RESOLUTION 97-721
APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOP NORTH COUNTRY
PROPERTIES FOR NORTH COUNTRY ESTATES LOCATED SUI . ' OF SOUTH SHORE
DRIVE, EAST OF THE CITY OF MEDICINE LAKE AND WEST OF BASSETT CREEK

WHEREAS, North Country Estates has requested approvai of a final Flat for North Country
Estates, a plat for three single family lots on a 4.7 -acre parcel located south of South Shore
Drive, east of the City of Medicine Lake and west of Bassett Creek; and
WHEREAS, the City staff has prepared a development contract covering the improvements
related to said plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the final plat and
development contract for North Country Estates located south of Souih Shore Drive, east of the
City of Medicine Lake. and west of Bassett Creek; an4.
FURTHER, that the development contract for said plat be approved, and that the Mayor and City
Manager be authorized to execute the development contract on behalf of the City; and,
FURTHER, that the following conditions be met prior to recording of, and related to said plat:
1. Final plat approval is hereby granted for North Country Estates in accordance %4th the plans
received by the City on October 16, 1997, except as amended by this resolution.
2. The developer shall provide the City with a trail easement over the northerly twelve (12) feet
of Lots 1, 2, and 3.
3. The minimum front yard setback shall be thirty-five (35) feet.

4. Development of the subdivision shall comply with the City's Tree Preservation Ordinance.
5. Buffer monuments shall be placed in accordance with Zoning Ordinance Section 21670.07.
6. The developer must obtain all necessary permits from the DNR and Bassett Creek Watershed
District prior to installation of the water main.
7. The applicant shall verify at the time of building permit application that the lowest floor
elevation is at least two (2) feet above the 100 -year flood elevation
g. Soil borings shall be required prior to building permit issuance.
9. The developer shall extend municipal water to all lots and to the westerly lot line of Lot l .
10. The total impervious surfaces on each lot may not exceed twenty-five (25) percent.
11. A fire hydrant shall be installed at the westerly lot line of Lot 1.
12. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Removal of all hazardous trees from the property at the owner's expense.
C. No building permits shall be issued until a contract has been awarded for
the extension of water services.
D. Compliance with Policy Resolution 79-90 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.
E. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
F. Submittal of required utility and drainage easement documents as approved by
the City Engineer prior to filing the final plat.
G. The Developer sha!1 hold the City and its officers, employees, and agents
harmless fiom claims made by itself and third parties for damages sustained or
costs incurred resulting from plat approval and development. The Developer shall
indemnify the City and its officers, employees, and agents for all costs, damages,
or expenses which the City may pay or incur in consequence of such claims,
including attorneys' fees.
H. Payment of park dedication fees -in -lieu of dedication in accordance with
the Dedication Policy in ef°ect at the time of recording the final plat.

J. No Zoning Ordinance Variances are granted or implied.
