FOR FRENCH RIDGE G LOT PARK THIRD ADDITION LOCATED NORTH OF P1 ELIMINARY PLAT AND FINAL PLAT FOR J7MNIUM INC. FOR COURT NORTH AND SOUTH OF ROCKFORD ROAD (97162) WHEREAS, Janco, Inc. has requested approval of a lot division, preliminary plat and final plat for approximately 1.38 acres located north of Xenium Court North and south of Rockford Road; and WHEREAS, the property is presently legally described as Lots 11-16 and 33, Block 1, French Ridge Park Y° Addition; and WHEREAS, Janco, Inc. has requested approval of a Lot Division to create two parcels of land from Lot 33, Block 1, French Ridge Park Second Addition, as legally described on Attachment One, attached hereto and hereby made a part hereof; and WHEREAS, the proposed lot arrangement for the Lot Division would revise the lot, as legally described on Attachment Two, attached hereto and hereby made a part hereof; and WHEREAS, the Planning Commission has reviewed the requested preliminary plat at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the lot division, preliminary plat and final plat for French Ridge Park Third Addition for property located north of %eniwo Court North and south of Rockford Road, subject to the following conditions: 1. 'chis lot division is for the creation of two lots, in accordance with the plans received by the City on October 24, 1997, -,xcept as amended by this resolution. 2. A preliminary plat and final plat is approved for the creation of eight lots in French Ridge Park Third Addition, in accordance with the plans received by the City on October 24, 1997, except as amended by this resolution. 3. Standard Conditions: [] Res. 97-706 Pap a. Compliance with the City Engineees Memorandum. b. Removal of all hmardous trees from the property at the owner's expense. c. Compliance with Policy Resolution 7940 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. E The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims. including attorneys' fees.
