CITY OF PLYMOUTH
RESOLUTION 97-707
APPROVING PRELIMINARY PLAT FOR LAURENT BUILDERS, INC. FOR
SILVERTHORNE a ADDITION, LOCATED SOUTH OF THE SOO LINE RAILWAY,
WEST OF FERNBROOK LANE, AND EAST OF VICKSBURG LANE (97133)
WHEREAS, Laurent Builders, Inc. has requested approval of a Preliminary Plat for Silverthome
41 Addition, containing 90 single family lots and six outlots on 60.04 acres located south of the
Soo Line Railway, west of Fembrook Lane, and east of Vicksburg Lane; and
WHEREAS, the property is legally described as Outlot F, Silverthome; and
WHEREAS, the Planning Commission has reviewed said request at, auly called Public Hewing
and recommends approval.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Laurent
Builders, Inc. for a Preliminary Plat for Silverthorne 4' Addition, subject to the following
conditions:
1. This Preliminary Plat approves 90 single family lots and six outlots, in accordance with the
plans received by the City on October 31, 1997, except as amended by this Resolution.
2. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits.
3. Prior to the issuance of building permits, wetland buffer monutnents shall be installed in
accordance with Section 21670.07 of the Zoning Ordinance for the undisturbed low quality
wetland and medium quality wetland (creekbed) located in the western portion of the site, as
well as for the high quality wetland located to the east of the site. The monument design
shall be approved by the Community Development Department.

4. Payment of park dedication fees -in -lieu of dedication in combination with the appropriate
credit in an amount determined according to verified dedication acreage, in accordance with
the Dedication Policy in effect at the time of recording the Final Plat.
S. The developer shall construct a five-foot wide concrete sidewalk along the north side of
Schmidt Lake Road. The sidewalk shall extend from the west line of the plat to the west line
of Oudot C. Notice of the sidewalk and corresponding 10 -foot wide easement shall be
included in the development/sales documents so that potential buyers will be aware of the
sidewalk.
6. The Final Plat submission shall include a 25 -foot wide trail easement in the area of the
existing power line easement. This trail easement shall be centered on the north/south lot
lines running through this area. Notice of the trail easement shall be included in the
development/sales documents so that potential buyers will be aware of the possible future
trail for this location.
7. The deed for Oudots A. D, E, and F shall be given to the City prior to filling the Final Plat.
8. The applicant shall provide notification and information about the park to the buyers of Lot
2, Block 2 and Lot 1, Block 3 which abut the access to the future park.
9. Upon commencement of grading activities, the applicant shall place a sign on Oudot A to
inform people of the future park and park entrance from Quantico Lane. The sign shall
include the telephone number of the City's Park and Recreption Division.
10. The applizant shall indicate a sketch of a parking lot adjacent to the street for the future park,
on all future plans submitted for this area.
11. Compliance with the Tree Preservation Ordinance. The first Final Plat submission shall
include a complete landscape plan indicating the size, location, and species of the 119 caliper
inches of trees required for reforestation.
12. Development Standards shall be as requited by the RSF-2 district. No variances are granted
or implieJ.
13. The applicant must vetition for of vacation of the existing drainage and utility easement
running from the intersection of Schmidt Lake Road and Quantico Lane northerly to the
railroad tracks, and for a portion of Schmidt Lake Road lying within proposed Block 6.
14. The applicant must petition for of vacation of existing Schmidt Lake Road right-of-way
(southerly alignment) for the area within proposed Block 6.

15. Prior to issuance of the grading permit, the applicant shall obtain the required NPDES permit
as well as approval of the MPCA, State Health Department, Bassett Crock Watershed
District, Shingle Creek Watershed District, and Army Corps of Engin-.m.
16. Sanitary sewer must be extended north from Orchid Lane to provide service for the eastern
two-thirds of the site.
17. Lots abutting Quantico Lane, 5 V Avenue west of Polaris Court, and Polaris Court may be
reviewed for final plat approval at this time. The Final Plat applicant shall not be submitted
on the remainder on the lots until the City has awarded a contract for construction of Schmidt
Lake Road.
18. A temporary cul-de-sac will be required at the end of 51" Avenue at the west line of the plat,
or there shall be no driveways wet of Quantico Lane.
19. Rate control will be required for storm drainage for the one-, five-, ten-, 25-, and 100 -year
stone.
20. Standard Conditions:
A. Compliance with the City Engincer's Memoraittlum.
B. Removal of all hazardous trees from the prope•ty at the owner's expense.
C. No building permits shall be issued until a contract has been awarded for sewer
Rnd water.
D. Street names shall comply with the City Street Naming System.
E. Compliance with Policy Resolution 79.80 regarding minimum floor elevations for
new structures on sites adjacent to, or containing any open storm water drainage
facility.
F. No building permits shall be issued until the Final Plat is filed and recorded with
Hennepin County.
G. Private driveway access shall be limited to internal public roads and restricted
from Schmidt Lake Road.
H. Drainage easements for ponding shall be pro%ided to the 100 year high water
elevation for each of the ponds on the site, and
1. Location and number of fire hydrants shall be approved by the Fire Division.
J. Submittal of fire flow data with the Final Plat.
K. A maintenance agreement is requited between the Developer and the City for the
water quality ponds.
L. Submission of a Site Improv_ment Performance Agreement prior to issuance of
building permits. The Site Improvement Performance Agreement shall include,
but not be limited to, the required landscaping and wetland buffer monumentation.

M. The Developer shall hold the City and its officers, employees, and agents
harmless from claims made by itself and third parties for damages sustained or
costs incurred resulting from plat approval and development. The Developer shall
indemnify the City and its officers, employees, and agents for all costs, damages,
or expenses which the City may pay or incur in consequence of such claims,
including attorneys' fees.
