RESOLUTION 97 - 670
APPROVING PRELIMINARY PLAT FOR CARLSON REAL ESTATE COMPANY FOR
PROPERTY LOCATED AT THE SOUTHEAST QUADRANT OF I-494 AND CO. RD. 6

WHEREAS, Carlson Real Estate Company has requested approval of a Preliminary Plat for
property legally described as follows; and
Parcel 1:
Lot 1, Block 1, Litton Addition, except that part thereof described as follows: Beginning at
the Southwest corner of said Lot 1; thence North 300 feet along the West line of said Lot 1;
thence East at right angles 45 feet; thence South and parallel with tie Wet line of said Lot I a
distance of 285.75 feet to the Southerly line of said Lot 1; thence Southwesterly along the
Southerly line of said Lot 1 a distance of 47.20 feet to the point of beginning, according to the
plat thereof on file or of record in the office of the Registrar of Titles in and for said County,
according to the recorded plat thereof, and situate in Hennepin County, Minnesota.
Parcel 2:
Lot 2, and the East 40.00 feet of the North 271.46 feet of Lot 3. That part of said Lot 3 lying
South of the North 271.46 feet and which lies East of the following described line:
Commencing at the Southeast corner of said Lot 3; thence on an assumed bearing of South 87
degrees 45 minutes 47 seconds West along the South line of said Lot 3 it distance of 110.02
feet to the beginning of the line to be described; thence North 1 degree 16 minutes 20 seconds
West of the North line of said Lot 3 and there terminating; all in Block 1, Litton Addition,
according to the plat thereof on file or of record in the office of the Registrar of Titles in and
for said County, according to the recorded plat thereof, and situate in Hennepin County,
Minnesota.

Parcel 3:
East 200 fat of West 350 feet of North 200 feet of East 'k of Southeast % of Southwest Sf
Section 27, Township 118, Range 22, according to the United State Government Survey
thereof and situate in Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Carlson Real Estate Company for a Preliminary Plat, subject to the following conditions:
1. A Preliminary Plat is approved for the creation of one lot, in accerdance with the plat and
plans received by the City on October 3, 1997, except as amended by this resolution.
2. A six-foot wide sidewalk shall be constructed along the east side of the property adjacent to
Xenium Lane. The grading plan and site plan shall be revised to show the sidewalk.
3. The developer's engineer shall submit calculations showing that the existing NURP pond,
as revised with Home Depot, has the capacity to handle the additional run-off fron the new
parking areas, if capacity is not available the pond must be enlarged.
4. A document, in recordable form, shall be submitted stating that Lot 1, Block 1 shall have
no access to I-494.
5. There shall be no access to County Road 6 and Xenium Lane, except for the existing
access on County Road 6 and Xenium Lane.
6. Standard Conditions:
a) Compliance with the City Engineer's Memorandums.
b) Compliance with Policy Resolution 79-80 regarding minimum floor elevations for
new Stru :tures on sites adjacent to, or containing any open storm water drainage
facility.
c) Any subsequent phases or expansions are subject to required reviews and approvals
per Ordinance provisions.
d) The Developer shall hold the City and its officers, employees, and agents harmless
from claims made by itself and third parties for damages sustained or costs incurred
resulting from plat approval and development. The Developer shall indemnify the
City and its officers, employees, and agEnts for all costs, damages or expenses
which the City may pay or incur in consequence of such claims, including
attorneys' fees.

e) No certificate of occupancy shall be issued until the Final Plat is filed and recorded
with Hennepin County.
f) Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
