure, but what other choice would I have . I would rather you had a 500pm departure and one later than 545pm, say 630pm. I took time since your call to have the site inspected and the file thoroughly researched. Here are the findings: 1. You asked if the City has the authority to require the builder to complete the two unfinished buildings. There are actually six buildings of the approved complex which remain to be built. There are no buildings that are in an incomplete stage, i.e., all the buildings for which permits have been issued have been completed. Construction of this development ceased approximately 1 1/2 years ago and the balance of the property is for sale.. You expressed to one of the inspectors that the pool and recreation building could be subject to vandalism because it is relatively isolated from the rest of the Timberton project. I agree with your observation that if the project were completed as planned, this likelihood would diminish because there would be buildings around it. In the meantime, the Timberton Homeowners' Association and/or developer should consider lighting and other security measures for that building. You may wish to contact our Public Safety Department for specific suggestions. 2. You asked whether the City has the authority to require the builder to remove dead trees. A developer is required to remove dead or diseased trees at the time of the development and it is my understanding this was done. This is a heavily wooded area and it appears there are stumps and scattered trees around the site which have died or are dying. We noticed that there is an elm tree which has been tagged and thus would be subject to removal. The responsibility over time for tree maintenance is the Association's. 3. You inquired whether the City has the authority to require the builder to repair patios and decks. Some of the patios installed on some of the buildings were poured in what is known as solid pours" and have undergone some cracking due to frost heave. You inquired whether the City has the authority to require the builder to remedy drainage problems. Some of the sites may have a slope away from the buildings to handle potentially large amounts of water coming off the roofs. The grading does appear to have been completed in accordance with the approved grading plan but, over time, runoff from the roofs has apparently resulted in some erosion around the entry patios. The developer and/or the Association would be responsible for the remedy to the problem which is not a Building Code violation. There may be several techniques which could be used to interrupt or divert the roof drainage and you could discuss this with a member of the Building Inspection Division. 5. You asked whether the City has the authority to require the builder to reinvest Association fees in repair and maintenance of the buildings. You indicated to the inspector that Association fees were spent on site improvements thus leaving little or no money for the repair and maintenance of the buildings. The City does not have the authority to regulate the fees for routine maintenance and repairs of common areas or buildings. The City would be involved only if the maintenance of a given area such as streets was neglected; the City has legal authority then to make the necessary repair to the public common areas and assess the cost to the Association. Inspection of the site found no Code or Zoning violations; lack of maintenance was apparent in a few areas and, as noted, a portion of the development has yet to be completed. I have tried to contact the original developer and I am now attempting to contact the Healy-Ramme Company with whom we had contact when the development was active. I will convey to them your concerns and suggest that they contact you. Below I have answered your specific questions, and I remain available to respond to any others. 1. The train speed on the track in question is 40 m.p.h. This is specific to the area of Zachary Street and Pineview Street. Zachary street is located on our railroad at MP 11.1. Eastbound trains would be reducing speed through this area since a speed limit of 20 m.p.h. begins at MP 9.5 eastward. 2. There is consistency in the whistle blasts for grade crossings in that our operating rules require two long blasts, one short blast, and one long blast to be the sequence for every crossing. The length of each blast may'vary somewhat between individual Engineers. Also, if an Engineer sees traffic on or approaching -the crossing, he may extend the length of the blasts in the interest of preventing a mishap. These whistling requirements are the same whether or not crossing gates are in place at a crossing. 3. Soo Line moves approximately 11,000 hazardous material cars on this segment of track annually. OLIVET CHURCH AREA SEWER SPECIAL ASSESSMENTS Dear Judy: Mayor Kim Bergman provided me with a copy of your September 6, 1990 letter to him and requested I research the issue and provide you any information possible in order to "clear up this matter as soon as possible" per your request. I have reviewed the copy of my letter written approximately nine years ago and discussed the assessment policy with both Dan Campbell and Fred Moore. I apologize for any ambiguity or misunderstanding my letter may have caused you. I do recall that Jerome and I discussed the conditions prior to his leaving for Arizona and then left the final details for you and I to discuss. As I recall, it was Jerome's proposal to grant the easements free of charge in return for the assessments being deferred until such time as the hookup was made to the sanitary sewer. It is impossible for me to recall the details at this time as to why the interest rate was not specifically stated under Item No. 2. It would appear that the statement in Item No. 3 was meant to apply to all specials on both lots. I have been assured that it was the policy at that time and it is the policy now that all special assessments are deferred with interest. The reason is that the City sells bonds in order to borrow the money to do the construction project and pay the contractor. As specials are paid off over a period of years, the bonds are retired along with interest due from the City. As far back as I can recall, the City charges interest at a rate 1% greater than the rate which they pay to borrow the money via the bonds. This 1% is to handle all administrative costs. I am enclosing a copy of the original resolution deferring the assessments which the lot owner at the time would have received and for which a public hearing was held. The resolution states that assessments would be deferred at the established rate. The reason you received the letter in August of 1988, was because of an administrative policy of the City to defer in five year increments thereby triggering a look after five years to determine whether or not hookup had been made and whether or not assessments would be due and payable. Your assessments were redeferred for an additional five year term at the same interest rate as on the original deferment. Thus, the reason for this letter. We have received numerous complaints about obscene phone calls made to children of elementary age. I have enclosed the Wayzata Sailor article to more detail the substance of these calls. In case you get any reports concerning this matter, you may want to pass on to the children that they should not talk to anyone on the phone that they do not positively recognize. The best advice for anyone receiving these types of calls is hang up immediately! None of the reported cases have involved a call-back by the suspect. This letter is simply an advisory to you. Federal and state laws require that persons legally responsible for storage tank releases notify the MPCA of the release, investigate the extent of the release and take actions needed to ensure that the release is cleaned up. A person is generally considered legally responsible for a tank release if the person owned or operated the tank either during or after the release. We are aware that an initial investigation of the site has occurred and petroleum contaminated soils and/or ground water have been identified. The MPCA staff is therefore requesting you to take the necessary steps to investigate and clean up the release in accordance with the enclosed MPCA technical documents. If you have not already done so, we recommend that you hire a qualified.consulting firm who has experience in conducting petroleum release site investigations and taking corrective actions. In addition, you must notify the MPCA within 24 hours if you discover free-floating petroleum product on the surface of the ground water. If you do perform the requested work, the state may reimburse you for a major portion of your costs. The Petroleum Tank Release Cleanup Act establishes a fund which in certain circumstances provides partial reimbursement for petroleum tank release cleanup costs. This fund is administered by the Petroleum Tank Release Compensation Board (Petro Board). More specific eligibility rules are available from the Petro Board (612/297-4017). Please respond to this letter either in writing or by telephone within 30 days after you receive it. We feel it is apparent, from the statements of the neighbors in the area, as well as from the engineering reports, records and information provided by LDK Builders, that our client was not responsible for the Kings North Subdivision drainage problems. We believe that the information provided to the City from all sources clearly substantiates LDK's contention that there were no swales on the particular lots upon which LDK constructed houses at the time LDK began their construction. It seems apparent that the swales were not constructed at the time of the final grading of the overall development. However, at your City Council Meeting of August 20, 1990, there were several inaccurate statements and allegations made by council members which implied that LDK was somehow at fault for the drainage problems. We would ask that the City Council publicly retract, at its next City Council meeting, any misinformation and statements that were made which wrongfully attributed blame to LDK Builders, Inc. for these drainage problems. Also, Ken Johnson has inspected the street and curb and completed a final punch list. The following is a listing of work yet to be completed within the common open area: 1. The entire area needs to be walked and the larger rocks (approximately the size of a fist) need to be hand picked. Also, there is some debris, such as wire, imbedded in the ground which needs to be removed. 2. A short section of silt fence along the west side of the path within the low area at the south end needs to be installed. The purpose of this silt fence is to prevent siltation on the pathway until vegetation has been established. 3. The rock drainage bed at either end of the drain tile has not been installed properly. Also, the outlet end of the. drain tile is too low and below ground level. 4. All of the weeds were not removed along the south and east side of the pond. Also, along the east side of the outlot, in back of an existing homeowner's fence, the weeds were not removed. The removal of the weeds within these areas is hand work. After the weeds are removed, these areas must also be reseeded. 5. There is evidence that you have planted grass seed in the entire area but until this seed germinates and growth is established, we cannot determine if this work has been done in an acceptable manner. This will again be inspected in the spring to determine if proper growth has been established. 3400 PLYMOUTH BOULEVARD. During the removal of the pile of black dirt in the southeast corner'of the outlot, the wood bollards marking the northwest property corner of Lot 1 were removed. Although these bollards were reinstalled, they are not in the proper location. You should have your surveyor locate this property corner and reinstall the bollards at the proper location. Also, the shrubbery at this same location was moved and will have to be installed at the correct location. 7. As part of the regrading, work was performed on the lot at 15335 41st Place. As completed it does not blend in with the existing yard. You or your representative should meet with the property owner, Larry Norling (phone 557-1122), and come to a mutual agreement on how the area should be regraded in order that his yard blends into the common open space. Also in conjunction with the common open space, we need the following documentation from your engineer: 1. Furnish us with the easement for the drainage swale as referenced in my August 31, 1990 letter. This easement must be in recordable form. 2. Certify that the grading within the common open area was done in accordance with the approved plan. Also, your engineer should provide us with an "as -built" plan. Regarding the final wearing surface and curb repair on the streets, the following work needs to be completed: 1. 42nd Avenue and Orchid Lane - Northeast quadrant, east side of catch basin a crack needs to be finished. It was not completely filled. 2. 4215 Orchid Lane - Grout back of curb. 3. Remove and replace approximately 150 feet of spalled and deteriorated curb and gutter on County Road 9 east. of Polaris Lane. By letters dated September 19, 1990 to John Sweeney, your engineer requested that the bonds for Quail Ridge of Plymouth 1st, 2nd and 3rd Additions be reduced to zero ($0). As stated in that letter, your street contractor still has to provide the City with a one year maintenance bond. Also, the bonds cannot be reduced to zero ($0) because of boulevard/ drainage swale sod, which has not been completed within the additions. You should verify with their engineer whether the City has received all of the "as -built" drawings for these additions and they have been approved by the City. If you have any questions about the work remaining to be completed, do not hesitate to contact me. In my letter to Randy Hedlund dated August 31, 1990, I suggested that he contact me after the grading in the common open area was completed, but before any seeding took place in order that we could inspect the area.
