RESOLUTION 97.706
INC. FOR FRENCH RIDGE G LOT PARK THIRD ADDITION LOCATED NORTH OF P1 ELIMINARY PLAT AND FINAL PLAT FOR J7MNIUM
INC. FOR
COURT NORTH AND SOUTH OF ROCKFORD ROAD (97162)
WHEREAS, Janco, Inc. has requested approval of a lot division, preliminary plat and final plat
for approximately 1.38 acres located north of Xenium Court North and south of Rockford Road;
and
WHEREAS, the property is presently legally described as Lots 11-16 and 33, Block 1, French
Ridge Park Y° Addition; and
WHEREAS, Janco, Inc. has requested approval of a Lot Division to create two parcels of land
from Lot 33, Block 1, French Ridge Park Second Addition, as legally described on Attachment
One, attached hereto and hereby made a part hereof; and
WHEREAS, the proposed lot arrangement for the Lot Division would revise the lot, as legally
described on Attachment Two, attached hereto and hereby made a part hereof; and
WHEREAS, the Planning Commission has reviewed the requested preliminary plat at a duly
called Public Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the lot division,
preliminary plat and final plat for French Ridge Park Third Addition for property located north of
%eniwo Court North and south of Rockford Road, subject to the following conditions:
1. 'chis lot division is for the creation of two lots, in accordance with the plans received by the
City on October 24, 1997, -,xcept as amended by this resolution.
2. A preliminary plat and final plat is approved for the creation of eight lots in French Ridge
Park Third Addition, in accordance with the plans received by the City on October 24, 1997,
except as amended by this resolution.

a. Compliance with the City Engineees Memorandum.
b. Removal of all hmardous trees from the property at the owner's expense.
c. Compliance with Policy Resolution 7940 regarding minimum floor elevations for new
structures on sites adjacent to, or containing any open storm water drainage facility.
d. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
e. No building permits shall be issued until the Final Plat is filed and recorded with
Hennepin County.
E The Developer shall hold the City and its officers, employees, and agents harmless from
claims made by itself and third parties for damages sustained or costs incurred resulting
from plat approval and development. The Developer shall indemnify the City and its
officers, employees, and agents for all costs, damages, or expenses which the City may
pay or incur in consequence of such claims. including attorneys' fees.

Hennepin County, Minnesota, lying northerly of the following described line:
Beginning at a point on the west line of said Lot 33, said point being at the intersection of the
westerly extension of the northerly line of Lot 10, said Block 1, the wen line of the said Lot
33 has an assumed bearing of north 0 degrees 08 minutes 22 seconds east; thence on a
bearing of east along said extension ant along said northerly line of Lot 10 and along the
easterly extension of said northerly line of Lot 10, a distance of 133.10 feet to the intersection
of the westerly right-of-way line of Xenium Court cul-de-sac as dedicated in French Ridge
Park Second Addition; thence northeasterly, easterly and southeasterly 91.10 feet along a
nontangential cum, concave to the south, having a radius of 50.00 feet and a central angle of
104 degrees 23 minutes 42 seconds, the chord bees north 79 degrees 26 minutes I I seconds
east and a chord distance of 79.01 feet; thence north 41 degrees 38 minutes 02 seconds east,
not tangent to last curve, 31.29 fee. to the no,thwest corner of Lot 17, Block I a krench Ridge
Park Second Addition; them north 71 degrees 53 minutes 50 seconds east along the
northerly line of said Lot 17 to the northeast concern of said Lot 17; thence north 10 degrees
21 minutes 43 seconds west 25.58 feet to an angle point in the north line of said Lot 33 and
said line there terminating.
