RESOLUTION NO. 97 - 763
REQUEST FOR PAYMENT NO.6 AND FINAL
12"' AVENUE IMPROVEMENTS
CITY PROJECT NO. 5023
WHEREAS, the City of Plymouth as owner and Ryan Contracting, Inc., as contractor,
have entered into an agreement for 12" Avenue Improvements, City Project No. 5023,
said agreement being dated July 24,1996; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was 1139,531.25. Two Change Orders
were approved in the amount of $22,314.00. The value of the work to date
is 1156,566.76 and is herewith approved. This project underran the
revised contract amount by 15,278.49 or 3.3%.
2. That the work performed by the contractor for 121 Avenue Improvements
and certified to the Council by the engineer as acceptable, being the same,
is hereby released from the contract except as to the conditions of the
performance bond, any and all legal rights of the owner, required
guarantees and correction of faulty work after final payment.
3. Request for Payment No. 6 and Final in the amount of 112,950.94 to Ryan
Contracting, Inc. for the 12a Avenue Improvements Project is hereby
approved and the City Finance Director is hereby authorized and directed
to pay the same forthwith.
