HomeMy WebLinkAboutCity Council Resolution 1997-6969 CITY OF PLYMOUTH RESOLUTION 97.06 APPROVING A CONDITIONAL USE PERMIT FOR HARTY'S BOAT AND BAIT BUSINESS FOR PROPERTY LOCATED AT 1920 AND 2900 EASE MEDICINE LAKE BOULEVARD (97121) WHEREAS, Mr. Joe Harty, 2900 East Medicine Lake Boulevard is the uwner and operator of the non -conforming commercial business known as Harty's Boat and Bait at 1920 East Medicine Lake Boulevard and at 2900 East Medicine Lake Boulevard; anu; WHEREAS, the operation involves the rental of recreational and fishing water craft. the sale of bait for fishing, the sale of fishing licenses and the rental of docking clips, lifts and buoys for the storage of craft on the water during season; and; WHEREAS, the operation at both locations has Veen legally non -conforming since the residential zoning was established, at lea.;t since 1968; and; WHEREAS, the legal description of such properties are as follows: 1920 East Medicine Lake Boulevard, ALSO known as: Lot 15, Block 16, Medicine Lake Park 3" Division, Hennepin County, Minnesota. AND 2900 East Medicine Lake Boulevard, ALSO known as: All that part of Lots 7 and 36, Auditor's Subdivision Number 333, Hennepin County, Minnesota described as follows: Beginning at a point 896.6 feet south of the north line of Government Lot 2, Section 24, Township 118, Range 22, and 769 feet west of the east line of said Government Lot 2; thence south 8 degrees 41 minutes east, 153.3 feet; thence Routh 72 degrees 07 minutes west, 233.9 feet to the center line of Town Road; thence south 22 degrees 22 minutes east along the center line of said Town Road, 8 feet; thence south 67 degrees 01 minutes 'est, 101.5 feet, more or less, to the shore of Medicine Lake; thence northwesterly along the shore of said Medicine Lake to a point 896.6 feet south of the • C Resolution 9796 Page 2 north line of said Government Lot 2 and which point is on the north line of the above described tract; thence east 413 feet, more or less, to the point of beginning. WHEREAS, the City Council is aware of the intensified use of Medicine Latae for recreational purposes and for fishing, as wed as the increasing urbanization of ureas around Medicine Lake; and, WHEREAS, the slwrelaad of Medicine Lake is subject to the requirements of the State and City' Sboreland Management regulations, and other applicable regulations ns administered by the Department of Natural Resuurces(DNR) and the Hennepin CtMrnty Stain's Water Patrol; WHEREAS, ft Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, 'THEREFORE, BE TT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CTTI' OF PLYMOUTH, MINNESOTA, that it should and hereby does make the following fundings and establish the following conditions regarding the non-confotmutg commercial use (mown as Harty's Boat Rental: 1, The Harty's Boat and Bait operation is a ton -conforming commercial use of lam in a residential zotdng district within the meaning and requirements of the Plymouth Zoning Ordinance subject to the following conditions: 1. Storage for 19 fishing boats. 2. 5 buoys for anchoring sailboats and 7 boat lifts. 3. A 200' dock that includes 6 boat lifts. 1. Storage for 2 fishing boats. 2. Buoys for up to 19 sailboats. 3. 30 boat lifts used for watercraft. 4. 3 -125' long docks each containing 10 slips for a total of 30 slips. Any further changes to the operation beyond these conditions and by this resolution shall be subject to review and approval by the City within the limitations of the Plymouth Zoning Ordinance non -conforming mse provisions. 2. Any proposed site modifications, physical alterations, or improvements, such as, but not limited to paving, extension of dock piers, lifts, or the introduction or removal of buildings shall be reviewed and approved by the City and shall be subject to the applicable requirements of the Zcning Ordinvice and other codes 0 Resolution 97-696 Page 3 and regulations which may govern, such as shoreline management regulations, regulations of the Department of Natural Resources(DNR), and regulations of the Hennepin County Sheriffs Watir Patrol. 3. The operation is subject to all applicable zoning, traffic and nuisance regulations, and verified violation of said regulations shall serve as a basis for revocation of the Conditional Use Permit for Harty's Boot and Bait business operation. 4. These findings constitute a definition of a recognized non -conforming use of land and do not ronstitute the granting of variances from present Ordinance requirements. 5. A copy of this resolution shall be appropriately filed and recorded at Hennepin County, relative to each of the properties involved. Adopted by the City Council on November 5, 1997.
