VtOPERTY LOCATED ON 4r AVENUE EAST OF NATHAN LANE (97172) WHEREAS, Ryan Companies US, Inc. has requested approval of a site plan and variance from the maximum impervious surface area coverage in the Shoreland Management Overlay District for property legaR- described as follows: That part of Lots 1 and 3. Meyer Gonyea Addition lying west of a line drawn parallel with and distant 44.00 feet west of the west line of Lot 2, said Block 1 and its southerly extension and lying north of the north line of I at S. said Block 1 and its easterly extension, according to the plat thereof on file .and of record in the office of the County Recorder in and for Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Ryan Companies US, Inc. for a site plan and variance from the maximum impervious surface area coverage in the Shoreland Overlay Management District for a an office building for Employers Association, Inc., subject to the following conditions: 1. This site plan is for construction of an office building approximately 30,000 square feet in size, as shown on plans received on November 24, 1997 and December 2, 1997, except as amended by this resolution. 2. An indoor trash enclosure must be identified on the plans and approved by staff prior to issuance of a building permit. • 11 Resolution 97-750 Page 2 3. The required turning radius in the parking lot must be maintained from all directions. 4. The fire lane must remain unobstructed the full width and height of the fire lane. All landscaping must be kept clear in this area. 5. Prior to issuance of building permits, a revised landscape plan must be submitted for review and approval by staff. 6. A variance it approved for 70 percent impervious surface area coverage where 25 percent is permitted in the Shoreland Management Overlay District, based on the following findings: a. Because of the particular physical surroundings. shape or topographical conditions of the specific parcel of land involved a pardrrtar hardship to the owner would result if the strict letter of the regulations to be tamed out. The shomland ordinance is intended to Xmrve and enhance the quality of surface waters, but Lost Creek has been piped and redirected and no longer meets the intent of the shomland ordinance. Water quality impacts would be limited by construction of water treatment and retention ponds on the site. b. The conditions upon which the variance is requested are unique to this property and are not applicable to other property within the same zoning district. This development was platted prior to adoption of the shoreland ordinance and development of this parcel consistent with the current shoreland regulations woulo be difficult due to the frct that 3.26 acres of this 4.42 acre site are located within the Shoreland Management Overlay District. c. The purpose of the variance is not based exclusively upon a desire to increase the value or income potential of the parcel of land. d. The hardship is caused by this Chapter and has not been created by persons having an interest in the pawl of land. Lost Creek is a piped waterway and does not meet the intent of the shoreland ordinance which aims to protect end enhance burface waters. e. Granting the variance will not be detrimental to the public welfare or igjuriuus to other land or improvements in the neighborhood in which the parrel of L ad is located. f. The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the c -igestion of the public streets, or increase the danger of fire, or endanger the public safety, ori substantially diminish or impair property values within the neighborhood. 0 • Resolution 97-750 Page 3 g. The requested variance is the minimum action required to eliminate the whip. 7. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Compliance with Policy Resolution 79.80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open stoito water drainage facility. d. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. e. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E Compliance with the Ordinance regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage prior to issuance of building permits. g. An 8 112 x 11 inch 'As Built' Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. b. Compliance with regulations regarding handicapped parking spaces and access. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially smtted construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, ac regulated under Section 21045.09 of the Zoning Onlinance.
