HomeMy WebLinkAboutCity Council Resolution 1997-701n CITY OF PLYMOUTH RESOLUTION 97 - 701 LOC APPROVINGNORTH OF ROCKFORD ROAD BETWEEN PARTNERS, 94 AND BERKSHIRE LANE (97070-F)PROPERTY TED WHEREAS, Baser Partners, Inc. has requested approval of a final plat for "Plymouth Collection", con Bining roughly eight acres located in the northwest quadrant of 1-494 and Rockford Road; and WHEREAS, the final plat consists of four commercial lots in the Plymouth Collection PUD, and WHEREAS, the Development Review Committee has reviewed said request and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Baker Partners, Inc. for a Final Plat for Plymouth Collection, subject to the following conditions: 1. The Final Plat is approved for the creation of Lots 1 through 4, Block 1, Plymouth Collection, in accordance with the plat and plans received by the City on October 23, 1997, except as amended by this resolution. 2. A 20 -foot wide drainage and utility easement will be required over the relocated sanitary sewer. 3. Drainage easement for ponding will be required over all wetland areas to the 100 year elevation. 4. The applicant must apply to vacate that portion of the sanitary sewer that is be to relocated from Manhole 2 northerly. • n Resolution 97-701 (97070-F) Page 2 3. The applicant must apply to vacate the 20 -foot wide drainage and utility easement mmning north to south through the mid-section of the site. 6. The applicant shall obtain the required NPDES permit, as well as the necessary permits from the Bassett Creek Watershed District and Hennepin County. 7. The Grading, Drainage, and Erosion Control Plan must be revised to indicated the required crushed rock berm construction entrance. 8. A maintenance agreement is required between the Developer and the City for the water quality ponds. 9. Cross -casements for access, driveways, parking, and utilities shall be filed with the Final Plat. 10. Berkshire Lane must be restriped to provide for dual left tum lanes and a combined through - right -turn lane. This may also require a split phased operation on the Berkshire/Annapolis approaches to Rockford Road, which Hennepin County controls. Prior to building permit issuance for any of the buildings, the County shall have agreed to these changes. Any costs related to these required improvements will be the responsibility of the developer. It. Plan and profile sheets for the sanitary sewer shall be submitted for staff review and approval. A financial guarantee for the sewer shall be included in the Planning Division Site Improvement Performance Agreement (SIPA). A two-year maintenance bond will be required for the sanitary sewer relocation. 12. The existing trail easement and document number must be shown on the Final Plat. 13. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. Compliance with the Ordinance regarding the location of fire hydrants, post indicator valves, fire department connections, fire lanes, and fire lane signage. e. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. f. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. g. Access shall be restricted from 1.494 and Rockford Road. • • Resolution 97-701 (97070-F) Page 3 h. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurrod resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. L No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. j. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. Adopted by the City Council on November 19, 1997.
