HomeMy WebLinkAboutCity Council Resolution 1997-705• C1117Y OF PLYMOUTH RESOLUTION 97-705 APPROVINI, VARIANCE REQUEST FOR M.A. MORTENSON COMTANY FOR DIRECTIONAL SIGNAGE AT NVAYZATA SENIOR HIGH SCHOOL AND ELM CREEK PLAYFIELDS LOCATED AT 4955 PEONY LANE NORTH (97142). WHEREAS, M.A. Mortenson Company has requested approval of variances to allow six directional signs which exceed the four square foot maximum directional sign area for Wayzata High School and the Elm Creek Playtields, and; WHEREAS, the subjort property is legally described as: Parcel 1: The Southwest Quarter of the Northeast Quarter of Section 7, Township 118, Range 22, Hennepin County, Minnesota, according to the Go, -ernment Survey thereof. Parcel 2: All of the Northwest Quarter of the Northeast Quarter of Section 7, Township 118, Range 22, except the North 980.00 feet thereof, according to the Goverment Survey thereof, Hennepin County Minnesota. Parcel 3: The East'h of the East Va of the Northwest V4, in Section 7, Township 118 North, Range 22 West of the 5' Principal Meridian according to the Government Survey thereof, Hennepin County, Minnesota. Parcel 4: The West''Va of the East Ya of the Northwest''/. of Section 7, Township 118, Range 22, according to the Government Survey thereof, Hennepin County, Minnesota. • • Fees. 97-703 Page 2 Parcel S: That part of the East 'A of the East '/2 of the Suuthwest '/4 of Section 7, Township 118 North, Range 22 West of the 3" Principal meridian, according to the Government Survey thereof, which lies north of the northerly right of way line of the Minneapolis, St. Paul and Sault Ste. Marie Railroad Company. Subject to an easement for road purposes and for ingress and egress over the North 80 feet of above land. Said easement is for the benefit of and appurtenant to, the East'/. of the Northwest'/. of said Section, and is to connect with an easement for the same purposes over the North 50 feet of the West'/ of the Southeast 'A of said Section, as shown in Dad Doc. No. 983463, Files of Registrar of Titles. Parcel 6: That part of the West '/4 of the Southeast '/. of Section 7, Township 118, Range 22, according to the Government Survey thereof, which lice North of the northerly right of way line of the Minneapolis, St. Paul and Sault Ste. Marie Railroad Company. Parcel 7: The East X, of the West '% of the Southeast Quarter of Section 7, Township 118 North, Range 22 West of the 5th Principal Meridian, which lies North of the northerly right of way line of the Minneapolis, St. Paul and Sault Ste. Marie Railroad Company. Subject to the rights of the public in Peony lane over the Easterly 33 feet of Parcel 7. WHEREAS, the Planning Commission has reviewed said request at a duly called Public meeting and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by M.A. Mortenson Company for six variances based on the finding that the variance standards have been met, subject to the following findings and conditions: 1. This variance allows installation of six directional signs which exceed the four square foot sign area permitted by ordinance. The approval is for six signs of the following approximate sizes: 13 square feet, 12 square feet, 10 square feet, two 9 square feet and 6 square feet, in accordance with the application received by the City on September 17,1997. 2. Wayzata High School is a 487,000 square foot building on a 161 -acre site. The physicol size of the campus and the adjoining City playfields causes the need for larger directional signs to identify various areas on the site. Res. 97-705 Page 3 LA 3. The conditions upon which the variances are requested are unique to this parcel ante not applicable to other property within the same zoning district. This 161 -acre sits is a unique development containing the 487,000 square foot Wayzata High School—the largest building in Plymouth --and the City -owned Elm Creek Playfields. 4. The variance request is not based exclwrively upon a desire to increase the value of the property. 5. The hardship is caused by this Chapter and is not a self-created hardship. The current sign regulations do not address the needs of major, large-scale developments. 6. Granting the variance will not be detrimental to the public welfare or injurious to other land in the neighborhood. 7. The proposed variance would not impair an adequate supply of light and air to adjacent prop.-rty, or substantially increase the congestion of the public streets, or increase the danger of h, ., or endanger the public safety, ur substantially diminish or impair property values within the neighborhood. 8. The variance is the minimum action required to eliminate the hardship. Adopted by City Council on November 19, 1997. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
