TO EXTEND THE HOURS OF OPERATION TO 24 HOURS A DAY FOR THE HOLIDAY GAS/CONVENIENCE STORE LOCATED AT THE SOUTHWEST QUADRANT OF SCHMIDT LAKE ROAD AND HIGHWAY 169 (97153) VIHEREAS, Holiday Stationstores, Inc. has requested approval of a conditional use permit to extend the hours of operation to 24 hours per day for the Holiday gas/convenience store located on property legally described as follows: Lot 1, Block 1, Epiphany Second Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval of the conditionrl use permit for Holiday Stationstores, Inc. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Holiday Stationstores, Inc. for a conditional use permit, subject to the following conditions: 1. The permitted hours of operation for this use shall be 24 hours per day. 2. The operation shall be responsible for litter control within 300 feet of the premises, and litter control is to occur on a daily basis. Trash receptacles must be provided on site at convenient locations to facilitate litter control. 3. The applicant shall submit a revised lighting plan prior to issuance of a certificate of occupancy. Additional lighting in conformance with the zoning ordinance shall be provided near the intersection of the driveway and Schmidt Lake Road. 11 Resolution 97-720 (97153) Page 2 4. Standard Conditions: a Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. b. This approval shall expire one year after the dal : of approval, unless the property owner or applicant has substantially a rated construction of the project, or unless the landowner or applicant has receiv. A prior approval ftom the City to extend the expiration date for up to one additional year, as regulated undar Section 21045.09 of the Zoning Ordinance.
