FOR PLYMOUTH STATION FOR PROPERTY LOCATED SOUTHEAST OF THE INTERSECTION OF HIGHWAY 55 AND COUNTY ROAD 24 (97145) WHEREAS, Hans Hagen Homes, Inc. has requested approval of a Preliminary and Final Plat for property legally described as follows; and Outlot G, SEVEN PONDS SECOND ADDITION, Hennepin County, Minnesota together with that part of vacated County Road No. 24 per Doc. No. 6755196 accruing to said property and together with That part of the North Half of the 66 foot wide vacated Medina Road per Doc. No. 2550687 as originally platted in SEVEN PONDS SECOND ADDITION, Hennepin County, Minnesota lying easterly of a line described as beginning at the most easterly comer of Outlot H, said SEVEN PONDS SECOND ADDITION; thence southerly perpendicular with the south line of said Outlot H to the center line of Medina Road and there terminating and lying westerly of the southwesterly continuation of the southeasterly line of Outlot G said SEVEN PONDS SECOND ADDITION. Outlot B, Seven Ponds Second Addition, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County. That part of the South half of vacated Medina Road, as dedicated in the plat of Seven Ponds Second Addition and delineated within a strip 66 feet in width adjoining Oudots 8 and G, in said plat, which lies between the Southwesterly continuation of the Southeasterly line of Outlot 0, in said plat and a line drawn Northeasterly peTendicular to the Northeasterly line of Block S in said plat, from the most Easterly corner of said Block S. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. UNCIL OF NOW, 'THEREFORE, BE IT HEREBY ItESOLBY approveTY ove the request by by CITY OF PLYMOUTH, MINNESOTA, that it should and hereby doe 0 Resolution 97-723 (97145) Page 5 Hagen Homes, Inc. for a preliminary and final plat and development contract for Plymouth Station for property located southeast of the intersection of Highway 55 and County Road 24; and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. A Preliminary and Final Plat is approved for the creation of two lots and one outlot, in accordance with the plat and plans received by the Cit. on September 19, 1997, except as amended by this resolution. 2. Covenants regarding cross acus, parking and fire access shall be submitted for staff review and shall be filed with Hennepin County prior to issuance of building permits. 3. The City will deed Outlot D of Dunkirk Meadows to the developer in exchange for the required Medina Road right-of-way east of Dunkirk Lane. 4. The developer is responsible for the relocation of all private utilities within the vacated right- of-way of Old County Road 24 and Dunkirk Lane and Medina Road. All relocated utilities shall be underground. 5. The Plat shall correctly show the MnDOT right-of-way. 6. A MnDOT storm water drainage permit may be required. The site should maintain existing drainage patterns and rates of runoff. Approval from the Army Corp of Engineers, Minnesota Department of Natural Resources ind the Minnehaha Creek Watershed District may be needed. 7. There shall be no driveway access to Medina Road, County Road 24 or Highway 55 except for the drives as shown on the PUD general plan dated August 5, 1997. S. Plan and profile sheets will be required for the storm sewer adjacent to Highway 55 along wide drainage calculations for review and approval. 9. Standard Conditions: a) Compliance with the City Engineer's Memorandums. b) Submission of a Site Improvement Performance Agreement prior to issuance of building permits. • • Resolution 97-723 (97145) Page 6 c) Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new Structures on sites adjacent to, or containing any open storm water drainage facility. d) Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e) Park dedication fees shall be cash Peas in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuar,A. f) Access shall be restricted from Highway 55 and Garland Lane. g) The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. h) No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. i) Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat.
