RESOLUTION 97-703
APPROVING SITE PLAN AND CONDITIONAL USE PERMITS FOR CREEKSIDE,
LLC FOR PROPERTY LOCATED IN THE SOUTHEAST QUADRANT OF
HIGHWAY 55 AND NATHAN LANE (97122)
WHEREAS, Creekside, LLC has requested approval of a site plan for a 204 -unit
apartment building located on p&vperty legally described as Outlot A. Willow Grove
Office Park Second Addition; and
WHEREAS, Creekside, LLC has also requested approval of two conditional use permits
to allow 1) off-site parking, and 2) increased building height; and
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Creekside, LLC for a site plan and two conditional use permits, subject to the
following conditions:
I. A site plan is approved for a 204 -unit apartment building, in accordance with the
plans received by the City on October 9, 1997 and October 23, 1997, except as
amended by this resolution.
2. A conditional use permit is approved to allow off-site parking on the adjacent 121 -
space parking lot located directly to the south on the theater site with the finding that
all parking spaces would be within 300 feet on an entrance and the applicable general
standards are met.

3. A conditional use permit is approved to allow a building height of 38.2 feet with tate
fmding that 1) the additional setback required for the proposed height would be
provided, 2) the building would not limit solar access to neighboring properties, and
3) the applicable general standards are met.
4. Nor to the issuance of the grading permit, the applicant shall receive Approval of the
wetland mitigation plan.
5. Prior to issuance of the grading permit, the applicant shall obtain the required NPDES
pernit, as wen as approval of the Bassett Crate Watershed District and Army Cones
of Engineers.
6. Prior to issuance of building permits, the applicant shall provide evidence of a
recorded perpetual parking easement to ensure that the apartment building maintains
use of the adjaccui 121 -space off site parking lot.
7. Prior to the issuance of building permits, all plan sheets must be signed.
8. Prior to issuance of building permits, the lighting plan must be revised to maintain .5
foot-candles on the site or at the centerline of the street.
9. The developer shag construct an eight -foot wide bituminous trail in accordance with
City specifications on the east side of Nathan Lane. The applicant shall also provide a
ten -foot wide trail easement along the western boundary of the site.
10. The applicant shall provide two walkways leading from the off-site parking lot to the
building. The materials used for the walkways shall utilize a different color and
pattern where they cross over the drive aisle.
11. Prior to issuance of building permits, wetland buffer monumentation shall be
provided for the 25 -foot wide buffer area to be maintained along the southeast portion
of the building, consistent with Section 21670.07 of the Zoning Ordinance.
12. All waste containers shall be stored within the building.
13. Any signage shall comply with the sign regulations of the Zoning Ordinance.
14. The 15 -space parking bay located northeast of the building shall be signed for
compact parking so that all required parking setbacks can be maintained.
15. Prior to issuance of building permits, the plans shall be revised to remove the curbing
from the interior of the cul-de-sac located east of the building.

16. Prior to issuance of building permit% a devil for the retaining was shall be provided.
17. Prior to issuance of building permitk the site plan shall be revised in indicate the
location of the fire lane, which requires eight inches of Class 5 (100 percent crushed
rock), two inches of 2331 base, and 1.5 inches of 2341 wear.
18. This resolution approves a Fire Code Variance to the requirement for a fire lane
within 50 feet of the southeast portion of the building, subject to the condition
outlined in the Fire Inspector's Memorandum dated November 6* 1997.
19. The Final Plat shall include drainage and utility eaxments of ten feet in width along
all streets and six feet in width along all side or rear lot lines.
20. The Final Plat shall include easements for the pons to the 100 year high water
elevation
21. Prior to issuance of building permit% the applicant shall enter into a pond
maintenance agreement with the City for maintenance of the water quality pond.
22. All water connection shall be via wet tap.
23. Prior to issuance of building permits, calculation shall be provided for the sanitary
sewer to enure that the six-inch service line can handle the two eight"nch lines
connecting to the existing services.
24. A cash deposit in the amount of $11000 will be reqiod of five Years
o the proposed
guaranteeing the street repair for the watermain tap s the forth side
plat. This cash deposit shall be submitted prior to issuance of building permits.
25. Granular material shell be used for backfilling the trench within the street for the
watermain connection.
26. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for
new structures on sites adjacent to, or containing any open storm water drainage
facility.
C. Submission of the required Financial Guarantee and Site Performance Agreement
for completion of site improvements within twelve months of the date of this
Resolution.

D. Any subsequent Abases or expansions are subject to required reviews and
approvals per Ordinance provisions.
