HomeMy WebLinkAboutCity Council Resolution 1997-778• CITY OF PLYMOUTH RESOLUTION 97-778 APPROVING A CONDMONAL SSEC)SE PERNUT LOCATED AT 12001 ST�AFTE STATEfi HIGHWAY ELECTRONICS (97151) WHEREAS, Corporate Real Estate, Inc. has requested a conditional use permit to allow a 39.75 -foot high cold box for nitrogen processiug plant where 20 feet is the maximum height for accessory structures for the Honeywell SSEC facility in the B -C (Business Campus) Zoning District on property legally described as follows: Lnt I. Block I. Honeywell Solid State Division, Hennepin County, Minnesota WHEREAS, the Planning Commission has Public Hearing and recommends approval; reviewed said request at a duly called NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does � ove the request by Corporate Real Estate Inc. for a conditional use Permit the maximum height for accessory structures for Honeywell SSEC, subject to the following conditions: 1. The Conditional Use Permit is to allow a nitrogen processing plant with 939.75- foot high cold box accessory to permitted used in the B -C zoning district, according to the plans received by the City on November 18, 1997, except as amended by this resolution. 2, The color of the cold box shall be approved by staff prior to installation. 3. The additiottal tAndscaping proposed west of the nitrogen plant and east of the wetland shall be planted in the spring of 1998. • n Resolution 97-778 (97151) Page 2 4. All damaged drive aisles and fire lam must be repaired t) fire lane construction standards. 5. Visibility and fire accts. to post indicator valves, hydrants and fire department connections shall not be obstructed. 6. The nitrogen plant and tanks must comply with all building and fire code requirements. 7. The operation of the nitrogen processing plant must comply with all MPCA noise standards. B. The applicant shall submit a revised plan adding acoustical materials inside the screening wall to provide additional sound attenuation, for review and approval of staff prior to issuance of building permits. 9. Standard Conditions: a. Compliance with the City Engineer's Mem^random. b. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. Compliance with the Ordinance regarding the location of fine hydrants, post indicator valve, fie department connection, fire lanes, and fire lane signage prior to issuance of building permits. e. An 8 1/2 x 11 inch "As Built" Fire Protection Platt shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. U This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of ire Zoning Ordinance.
