CITY OF PLYMOUTH
RESOLUTION NO. 97 - 771
AUTHORIZING THE VACATION OF
DRAINAGE AND UTILITY EASEMENT AND EASEMENT RIGHTS FOR
UTILITY PURPOSES OVEk AND ACROSS CARLSON COMPANIES
ADDITION NOW KNOWN AS CARLSON CENTER SECOND ADDITION
WHEREAS, a petition was received to vacate drainage and utility easement and easement rights
for utility purposes over and across Carlson Companies Addition now known as Carlson Center
Second Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearirg with respect to said vacation was scheduled for December 17,1997
in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
L.tc meeting of Decembc. 17, 1991; and
WHEREAS, all property ownets adjacent to the proposed vacation were duly notified by mail;
and
WHEREAS, the Council did hold a public hearing on D cember 17, 1997 to inform any and all
interested parties relevant to the vacation of drainage and utility easement and easement rights
for utility purpows over and across Carlson Companies Additior. now known as Carlson Center
Second Addition; and
WHEREAS, it was determined by the City Council that said easements were not needed for
public purl.oses;

easement rights for utility purposes created by Document No.'s 4489750 and 4557127 be
vacated:
A. The drainage and utility easements over, under, and across the following
described property:
That part of the dnsieage and utility easements as dedicated and delineated on
the plat of CARLSON COMPANIES ADDITION described as follows:
That part of the westerly and southwesterly 10.00 feet of Lot 1, block 2,
CARLSON COMPANIES ADDITION embraced within Lot 1, Block 1,
CARLSON CENTER SECOND ADDITION and that part of the
northeasterly 10.00 feet of Lot 1, Block 3, CARLSON COMPANIES
ADDITION embraced within Lot 1, Block 1, CARLSON CENTER
SECOND ADDITION.
B. All of the reserved easement rights set forth in City Council Resolution No's
79-149 and 79440, as recorded in the office of the County Recorder for
Hennep+n County as Document No's 4489750 and 4557127.
Adopted by the City Council on December 17,1997.
