TO OPERATE AN INDOOR RECREATIONAL FACQ.iTI' (SKATE PARK) AT 2735 CHESHIRE LANE NORTH (97164) WHEREAS, Legacy, Inc. has requested approval of a couliticnal use permit to operate a skate park at 2735 Cheshire Lane North. The property it more specifically described as Lot 8, Block 11 Industrial Park 494, Hennepin County, Minnesota; and WHEREAS, the planning Commission has reviewed said 7equest at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, b9NNFSOTA, that it slwuld and hereby oes approvonal e the request by Legacy, Inc., based on the finding that all the applicable permit standards are met, and subject to the following coudittons: 1. The conditional use permit allows operation of an indoor recreational facility (skate park) in an 8,160 square foot lease -space at 2735 Cheshire Lane North, in accordance with the revised plans received by the City on November 24, 1997, except as amended by this resolution. 2. Membership to the skate park facility may be offered, but cannot be a requitement pursuant to the definition of an indoor recreational facility provided by the Zoning Ordinance. 3, prior to issuance of the required building permits and occupancy of the site, the applicant shall enter into a Site improvement Performance Agreement for the required site improvements, including but not limited to, striping of the parking lot areas on the north and south sides of the building and construction of a accessible ramp to the main entrance. Prior to issuance of the required building permits, the applicant shall submit a revised parking pian which eliminates the spaces that conflict with the entrance drive, wick loading and muteuver ft areas, other parking spaces, and dumpater. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. S. The permit is subject to all applicable codes, regulations and ordinances, am violation thereof shall be grounds for revocation. 6. Any signage shall be in compliance with the Sign Ordinance. 7. This approval shall expire one year ager the date of approval, unless the property owner or applicant has sorted the project, or unless the landowner or applicant his received prior approval from the City to extend the expiration date for up to one additional ye-ar, as regulated under Section 21015.07 of the Zoning Ordinance.
