DEVELOPMENT SIGNAGE -- On Friday, June 29, development signs will be installed at the following locations: a. Northeast of Revere Lane and Highway 55. Ryan Construction Company is proposing additional development at the Waterford Park Plaza consisting of a Land Use Guide Plan Amendment from CL (Limited Business) to CS (Service Business), a Rezoning from B-1 (Office Limited Business) to B-3 (Service Business District), PUD Preliminary Plat and Final Plat for one lot and one outlot, and Preliminary Plan and Final Plan for Arby's fast food restaurant. The Conditional Use Permit is for the PUD. (90052) b. Northeast of Carlson Parkway and I-494. Shafer Contracting is requesting a Conditional Use Permit to remove the excess earth and fill from reconstruction of I-494 right-of-way and place and compact on this portion of Carlson Companies property. (90058) These requests will be heard by the Planning Commission at the Wednesday, July 11, 1990 meeting. 2. COMPLAINT OF CONTAMINATED SOIL - Mayor Bergman called to relay a of Alpine Tree Apartments. The removal of a leaky fuel oil tank Excavation had been accomplished had been left near a drainage ar - On Wednesday, July 3, complaint from a resident PCA had ordered the earlier this year. but the spoil material ea uncovered. The concern was that this material may erode into the surface water causing further pollution. On Wednesday, I contacted the Pollution Control Agency and City.Fire Inspector's office. Attached is a correction notice issued by Fire Inspector Stan Scofield advising Alpine Tree Apartments that all contaminated soil must be completely covered until an appropriate disposal method is found for the soil. Typically, in these cases there is some delay in identifying the method of disposal of the contaminated soil. (I-2) 3. COUNTY ROAD 73 -- Attached are materials related to County Road 73 which were provided to the Council in the March 9 and March 16 information memorandums. (I-3) CITY COUNCIL INFORMATIONAL MEMORANDUM JULY 6, 1990 PAGE 3 4. 1990 STREET RECONSTRUCTION -- The attached announcement and map was sent to residents in the four areas affected by Plymouth's 1990 Street Reconstruction Project on Tuesday, July 3. Work should be completed by mid- October. (I-4) 5. COUNTY ROAD 6 UPDATE -- The attached flyer and map was sent to residents on Tuesday, July 3, whose property abuts County Road 6, informing them of the County Road 6 project. (I-5) 6. 1990/1991 LEAGUE OF MINNESOTA CITIES DUES SCHEDULE -- Attached is the September 1, 1990 through September 1, 1991 dues statement for the City of Plymouth for the League of Minnesota Cities in the amount of $11,883. The dues must be paid by the first of January following the September 1 due date of the preceding year. Membership in the League of Minnesota Cities is a prerequisite for the city to participate in a League of Minnesota Cities insurance trust through which Plymouth presently receives its automobile and general liability insurance. (I-6) 7. 1991 DUES FOR THE ASSOCIATION OF METROPOLITAN MUNICIPALITIES (AMM) -- Attached is a memorandum from Larry Bakken, President of the AMM, concerning 1991 dues. The dues for Plymouth would be $6,333. A representative of the AMM is scheduled to make a presentation to the Council on this subject at the August 6 meeting. (I-7) 8. WASTE TRANSFER STATION -- The status report on Hennepin County's application for a Waste Transfer Station is attached. (I-8) 9. 1990 TRAVEL BEHAVIOR INVENTORY (TBI) - Attached is a letter and brochure from Steve Keefe, Chair of the Metropolitan Council concerning a survey of travel behavior which will be conducted in the seven county area this summer. Information collected from the survey will be used to update and revise travel forecasts which will have a major influence on decisions about transit and highway improvements that will affect the region's development for the 1990's and beyond. (I-9) 10. HOLNES & GRAVEN CLIENT SUMMARY -- Attached is a client summary from Holmes and Graven, Chartered, dated June 28, 1990. (I-10) 11. FOLLOW-UP ON COMPLAINT - Phillip Sykes, Community Tom Saba, responding to (I-11) - Attached is a letter from Service Officer, to Lieutenant complaint by Jeffrey Colyer. RTB ACTION ON MEDICINE LAKE LINES (MLL) BANKRUPTCY -- As the Council is aware, Medicine Lake Lines has numerous outstanding audits with the RTB and MnDOT, both for Plymouth Metrolink and other bus services. The RTB has authorized the consolidation of all actions against Medicine Lake Lines. In doing so, the RTB would collect the $150,000 the City presently holds of MLL money and MnDot, the RTB, and MLL would release any claims against the City. Negotiations were underway with respect to the specific language of the settlement. (I-12) 13. NEW EMPLOYEES -- John Tabery has been hired as the Property Management Coordinator. He brings to the City many years of experience caring for and maintaining buildings. Most recently he was the Manager of Building and Grounds for the Robbinsdale School District. In that capacity he supervised the building and grounds staff and developed long range plans for capital improvements. Prior to that he worked for the Golden Valley -Health Center as its facility manager. 14. CITY EMPLOYEES -- The following correspondence has been received on City employees: a. We are particularly concerned about the upcoming discussion of the 5 Year CIP and specifically the realignment of County Road 73 as it intersects with T.H. No. 55. As preparation for the adoption of the upcoming 5 Year CIP, the city requested a "transportation study". It is our feeling that such 'a study is premature for this area until the completion of I-394. It has been under construction for the past several years and as a result has altered, in some cases permanently, the driving patterns in this area. During part of this time County Road 73 was the designated detour for many of the traffic movements at the 394-169 interchange. There has been, understandably, great variation of traffic volumes during this time, making traffic volume prediction subject to much speculation. It is also our concern that if Co. Rd. 73 is realigned it will become a "speedway" between 394 and 55, since it is a straight roadway and speeds will tend to be higher than they should be through a residential area. And there is the potential for the same type of problems which currently exist on 26th Ave. No., where traffic will use what is now a residential street as a bypass for 169. The interchange at 394 and Co. Rd. 73 is not scheduled for completion until late 1991 and it would seem to be more appropriate to assess the traffic situation at such time as more normal traffic patterns are established after this completion. We therefore urge the members of the Plymouth City Council to delay the adoption of this portion of the CIP until a true need can be established. We believe the need for this roadway alignment will become even more apparent with the connection of County Road 73 with I-394. During the past several months there have been discussions between the City staff and the Robert Larson Partners, a group seeking to redevelop the Schiebe Shopping Center. The Larson Partners proposal, if it were to proceed, would likely accelerate the construction of the realigned County Road 73 segment. Whether or not the Larson group will proceed with their plans is not known; you will hear more about any proposal they may submit for planning review. I understand your basic concerns regarding the potential impacts of the realignment of County Road 73 on your home. I can assure you that if County Road 73 roadway is realigned we will work closely and cooperatively with you and others who may be affected so as to minimize adverse impacts. SUBJECT: CSAR 73 According to Gary Thompson, Mn/OOT Resident Engineer, the new CSAH 73 bridge over 1394 will be opened to trarric in the fell of 1990. Current scheduling calls for completion by November 15 at the latest. However, the permanent interchange ramps between 1394 and CSAR 73 may not be operational this fall because of possible construction delays, In that event temporary connections will be provided so that all interchange movements can be made. Several years ago preliminary concept layouts were drawn by our department ,showing a straightened connection on CSAH 73 between Sunset Trail and TH 53. These layouts showed CSAR 7$ extending straight north from Sunset Trail, then curving easterly to intersect TH SS at the existing CSAH 73 (South Shore Drive) intersection. Presumably due to low priority, this project has not appeared in our Capital improvement program (CIP), The currently approved 1990-94 CSP does not include a project at this location. PBM/DLH:gk P.S. Vern Genzlinger CIM j` i" u 6 X90 G\m-3itto Ma I- L/ L CITY OF PLYMOUTR 1990 STREET RECONSTRUCTION BEGINS JULY 2ND The City of Plymouth's 1990 Street Reconstruction project began Monday, July 2, work should be completed by mid - October. Work will affect four areas in Plymouth, including your neighborhood. To minimize the inconvenience this project causes, please review the following information: Short -Elliott -Hendrickson, Inc., (SEH), has been retained by the City to oversee the project. A resident project representative, Todd Blank, will be at the site throughout the project. Mr. Blank may be reached at the field office located between 23rd Ave. and 24th Ave. on East Medicine Lake Blvd. You may also contact project manager, Sue Mason, at 490-2018 if you have questions or concerns. The contractor, Hardrives, Inc., plans to begin construction on the streets adjacent to Pilgrim Lane (Districts 4 & 11) by repairing or replacing concrete curb and gutter, milling, and then following with total reconstruction on designated streets. All work in the area is scheduled to be done before school starts. The contractor will construct streets in the area east & west of County Road 101, north of 26th Ave., (District 10) concurrently with work in Districts 4 & 11. Work in District 10 includes milling, pavement repair, and total reconstruction. This should take four to six weeks depending on the weather. The contractor expects to move to the Medicine Lake area (District 8) by mid - August. Some activity will occur before August, such as utility pole relocation and tree removal. All work is to be completed by early October. The contractor is responsible for proper traffic control, signage, and overall project safety. Because of construction activity and increased truck traffic, we urge you to travel with caution through the work areas. At different times throughout construction, you may not be able to reach your driveway. You will be notified in advance of the occurrence. The City, SEH, and the contractor will try to minimize your inconveniences. We appreciate your cooperation to help make this a safe and successful project. Rd. 6 between Fernbrook Ln. and Co. Rd. 101 within the next week. While this project will cause inconvenience to residents, the County hopes to minimize it by keep- ing one lane of traffic open in each direction at all times and by providing access to all homes with driveways located on Co. Rd. 6. Plymouth city officials have worked with Hennepin County to ensure that as many trees as pos- sible are preserved. The County has already notified residents who have trees which will be af- fected by this project. This is a County project. But because the County has no plans to notify residents of the con- struction phases, the City of Plymouth is sending you this update. OVERALL PROJECT This project will include: • Widening Co. Rd. 6 to two lanes in each direction; • Creating turn lanes; • • Constructing medians at Dunkirk, Vicksburg, Shenandoah and Niagara Lanes; • Building a pedestrian underpass at Niagara Ln.; and • Converting Zanzibar Ln. to a cul-de-sac. Construction is expected to be completed by the fall of 1991 with sodding of affected areas and the laying of the final layer of bitumious slated for the spring of 1992. TENTATIVE SCHEDULE Week ofJuly 9: Preliminary work such as clearing out vegetation in the project area begins. Utility relocation continues. Following this work, temporary bitumious lanes will be laid to allow one lane of traffic in each direction to remain open during construction. Week of July 16: Stage 1 construction begins. Traffic will be moved to the northern lanes while crews construct lanes on the south. Stage 2: Construction of stage 2, the northerly lanes, will likely occur in the summer of 1991. Membership Services Legislative program The League represents all cities at the state Legislature and before state agencies and departments. The legislative program includes development of policies on issues which affect local government. Each member city receives the weekly Cities Bulletin during legislative sessions. The Bulletin keeps members informed of legislative activities. LMC is a member of the National League of Cities, which represents the local vie.; in Congress. Information services The League general counsel and research staff answer local government questions. Information memos on state and federal laws or applicable technology are available. The League has use of an extensive library of ordinances, city charters, and literature on local government. LMC updates the Handbook for Minnesota Cities each year. It is a comprehensive and authoritative work, covering all aspects of city government. Magazine All member -city officials receive Minnesota Cities, a monthly publication for and about cities, which contains articles on issues and problems of concern to city officials. Conferences The League holds an annual'conference for city officials to discuss concerns and elect officers. Regional meetings in the fall give city officials a chanceJo exchange ideas and information. An annual legislative action conference, for discussing legislation, takes place during each legislative session. A policy adoption meeting takes place in November. Training LMC participates in the Government Training Service, which provides training programs for city officials. The League sponsors special conferences and seminars on specific problems and issues. Field service A field representative visits member cities on a continuing basis to assist with local problems, and to collect materials to share with other cities. Insurance Through the League of Minnesota Cities Insurance Trust (LMCIT), the League offers workers' compensation, proper- ty/casualty, group health, and group dental coverage to member cities. Directory of city officials The Directory of Minnesota Municipal Officials is an annual list of eluted officials and department heads in every city. The directory includes population, state legislative and congressional districts, form of government, council meeting day, and city hall telephone numbers. CLEAR The City Lawyer Exchange Aid and Repository is a service to subscribing city attorneys providing legal research and assistance, and a brief bank to track municipal law in Minnesota courts. MAP The Municipal Amicus Program offers support to cities that are involved in litigation that may have significant statewide impact on Minnesota's cities. Equipment loan program The League sponsors a program to provide cities with low-cost funds for equipment purchases. 4M Fund The League -sponsored Minnesota Municipal Money Market Fund ('the 4M Fund') offers a short-term investment alternative to cities. Cit § t,�` `L U 6 s90 JL July 2, 1990 TO: James Willis — City Manager jut � Gi1Y a P1.�N1011�N 1-7 RE: 1991 DUES FOR THE ASSOCIATION OF METROPOLITAN MUNICIPALITIES (AMM) The AMM Board, in accordance with the By—Laws, is responsible for establishing the Annual Budget and Work Program and setting the corresponding membership dues rate. The process for 1991 is more complicated due to the impact of the recommendations contained in the final report of the Mission and Membership Services Task Force which you recently received under separate cover. The Board voted at the June 28th Board Meeting to recommend implementation of the major Mission Task Force recommendations. Implementing the major Task Force recommendations, including the additional staff person has a total cost of about $38,000 which would result in a 19% dues increase for member cities over the 1990 dues paid. Consequently, the 1991 AMM dues for Plymouth based on this decision would be $6,333 and I would ask you to use that amount when preparing your 1991 budget. The Board recognizes that this is a large increase but believes it is essential for several reasons detailed in said report including the following: 1. The need for the AMM to become more proactive and visible in helping set the metropolitan agenda. We need to be 'there' to represent the AMM member cities adequately at the Council. We need to have a staff.person there 12-15 hours per week. Increased responsibilities at the legislature have made it impossible for our small staff to maintain that kind of commitment. 2. The AMM also needs to increase its presence at the State Legislature. The AMM has been 'spread to thin' with the number of policy issues involved and with outstate groups promoting tax policies detrimental to the collective interests of metropolitan area cities, the AMM staff needs to increase the amount of time it can spend 'one-on-one' promoting AMM policy positions. If the AMM is to achieve the status of being recognized as the organization that speaks and represents the collective interests of metropolitan area cities, it is important that the association increase its visibility in the eyes of the Legislature, City Officials, the general public and the Metropolitan Council. An enhanced public relations system must be implemented and this cannot be done effectively without an additional staff person. A dues increase of such magnitude however, requires membership approval and there will be a special AMM Membership Meeting on Thursday evening September 6, 1990 to vote on this matter. (a two/thirds majority of those present and voting is required for approval). It is intended that the new staff person would handle a lot of the enhanced communications and public relations effort thereby 'freeing -up' the Director of Legislative Affairs and the Executive Director for more 'one-on-one' contact at both the metro and state levels. A back-up budget based on a work program and staffing level similar to our 1990 level of activity and effort has also been prepared in case the 19% dues increase is not approved at the membership meeting. W' is ity FROM: Charles E rud, Manager Community Development Coordinator SUBJECT: HENNEPIN COUNTY APPLICATION FOR WASTE TRANSFER STATION (89057) On July 23, 1989 Hennepin County made application for a Conditional Use Permit to construct a solid waste transfer station at the northeast corner of County Road 6 and I-494, pursuant to Section 9, Subdivision D. of the Zoning Ordinance (Hazardous Waste Facilities Conditional Uses). Development Review Committee review of the application commenced immediately together with activity to retain a qualified consultant to review the application on behalf of the City of Plymouth, as the Ordinance specifies. It should be noted that the review by the outside consultant is at the expense of the project applicant. On August 29, 1989, we drafted a letter to Hennepin County reviewing 35 items that are in need of modification; additional clarification; or additional information. These review comments were only the result of review by the City of Plymouth staff and usual retained utilities and traffic consultants. On July 24, 1989, we advised Hennepin County that the City of Plymouth had selected Black and Veatch, Kansas City, to be the consultant that would review technical aspects of their application on our behalf. On August 4, 1989, Hennepin County delivered the necessary financial deposit and authorization to proceed with the review of the application by the outside consultant. On August 10, 1989, we instructed Black and Veatch to proceed with their review. Black and Veatch completed their review and on October 18, 1989, we transmitted a copy of the Black and Veatch report, together with a list of 34 additional design -related items requiring additions, modifications of clarifications related to plans that had been submitted by Hennepin County for this facility. These additional design review items were generated from the report presented by Black and Veatch. The project remains in Stage 2 of the development review process, and cannot proceed until the applicant has provided responses we have requested. I also recall the incident with Mr. Colyer quite clearly. I frequently patrol Parkers Lake Park for animal control as well as parking in the restricted zones. Most often I issue a verbal warning to people parked incorrectly and a verbal warning accompanied by a "Pets in Plymouth" pamphlet to people in the park allowing their dogs to run off the leash. Most people are understanding of the ordinance and are quite willing to comply once they know they are in violation. However, in the case of Mr. Colyer, he was unwilling to listen to what I had to say from the start. As a matter of fact, as I was approaching him on the dock, Mr. Colyer initiated the conversation saying, "What ... you mean I have to have my dog on a leash even here?". The incident started as I turned into the boat launching area and observed a vehicle parked in the restricted zone. I performed the usual checks on the vehicle and determined that the owner did not have any warrants, etc., so I proceeded to do a quick check of the area to find the driver and have him move his vehicle. If I had not found the driver, he would have been citationed. As I went around the berm and could see the boat launch area, I observed a man and his wife sitting on the dock with their two dogs running loose, the two people and the dogs were obviously in the way of the people trying to launch their jet ski's from the dock, and the dogs were jumping up on people. As I exited the vehicle to speak to the two people, not yet identified as the car owner, one of*the dogs ran up to me barking and causing the other dog to start barking at people as well. As I approached the man•, he got up and started to come towards me, and made the above stated comment. I then asked him if the two dogs belonged to him and whether the car parked in the restricted zone also belonged to him. I tried to explain to Mr. Colyer that he was in violation of the ordinance pertaining to dogs being at large, and I also explained to him about the parking restrictions. I did in fact say "you came this close (gesturing with my fingers) to getting a citation for parking in a restricted zone", trying yet again to impress on Mr. Colyer that Plymouth enforces their ordinances, and that he was in violation. wo J,;} 06 '90 Page 2 My main objective was for Mr. Colyer to regain control of his animals, gather his belongings and move his vehicle from the restricted parking area in a timely manner, reminding him of his responsibility to obey the various ordinances described above. Mr. Colyer was immediately defensive when he saw the CSO vehicle, and acted as if he felt his violations should be overlooked. Upon returning to the hall after this, I did relate the incident to Services Supervisor Correll. As I only issued a verbal warning to Mr. Colyer, as I had done to several people that day at the park, I logged the contact as a 66, miscellaneous enforcement from 1611 hours to 1630 hours. Since we did not have our dogs leashes with us, we were holding them on the dock. In addition, we had parked next to our friends in the trailer parking zone. As a result, my wife and 1 were in violation of the "leash law" and were parked in the lot restricted to cars with trailers. However, we were in control of our dogs and there were several parking spaces still available for people with boat trailers. We had been watching our friends jet ski for approximately five minutes when the community service officer approached the dock and lectured us about keeping a leash on our dogs. In addition, he stated, "you came this close (gesturing with his fingers) to getting a citation for parking in a restricted zone." Although the community service officer was correct in both instances, my wife and I thought his response was over -reactive and down right rude. It was our first visit to the park on Parker's Lake and would have placed the dogs in the car and parked the car in a different location if he had just asked us to do so. The reason for this letter is not necessarily to criticize the community service officer for his actions but to have him "lighten up" when indicated by the circumstances. The proposed settlement is predicated on the condition that the Minnesota Department of Transportation (Mn/DOT) give up any claim against the City of Plymouth. Finley moved and Caranicas seconded: That the Regional Transit Board authorize the executive director to negotiate and enter into a settlement agreement with the Medicine Lake Lines Bus Company on the condition that prior to execution of that agreement a fully executed agreement between the Medicine Lake Lines Bus Company and the Minnesota Department of Transportation is received, which provides a waiver by Mn/DOT of all claims or rights to payments against the City of Plymouth provided that MLBC assigns all rights it has against the City of Plymouth the the Regional Transit Board. A resident of the 4350 Building is keeping three dogs in her unit. This woman allows those dogs to piss in the elevator and to poop near the entrance. The board of directors has sent her a registered letter informing her that she must remove those dogs from the condomin- ium. The trouble is that the woman has refused to sign the receipt for the letter: we're still plagued by those undisciplined dogs. As a member of the Buildings and Grounds Committee, r'm eager to find a solution to this problem; A resident an my building told me that there is a solution. She said that Plymouth has a "kennel ordinance" that prohibits a resident of Plymouth from keeping three or more dogs in a household. She said that, upon a complaint from me regarding these dogs, the animal control officer would come to Trenton Place, seise the dogs, take them to the Plymouth pound, and then bill the owner of them for their board. So, I thought would take the opportunity to respond to your July 1 letter. I Your letter states that a resident in the 4350 building of the apartment complex is keeping three dogs. Moreover, you indicate that she has failed to cleanup after the animals. For your information, I am attaching a copy of the City's Animal Control Ordinance. The ordinance provides that no more than two dogs over the age of 6 months old may be kept unless the owner has secured a kennel license. A kennel license may only be obtained for households located in the FRD zoning district. The area you speak about is not designated as FRD. Therefore, no more than two dogs will be allowed on the site. From experience, we find that the most effective means of dealing with these kinds of problems is directly between tenants or homeowners. Once these informal means fail, then it is appropriate for the City to get involved. Accordingly, I am attaching a copy of the publication "Pets in Plymouth" with a suggestion that you speak with the individual directly and advise her of the City's requirements. You may also wish to share a copy of the ordinance with her. Q '9Q Z-1 S c., Plymouth City Code 915.01 (Rev. 1988) Section 915 - Animal Control 915.01. Definitions. Subdivision 1. For purposes of this Section, the terms defined herein have the meanings given them. Subd. 2. "Owner" means any person owning, keeping, harboring or having custody of a dog or other animal within the City (Amended, Ord. No. 88-26, Sec. 1) Subd. 3. "At Large" means off the property of the owner and not under restraint of the owner or a member of the owner's immediate family. Subd. 4. "Under Restraint" means controlled (i) by a fence, leash or owner's command within the confines of the owner's property or (ii) by a leash not exceeding six feet in length while outside of the owner's property and under the control and direction of the owner or a member of the immediate family, so as to be as effectively•restrained, or (iii) within a vehicle that is enclosed sufficiently so as to prevent the animal from exiting the vehicle. (Amended, Ord. No. 85-30, Sec. 1; Ord. No. 88-26, Sec. 2) Subd. 5. Subd. 6. "Dangerous Animal" means any animal which has attacked, molested, bitten, confined or assaulted a person or domestic animal, or which otherwise has demonstrated that it poses a significant risk of causing harm or injury to persons or domestic animals. (Added, Ord. No. -85-30, Sec. 1; Amended, Ord. No. 88-26, Sec. 3) Subd. 7. "Wild Animal" means any ape, including chimpanzee, gibbon, gorilla, orangutan, or siamang; baboon, bear, bison, bobcat, cheetah, crocodile, coyote, deer, including all members of the deer family such as elk, antelope and moose, elephant, ferrett, fox, hippopotomus, hyena, jaguar, leopard, lion, lynx, monkey, ostrich, puma, also known as cougar, mountain lion or panther, rhinocer- os, a snake which is poisonous or non -indigenous, or any constrictor snake, snow leopard, tiger, wolf, or other animal that is wild, ferocious, or vicious by nature, habit, disposition or character. (Added, Ord. No. 88-26, Sec. 4) 915.03. Abandonment. it is unlawful for any person to abandon a dog or other animal within the City. 915.05. Licenses. Subdivision 1. License Required. No person shall own, harbor, keep or have custody of a dog over six months of age within the City, unless a current license for the dog has been obtained and the tag affixed as herein provided. Subd. 2. Duration of License, Licenses shall be issued on an annual basis and shall be made for the whole or unexpired portion of the year ending on il��, December 31st next following the first effective day of license. JUL 06'90 Plymouth City Code 915.05, Subd 3 (Rev. 1988) Subd. 3. License Fees; Amount. The license fee for each dog shall be as provided in Chapter X. The fee shall be waived if the license is obtained during the month of January of each year. Subd. 4. Late -License Penalty Fee.• If the license is obtained while the dog is impounded by the City, there shall be added to the regular license fee a late -license penalty as specified in Chapter X. Subd. 5. Issuance of Licenses; Veterinarian's Certificate to Accompany Application. All licenses shall be issued by the City Clerk or Police Depart— ment personnel, and applications therefor shall be accompanied by a certificate issued by a veterinarian licensed to practice in the State of Minnesota, showing that the dog has been vaccinated against rabies within a period of two years preceding the application for a license. (Amended Ord. No. 83-15, Sec. 1) 915.07. Tags. Subdivision 1. Issuance of Tag; Content; Registry. The City Clerk shall provide and furnish for each licensed dog a metallic tag upon which there shall be stamped or engraved the register number of the dog, the word "Plymouth" and the year when licensed. The City Clerk shall keep a registry of the dogs so licensed and said -registry shall contain the name and address and phone number of the owner, a description of the dog, and the number of the license. (Amended Ord. No. 83-15, Sec. 2) Subd. 2. Replacement of Lost Tags; Procedure; Fee. If any license tag is lost or stolen, the owner may obtain a new tag by surrendering the receipt for the first tag or by other proof of the fact that the dog has been previously licensed and by paying the fee provided in Chapter X. Subd. 3. Use of Tag and Collar. Every owner shall place and keep around the neck of the dog a collar on which the current license shall be securely fixed. Subd. 4. Counterfeiting or Transferring the Tags Prohibited. No person shall counterfeit any such license tag or use a counterfeit tag. A license tag is not transferable to any other animal nor to a new owner of a dog with respect to which such tag was issued. 915.09. Kennels. Subdivision 1. Kennel Licenses. No kennel license or renewal shall be issued except upon action of the City Council following review of the kennel license application by the Director of Public Safety and Planning Commission. (Amended, Ord. No. 85-30, Sec. 2) Subd. 7. Display of License. Persons granted a kennel license shall be issued a certificate which must be conspicuously displayed at the kennel loca- tion. Failure to display such certificate shall constitute prima facie evidence that the license has not been secured. 915.11. Dogs Prohibited from Running at Large. Subdivision 1. General Rule. No owner of a dog shall permit it to be at large within the City. Every owner of a dog shall keep it under restraint at all times. (Amended, Ord. No. 85-30, Sec. 3; Ord. No. 88-26, Sec 5) Subd. 2. Certain Animals. No owner shall allow a female dog in heat or a dangerous animal to be at large anywhere within the City. (Amended, Ord. No. 85-30, Sec. 3; Ord. No. 88-26, Sec. 6) Subd. 3. Impoundment of Dangerous Animals. The Director of Public Safety is hereby authorized to impound any dangerous animal found within the City. (Amended, Ord. No. 85-30, Sec. 3; Ord. No. 88-26, Sec. 7) 915.13. Public Nuisances; Abatement of Nuisance; Notice of Violation. Subdivi- sion 1. General Rule. No person shall own, keep or loud and fredisturbance or annoyance to persons residing in the vicinity thereof. Subd. 2. Clean-up. No owner shall vermit his dost to damage or foul any, lawn, garden or other property. An owner shall have the responsibility of cleaning up any feces ot the animal -and -to dispose of such feces in a sanitary manner. Subd. 3. (Repealed, Ord. No. 87-33, Sec. 1) Subd. 4. Notice. Upon the receipt of a written complaint of such annoy- ance by two or more persons residing in the vicinity of such a dog, the Chief of Police shall notify the owner to abate the nuisance within 48 hours. Failure to obey such notice shall be a violation of this Section.
